On August 5, 2009, the Governor signed Session La-w 2009 -406. This la-w impacts any development approval issued by the
Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, "N -hich is current and valid at any point
bet,, een January 1, 2008, and December 31, 2010. The la,,N- extends the effective period of any state permit that is set to expire
during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session La,,N-
2010 -177 ,Nhich grants an extra year for a total of four (4) years extension.
We discussed the issue -with the expiration of the Nationwide permits. If this does become an issue (that you do not finish the
project within a year after the NW's expire, per Henry), -we -will need to address that issue at that time.

I called the other day but you were not available. The Corps has recently a- warded the contact to restore Section 404
-wetlands in Wilson Bay, Jacksonville, NC. Back in 2008,,,,,-e received the enclosed 401 Certificate for 43689, which expires in
2011. Also -we understand from Regulatory that the new Nationwide Permits come out in March 2012. Henry Wicker states
that the already issued NWP's are good until March 2013.
What do N e need to do in order to comply with Water Quality? Of course, the contractor ,ants to start work in February 2012.
