Dear Mr. Willette:
In accordance with your renewal request received November 4, 1985, we are
forwarding herewith Permit No. 9941-R, dated January 2, 1986, to James B.
Willette for continued operation of the subject non -discharge type wastewater
treatment and disposal facilities.
This permit shall be effective from the date of issuance until January 31,
1991, and shall be subject to the conditions and limitations as specified therein.
if any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing before a
hearing officer upon written demand to the Director within thirty (30) days
following receipt of this permit, identifying the specific issues to be con-
tended. Unless such demand is made, this permit shall be final and binding.

PERMIT
For the Discharge of Sewage, industrial Wastes, or other Wastes
In accordance with the provision of Article 21 of Chapter 143, General
Statutes of North Carolina as amended, and other applicable Laws, Rules, and
Regulations -

FOR THE
. continued operation of a 450 GPD non -discharge, land application/spray irrigation
type wastewater treatment and disposal -facilities consisting of a 1200 gallon
capacity baffled septic tank, a recirculation/pump tank with single 15 hp
recirculation pump and minimum recirculation ratio of 3 to 1, a 300 square feet
surface sand filter, a flow splitter box, a tablet -type chlorinator, an irrigation
pump tank with a single 16 GPM irrigation pump and 2000 gallon capacity for
wastewater storage, a 6,800 square feet irrigation area and associated piping,
valving, sprinklers, and appurtenances to serve Lot No. 10 of the James B. Willette
Subdivision with no discharge of wastewater to the surface waters of the State.
pursuant to the application received November 4, 1985, and in conformity with the
project plans, specifications, and other supporting data, subsequently filed and
approved by the Department of Natural Resources and Community Development and
considered a part of this permit.
This permit shall be effective from the date of issuance until January 31,
1991, and shall be subject to the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
• 4. The sewage and wastewater collected by this system shall be treated in the
septic tank/recirculating sand filter system prior to being sprayed onto the
receiving irrigation area.
5. This permit is not transferable.

6. This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes, and may be rescinded unless the facilities
are installed, maintained and operated in a manner which will protect the
assigned water quality standards or the surface waters and ground waters.
7. in event the facilities fail to perform satisfactorily including the creation
of nuisance conditions, the Permittee shall take such immediate corrective
action as may be required by this Division, including the construction of
additional or replacement wastewater treatment or disposal facilities.
8. Solids, sludges, or other pollutants removed or resulting from the wastewater
storage facilities shall be contained and disposed of in such a manner as
to prevent any contamination of the surface or groundwaters of the State.
9. The Permittee shall employ a certified wastewater treatment plant operator
in responsbile charge of the wastewater treatment facilities. Such operator
must hold a certificate of the grade at least equivalent to the classification
assigned to the wastewater treatment facilities by the Certification Commission.
10. Diversion or bypassing of the untreated wastewater from the treatment and
disposal facilities is•prohibited.
11. Upon the availability of a municipal or regional sewerage collection system,
the subject wastewater treatment and disposal facilities shall be abandoned,
and all wastewater discharge into the municipal or regional sewerage system.
• 12. The Raleigh Regional Office, Phone No. 919/733-2314, shall be notified at
least twenty-four (24) hours in advance of backfilling of the installed
subsurface disposal system so that an in -place inspection can be made of
said system prior to backfilling. Such notification to the Regional
Supervisor shall be made during the normal office hours from 8:00 A.M.
until 5:00 P.M. on Monday through Friday, excluding State Holidays.
13. Monitoring wells shall be constructed and sampling schedules arranged as
required by the Division of Environmental Management and constructed in
accordance with 10 NCAC 2C 0.100.
14. Any monitoring deemed necessary by the Division of Environmental Management
to insure surface and ground water protection will be established and an
acceptable sampling reporting schedule shall be followed.
15. Reports on the operations of the facilities shall be submitted to the
Division's Raleigh Regional Office at regular intervals and in such form
and detail as may be required by this Division.
16. A suitable year round vegetative cover shall be maintained.
17. Irrigation shall not be performed during inclement weather or when the
ground is in a condition that will cause runoff.
18. No root or leaf crops for public consumption shall be raised on these sites.

19. The Permittee, at least six (6) months prior to the expiration of this Permit,
shall request its extension. Upon receipt of the request, the Commission
will review the adequacy of the facilities described therein, and if indicated,
will extend the Permit for such period of time -and under such conditions
and limitations as it may deem appropriate.
20. The issuance of this permit shall not relieve James B. Willettee of the
responsibility for damages to surface or ground waters resulting from the
operation of this facility.
21. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater into the surface waters
of the State.
22. No type of sludge other than that from this residence in Willette Subdivision
shall be sprayed onto the irrigation area_
23. No traffic or equipment shall be allowed on the disposal area except while
installation occurs or while normal maintenance is being performed.
24. The application rates shall not exceed:
a. 0.75 inches per acre per week
b. 150 pounds of PAN per acre per year.
25. Adequate inspection, maintenance, and cleaning shall be provided by James
B. Willitte to insure proper operation of the subject facilities.
26. The sand media of the recycle surface filter must comply with the Division's
sand specifications and must be analyzed and approved by this Division either
by direct sampling or by acquisition of filter sand from a dealer who is
currently certified by 'the Division as an acceptable source.
27. The following minimum buffer zones shall be maintained from the wetted peri-
meter of the irrigation area.
a. 400 feet from any existing off site residence
b. 150 feet from property lines separating Willette Subdivision from adjacent
property owners
C. 100 feet from any potable water supply well and any adjacent surface
waters
d. 200 feet from any proposed residence

28. In any future transfer of this land and facilities, a notice shall be
given to the new owner that gives full details of the requirements for
operation, maintenance, and overall compliance with Division regulatory
requirements, including the new owner requesting reissuance of this per-
mit from James B. Willette to him.
29. Replacement pumps for the recycle and irrigation pump tanks must be readily
available either at the subdivision site or from a local dealer and must
be repaired/replaced within 24 hours of failure.
30. The lot shall be landscaped in a manner so as to prevent overland flow
of stormwater.
