Carolina Marine Structures, Inc., on behalf of the Village at Nags Head Property
Owners Association (c/o Alfred Byrum, Association President), has requested the attached
application be processed under the Express Permit Review Program, for the
redevelopment of the South Sound Access site. The project site is located within the
Village at Nags Head at 0 West Sound Breeze Lane off US 158 (South Croatan Highway)
in the Town of Nags Head on Roanoke Sound in Dare County, North Carolina.
The site is a 2.19-acre community access area along Roanoke Sound with ±443' of
shoreline and a deteriorated pier with 6 slips. The community access area is located
between two holes of the Nags Head Golf Links Course. Access to the site is at the
terminal end of West Sound Breeze Lane, and is a gravel access road with a gravel loop at
the waters edge. The center of the loop has been landscaped with ornamental shrubs and
mulch, and has a concrete pad with two picnic tables and a grill for community use. A
second gravel loop and parking area is located on the south side of the access road in the
center of the property. Currently, several sailboats on trailers are located in this parking
area. The area around the access road and parking area is maintained by mowing and
vegetated with upland grass, and pruned bay and wax myrtle. The remainder of the site is
vegetated with live oak, cedar, bay, wax myrtle, pennywort, Spartina patens, broom sedge,
herbaceous shrubs and vines.
The northern portion of the property in the area of the gravel loop between the pier
and north property line is stabilized with ±165' of granite riprap. This riprap connects into
an existing bulkhead on the adjoining golf course property to the north side. The remainder
of the shoreline on the south side of the pier is natural. A beach access sand walkway is
present on the south side of the pier and is demarcated by split rail fence.
The existing pier is 8' wide by ±132' long, with a ±720 ft2 (14' per side) three-tiered
hexagon shaped platform on the end. A ±8' wide by ±30' long elevated access connects
the pier to the parking area. Three - 5' wide by 29' long finger piers project out from the
platform creating 6 slips. The current structure has a shading impact of ±2,211 ft2. The
entire structure is in a deteriorated state with missing deck boards and broken pilings and
is not usable at this time. The water depth at the end of the existing pier is ±2' below the
normal water level (NWL). The near shore sediment is made up of sand and shell
material. No submerged aquatic vegetation was evident on the date of the site visit in the
area of the existing pier.
As previously stated, the site is bordered on the both sides by the Nags Head Golf
Links Course. The site is ±4.5' above the normal high water level (NHW) in the area of the
gravel loop and pier access. Roanoke Sound in this area is classified SA by the
Environmental Management Commission and is open to shellfishing.

Project description
The Property Owners Association proposes to upgrade the community access
facility by replacing the pier in the same alignment. The new pier will be 8' wide by ±132'
long with a ±16' wide by ±24' long platform on the terminal end. The platform will be roofed
resulting in a dripline of ±18' 8" wide by ±26' 8" long. A ±8' wide by ±24' long uncovered
step down platform will be constructed on the waterward side of the covered platform. Two
- ±5' wide by ±30' long finger piers are proposed resulting in a potential for 4 slips. No tie
pilings are proposed. The overall length of the structure over water will be ±186' long. A
new ±8' wide by ±30' long elevated access will connect the pier to the parking area.
The total shaded impact of the proposed structure will be ±1,895.93 ft' while the
existing shaded impact is ±2,211 ft2, resulting in a reduction of ±315.1 ft2 (±14%).
Equipment staging will be confined to a ±40' by ±40' (1,600 ft2) area of existing gravel
parking on the south side of the access road.
Anticipated impacts
The project as proposed will result in the shading of ±1,895.93 ft2 of sound bottom
associated with the replacement of the pier. The project will result in localized turbidity as a
result of the construction activities. A total of ±1,600 ft2 of uplands will be disturbed as a
result of temporary equipment storage.

Existing Structures and conditions: The Villages at Nags Head Property Owners
Association owns Lot: South Sound Access, 0 West Sound Breeze Lane, Dare County,
Nags Head, North Carolina 27959. This lot has existing waterfront structures installed in
the Roanoke Sound is installed 165 linear feet south of the northernmost property line,
have a combined length of 225 linear feet and a shadow area of approximately 2451
square feet. The installed structures are supported with square foundation posts, overall
structure dimensions are as follows: an 8' wide (walkway surface) x 162' long pier (the
first 30' are installed in the sand and the remaining 132 linear feet are installed over
water), an approximate 720 square foot (14' per side) hexagon shaped platform at the
pier's end, three 5' wide x 29' long finger piers extending off the hexagon dock (one
westerly, one northwesterly and one southwesterly, respectively) and eight square
mooring posts, all structures in varied states of deterioration. The horizontal elevation of
these structures is three feet above ordinary water/normal water level. There was a very
small amount of Spartina Paleus located approximately 50 feet from the southernmost
property line that will not be effected by this project. As confirmed by a site visit
conducted with the District CAMA representative (Ms. Lynn Mathis) on 4 April 2007,
there were no SAVs found in the project area.
Structure deterioration and damage: The structures' supporting/foundation square
posts exhibit various stages of deterioration influenced by parasite infestation. During the
period of October 2006 through March 2007, the existing structures incurred repeated
damage caused by various westerly storms to the extent that the structures integrity has
been compromised and the structures are not safe for the property owners to transit from
the inshore to the off-shore ends.
Proposed construction project overview: Carolina Marine Structures, Inc. (contractor)
and Villages at Nags Head Property Owners Association (Owner) are concurrently
requesting the approval of the following project that supports approximately 625 of the
1250 Villages at Nags Head Property Owners :
(a) Removal of the existing structures and dispose of as debris.
(b) Installation of an elevated 8' wide (outside pile to outside pile- walkway surface
between the piles is approximately 6' 8"±) x 162' round pile supported pier
( same footprint as the current pier, but with a horizontal elevation of the pier at
approximately five feet above ordinary water/normal water level)
(c) Installation of 16' wide x 24' long covered dock at the pier's end with limited
wood seating. (Note: the roof drip line measures 26'8" x 18'8")
(d) Installation of an 8' wide x 24' long lower dock (west side of the proposed
covered dock) with two 5' wide x 30' long finger piers constructed in a westerly
direction. Both lower dock and finger piers will be at the same elevation,
approximately 2' lower than the main pier and covered dock elevation.
(e) Installation of a total of three step structures, one near mid-pier, one transitioning
from covered dock to lower dock, and the remaining set installed from the lower
dock into the water (between the two proposed finger piers).

(f) The combined length of proposed project structures will be 216 linear feet and
will have a shadow area of 2271 square feet; a reduction of 9 linear feet in length
and 279 square feet of shadow effect compared to the existing structures.
Land disturbing activity: The preponderance of the proposed project foundation
installation will be accomplished with equipment (a rubber tracked Takeuchi model TB
175 with a NPK vibratory hammer) pre-staged on a waterborne barge. This equipment
will be used to drive the structure foundation piles. Carolina Marine Structures expects
that land disturbing activity will be conducted and limited to an area approximately forty
feet from the NWL line, which is twenty-five feet from the inshore end of the proposed
pier and on the existing gravel access road. This area is defined as a forty foot by forty
foot area of the lot (south and directly adjacent to the gravel traffic circle access) and will
be used for material staging/delivery, temporary stowage of a 7' x 10' workltool trailer,
temporary stowage of a model T300 rubber tracked Bobcat, the daily parking of two
company vehicles (F1 50/F250 trucks) and the on-load of disposal materials on to a truck
via a Bobcat forklift. No additional land disturbing activity; bulkhead, backfill or rip-rap
installations have been included nor is requested within the scope of this project. Any
disturbed surfaces will be rough graded back to original elevation upon completion of the
project and subsequent de-mobilization of equipment.
Proiect work hours and duration: The daily operating schedule will be from 7:30 am
until 6 pm daily (less Sunday) until project completion. Various types of equipment
(previously annotated above) and hand tools will be operated during these periods.
Carolina Marine Structures, Inc is sensitive to noise abatement concerns and will keep to
the bare minimum the amount of time these noise producers are operating. Carolina
Marine Structures, Inc estimates this project will be completed in thirty workdays.

that would interfere with this system; however, it is understood
and agreed that this easement to use the underground water shall in
no way interfere with Declarants or Grantees of Declarants use of
the improvements on the surface. Declarants and all Grantees of
Declarants, their heirs and assigns, are prohibited from constructing
a potable water supply well within the bounds of this property and
agree to convert to the Nags Head Water System. Furthermore, Ammons
Dare Corporation, permittee of the sewerage disposal system, and
the State of North Carolina reserve the right to enter on property
conveyed for groundwater monitoring and remediation purposes.

In accordance with Coastal Area Management Act (CAMA) regulations, Carolina
Marine Structures, Inc will be submitting a Major Permit (Express) Application for a
demolition and construction project for the Villages at Nags Head Property Owners
Association. The project is located at the South Sound Access recreational area, west of
Sound Breeze Lane, and involves the demolition of the existing structures and replacement
with new structures as delineated in the accompanying drawings.
The express permit application requires a letter from the governing Township be
submitted with the application documents stating that the plans have been reviewed and
