Please find attached the Minor Variance form relating to Mr and Mrs Rick Norwood's
personal residence located at 2020 Fernwood Way Henderson North Carolina 27536
When Mr Norwood applied for a zoning permit from the City of Henderson to construct his new
residence a site plan was included with the application for the zoning permit review
The zoning permit was approved by the City of Henderson and Mr Norwood proceeded to acquire a
building permit from Vance County Code Enforcement Department
All construction permits were issued and the residence was constructed There was no reference
regarding a (50 Foot) buffer from the small creek located on the right side of the residence by the City
Of Henderson or Vance County Code Enforcement Department
Approximately a year later Mr Norwood applied for a zoning permit to construct a small utility
storage building on the property When this was reviewed by the City Engineer it was discovered that
the utility building and existing residence infringed on the 50 foot buffer rule
At that point Mr Norwood contacted your department to seek relief and for a minor variance
Please find enclosed the application for a minor variance a site plan of the existing residence and the
proposed location for the utility building
Also attached you will find a Flood Hazard Determination Form that indicates that the structures are
not in a flood hazard area
The residence has been landscaped and the entire area that was disturbed has been seeded in grass
There is no erosion on the site There was no area pertaining to the creek banks that was disturbed
during construction of the residence
We would hope that the variance for the existing structure and the placement of the utility building
would be granted

Part 4 Proposed Impacts and Mitigation
Provide a description of how mitigation will be achieved at your site pursuant to 15A NCAC 2B 0242
for the Neuse Basin and 15A NCAC 2B 060 for the Tar Pamlico Basin
If buffer restoration is the method you are requesting, be sure to include a detailed planting plan to
include plant type date of plantings the date of the one -tune fertilization in the protected riparian
buffers and a plan sheet showing the proposed location of the plantings A guide to buffer restoration
can be downloaded at the following website
If payment into a buffer restoration fund is how you plan to achieve your mitigation requirement, then
include an acceptance letter from the mitigation bank you propose to use stating they have the
mitigation credits available for the mitigation requested

required by this vanance shall be located to recorded stormwater easements that the easements will
run with the land, that the easements cannot be changed or deleted without concurrence from the
