Subject: Preliminary Waters of the U.S. Jurisdictional Determinations

This report summarizes the results of CEC's desktop and on-site Preliminary Jurisdictional
Waters Determination(PJWD) conducted for City of Hickory totaling approximately 2.14 acres,
in or near the city of Hickory, in Catawba County of North Carolina(Project or Project Areas)
There are two distinct project areas, denoted as PA 1 or PA 2, which are located by Eller Drive
and Lutz Boulevard respectively; PA 1 has a total acreage of 1.46 and PA 2 has a total acreage of
0.68.
The purpose of this desktop assessment and on-site wetlands and waters investigation was to
provide a preliminary jurisdictional opinion on the presence or absence of potential jurisdictional
Waters of the United States (WoUS) within the designated Project Areas, for preliminary
planning purposes.
1.0 BACKGROUND
WoUS are defined by the United States Army Corps of Engineers (USACE) and the U.S.
Environmental Protection Agency(EPA) as"those areas that are inundated or saturated by surface
or groundwater at a frequency and duration sufficient to support, and under normal circumstances,
do support a prevalence of vegetation adapted for life in saturated soil conditions."In order for an
area to be classified as a jurisdictional wetland,hydrophytic vegetation, hydric soils, and wetland,
hydrologic indictors must be present, and must be adjacent to a jurisdictional non-wetland water
(tributary) of the United States.
In North Carolina, the USACE and the EPA jointly regulate the discharge of dredged and fill
material within jurisdictional WoUS under Sections 401 and 404 of the Clean Water Act and
Section 10 of the Rivers and Harbors Act of 1899. WoUS includes territorial seas, navigable
coastal and inland lakes, rivers and tributaries (perennial and intermittent), and wetlands.
Jurisdictional features include wetlands, open waters, ponds, lakes and perennial/intermittent
tributaries. Jurisdictional features are regulated by the USACE and North Carolina Department of
Environmental Quality, Division of Water Quality(NC DEQ). Permit requirements are specific to
the type, location and amount of impacts, if proposed. Stormwater management plans and/or
mitigation for proposed impacts could be a requirement of the permit approval process.

This updated assessment can be used to assist the City of Hickory with a preliminary review of
the Project Areas only and is not considered final until verified by the USACE. The following
supporting documents are provided:

2.0 SITE CONDITIONS AND DESKTOP REVIEW
The Project is approximately 2.14 acres and currently consists predominantly of undeveloped
woods (Figures 1 & 3). Surrounding land use consists mainly of commercial and residential
development. Prior and during the investigation Catawba County was not considered abnormally
dry per http://www.ncdrought.org/. Additionally, queries were made of the USACE Antecedent
Rain Database, indicating that recent rainfall occurred in the Project Areas and the 30-day rolling
total was above the 70th percentile that correlates to the 30-year rolling total. (Attachment A)
A review of available topography information shows the surrounding area to be gently to
moderately sloping (Figure 2). The Project contains elevations ranging from approximately 900
above mean sea level (amsl) to 987 feet amsl. Overland flow from the Project Areas generally
drains in a South and South East direction. In the first Project Area (PA 1), Muddy Creek runs
through PA 1 and flows South/Southeast. One Unnamed Tributary (UT) is indicated within the
Project Areas specifically in Project Area 2 (PA 2), and drains into Muddy Creek in the Southwest
direction.
A review of the published and on-line National Resource Conservations Service (NRCS) Soil
Surveys for Catawba County indicates there are potential for hydric, or wetland, soils within the
Project Area. The Codorus and Dan River Soil Series is indicate on the on-line soil survey along
with the Chewacla series on the published soil survey(Figures 4A and 4B). While these Soil Series
are not hydric by soil taxonomy standards they can have inclusions of hydric soils due to landscape
position and slow permeability.
Two Unnamed Tributaries (UT) are indicated on the published soil survey. The UT located in PA
1 originates North of the Project Area and continues south throughout, and the UT located in PA
2 originates Northeast of PA 2 (Figure 4B).

A review of the National Wetlands Inventory (NWI) map indicates there is potential WoUS,
stream, within both of the Project Areas. (Figure 5). The NWI map appears to concur with the
USGS map.
3.0 WATERSHED CLASSIFICATION AND BUFFER REQUIREMENTS
According to the NC DEQ, the Project is in the eight digit (Hydrologic Unit Code [HUC]-8:
(03050102) Catawba River Basin, the ten digit [HUC]-10: (0305010201) Henry Fork, and the
twelve digit [HUC]-12: (030501020103) Lower Henry Fork. Henry Fork is classified as "Class C
Waters" by the NC DEQ. Class C waters are defined as: Waters protected for uses such as
secondary recreation, fishing, wildlife, fish consumption, aquatic life including propagation,
survival and maintenance of biological integrity, and agriculture. Secondary recreation includes
wading, boating, and other uses involving human body contact with water where such activities
take place in an infrequent, unorganized, or incidental manner.
Mandatory vegetative riparian buffers are not required by the NC DEQ based on the site locality
within the Catawba River Basin.Based on observations,potential jurisdictional surface waters that
may be subject to vegetative buffers are located on the site. Development or stormwater setbacks
that are specific to the proposed development of the site could be required by the NC DEQ.
Consultation with the local zoning authority is recommended to determine site specific vegetation
buffers adjacent to the features located on the site prior to submittal for zoning approval.
4.0 PRELIMINARY JURISDICTIONAL REVIEW
This assessment utilized the 1987 USACE Wetland Delineation Manual, the 2018 Version 8.2
Field Indicators of Hydric Soils of the United States along with the USACE 2010 Regional
Supplement: Supplemental Guide ERDC/EL TR-12-9 (Eastern Mountains and Piedmont Region
(Version 2.0), Wilmington,NC District office.
Potential jurisdictional areas were delineated (flagged in the field), classified, and mapped with a
sub-foot Trimble Geo7X GPS unit using the USACE Routine On-Site Determination Method.
Data representative of on-site jurisdictional wetland areas, excluded waters, and non jurisdictional
upland areas was collected and reported using Wetland Determination Data Forms (Attachment
A).
Potential jurisdictional tributaries and excluded waters were classified according to NC DWQ
Stream Identification Form Version 4.11. CEC utilizes the NC DWQ stream classification forms
in order to document on-site stream conditions as requested by the USACE Wilmington District
field and Satellite offices. These classifications include sampling with a soil hand auger and D-
shaped dip net, collecting photographic documentation, and defining approximate breakpoints
(location at which stream changes classification) within each on-site stream channel. NC DWQ
Stream Classification Forms representative of on-site stream channels were used to document
stream conditions (Attachment B).

Representative photographs were taken of on-site aquatic features and existing site conditions
(Attachment C). The locations of mapped wetlands and other WoUS, Stream Classification Points
(SCP), Wetland or Upland Determination Data Points (DP) are depicted on (Figure 6).
5.0 RESULTS
On October 2nd, 2020, CEC ecologists Caleb Cantrell, and Kevin Thomas, Professional Wetland
Scientist (PWS) & North Carolina Licensed Soil Scientist (NC LSS) delineated potential
jurisdictional WoUS features, within the Project Areas. Based on the results of the field
investigation, there are two features that would likely be considered potentially jurisdictional
within the Project Areas (Figure 6).
The two potentially jurisdictional features total approximately 429 linear feet (1.f.) of perennial
(a)(2) tributary channels.
Tributaries
Two potential jurisdictional tributary channels exist within the Project Areas (Figure 6; Table 1).
PA 1 contains one Stream Area (SA) 1 that originates along the north portion of the Project Area
and flows southwards out of the Project Area. SA-1 within PA 1 exhibits perennial flow and
characteristics throughout the entirety of its area within the Project Area.
PA 2 contains one SA-1 that originates in the northeastern portion of the Project Area and flows
in a southwestern direction confluencing with the perennial stream that flows out of PA 1.
On-site perennial tributaries exhibit year-round flow with strong geomorphological, hydrological,
and biological characteristics. The on-site perennial tributary generally included soil based
evidence of high water table, iron oxidizing bacteria, strong continuity of channel bed and bank,
with some aquatic biological activity.

boundaries (Attachments A, B and Attachment C; Photographs 7-9 to 17-19). However, these
findings can only be considered preliminary and is not an official governmental approval. The
results of the on-site field investigation conducted by CEC indicate that there are no potentially
excluded features within either Project Area.
6.0 RECOMMENDATIONS
The Report provided by CEC represents our best professional judgment regarding the potential
of on-site wetlands, tributaries, other water features, and excluded waters at the time of the
investigation that can be used for preliminary project planning only. Potential jurisdictional
waters are present on the Project Area, which are regulated by the USACE and/or NC DEQ.
Additionally there are potentially excluded waters present within the Project Area. However,
until a Jurisdictional Determination(JD) is issued by the regulatory agency, these findings can
only be considered preliminary and is not an official governmental approval. CEC recommends
that before any construction or other earth disturbance activities occur on site, a formal JD
should be obtained from the USACE.
