Dear Mr and Mrs DeRose
On December 5 2011 the Division of Water Quality (DWQ) received a Minor Variance application dated
November 17 2011 to fill or otherwise impact the Neuse River basin protected buffer for a sun porch addition
During a meeting with you (homeowner) and your contractor on January 13 2012 it was brought to DWQ s
attention through conversation and photo documentation that the sun porch would be build upon an existing deck
(approximately 9 feet high) that does not currently receive direct sunlight below it thereby indicating that the deck
is impervious
Based on the project review and subsequent meeting it has been determined that the subject protect is Exempt
from the Neuse River Riparian Buffer Rules and written concurrence from DWQ in not required Since you don t
need DWQ written concurrence we are withdrawing your Minor Variance application
It is also our understanding that you will be directing stormwater from the gutter to an existing stormwater
conveyance which is also considered Exempt from the buffer rules
You should obtain or otherwise comply with any other required federal state or local permits before proceeding
with the project including (but not limited to) Erosion and Sediment Control regulations
