SUBJECT: CAMA Dredge/Fill Permit Application for Hale Stephenson, Beaufort County,
North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 123
Brookshire Drive adjacent Bath Creek in Bath, NC. Our comments are provided in accordance with
provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended,
Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act
(48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to bulkhead, fill and grade 1,645 tf of Section 404 wetlands by constructing a 75'
bulkhead in front of an areas of wooded wetlands within the AEC. The shoreline had previously been
permitted a bulkhead under a General Permit in 2014, but did not include the wetland area. The applicant
proposed to fill the area of wetlands and plant live oaks on 10' spacing to address impacts within the
buffer. Bath Creek is classified SB NSW by the Environmental Management Commission, is subject to
the NC Division of Water Resources Tar -Pamlico Buffer Rules, and is designated a primary nursery area
(PNA) by the NCWRC.
The NCWRC has reviewed the permit application and could not find a stated purpose and need of the
request_ It was not evident that accelerated erosion had occurred on the property nor that the 2014
measures to protect the shoreline were failing. Bath Creek is subject to the Tarr -Pamlico buffer rules.
These rules were established to address excess nutrients in the watershed. Wetlands filter runoff from
adjacent uplands, reducing nutrient and sediment inputs into adjacent waterbodics. They also provide
excellent habitat opportunities for aquatic and avian species. This function is especially important near
PNAs due to the vital role PNAs play in the rearing of larvae and juvenile finfish. To avoid the loss of
riparian wetlands, the NCWRC requests the applicant consider alternate means of shoreline stabilization

if property erosion is of concern. This could include a riprap revetment waterward the wetland interface
with the creek to extend no greater than 6" above wetland substrate. This revetment would provide
shoreline protection while avoiding wetland fill, not affect the wooded vegetation of the riparian area, and
may even provide foraging opportunities for fishery species along the rock.
