On May 21 2009 the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to
impact 192 linear feet of perennial stream 15 003 square feet of Zone I Neuse River basin protected
riparian buffers and 9 700 square feet of Zone 2 Neuse River basin protected riparian buffers
In order to meet Conditions (6) and (7) of the 401 Certification for this protect a stormwater
management plan (SMP) for the Caterpillar site were approved by the DWQ on November 16 2010
and December 10 2010 An SMP specific to the office building and shop dated October 27 2011
was received by the DWQ on November 1 2011 Updates to the SMP for the office building and
shop dated December 20 2011 were received by the DWQ on December 20 2011
The DWQ approves the SMP for the office building and shop (with subsequent revisions received
December 20 2011) to satisfy the stormwater condition required by the General Water Quality
Certification This approval is for the purpose and design that you described in your application If you
change your project you must notify us and you may be required to send us a new SMP If the property
(or a lot on the property) is sold the new owner must be given a copy of this approval letter and is thereby
responsible for complying with all conditions This approval requires you to follow the conditions
listed in the General Water Quality Certification for the protect and the following additional
conditions listed below
The SMP approved by the DWQ for the office building and shop consists of a wet detention basin
and all associated stormwater conveyances inlet and outlet structures vegetated shelf planting
plan and the grading and drainage patterns depicted on plan sheets dated December 20 2011 -The
approved SMP must be maintained in perpetuity No changes to the structural stormwater
practices shall be made without written authorization from the DWQ The stormwater
management structures shall have maintenance access and at least a 10 foot drainage easement on
each side to allow for the ability to maintain the structures and to perform corrective actions The
stormwater easements shall be recorded to provide protection of the structures from potential
alterations by future property owners

2 Operation and Maintenance of BMP Maintenance activities for the proposed wet detention basin
shall be performed in accordance with the notarized wet detention basin O &M agreement signed
by Mr Johnson Tilghman on October 27 2011 The O & M agreement must transfer with the sale
of the land or transfer of ownership /responsibility for the BMP facility DWQ must be notified
promptly of every transfer
