The proposed project is in Kinston in Lenoir County. The proposed re -use line begins approximately 4501f south of Young Street and Peachtree Street (Latitude: 34.248686 °N; Longitude: - 77.564533 °W) and ends approximately 15001f east of the intersection of Old Asphalt Road and NC 55 (Latitude: 35.247894 °N; Longitude: - 77.605644 °W). The Future Soccer Complex is located in the northeast quadrant of the intersection of Old Asphalt Road and NC 55 (Latitude: 35.249689 °N; Longtitude: - 77.606439 °W). The Future Historic Battlefield Park is located west of the intersection of Old Asphalt Road and US 258 (Richlands Road) (Latitude: 35.242278 °N; Longitude: - 77.595906 °W). The project is located in the Neuse River basin and onsite waters drain to Neuse Creek. The Water Quality Classification for the Neuse River is C; NSW and the Stream Index Number is: 27- (75.7). The cataloging unit for the site is 03020202. Proposed Project The Battlefield Re -Use project consists of the installation of 17,500 if of 8 -inch line that will transfer effluent reuse water from the City of Kinston's Regional Water Reclamation Facility to the Future Historic Battlefield Park and Future Soccer Complex to provide irrigation for these facilities. Irrigation lines will be installed within the Future Historic Battlefield Park and Future Soccer Complex projects; however, construction of the irrigation lines will not require impacts to wetlands, streams or buffers. Please note that we are only asking for authorization for impacts associated with construction of the treated effluent reuse line under this application. Upon completion of the final design of these facilities, any impacts to wetlands, streams or buffers necessary for construction of the infrastructure (i.e. parking, buildings, etc.) will be permitted at that time. Please note that the construction of the Future Historic Battlefield Park and Future Soccer Complex are not anticipated at this time. The proposed alignment of the reuse line, as well as Future Battlefield Park is located on property owned by Lenoir County, which was purchased by FEMA as a result of flooding after Hurricane Floyd. The proposed project will use treated effluent to irrigate the Future Historic Battlefield Park and Future Soccer Complex. The reuse of treated effluent for irrigation will help to reduce the negative impacts of nutrients, nitrogen and phosphorous on the "nutrient sensitive" Neuse River, which would occur from simply discharging the treated effluent into the Neuse River. Using treated effluent for irrigation will also help reduce the annual loading of the nutrients, nitrogen and phosphorous entering the river. The reuse the treated effluent for irrigation will allow the City of Kinston to operate two public park areas with "green irrigation" that will not require impacts to the City's potable water system demands. The proposed project is being funded by a Clean Water Management Trust Fund Grant. Project History Wetlands within the proposed reuse line alignment, Future Historic Battlefield Park and Future Soccer Complex were delineated by W &R. Maps, Datasheets and other information in support of the wetland delineation for the proposed impact areas have been provided as an Appendix. Please note that all buffers were assumed for all streams within the proposed re -use line alignment. Endangered Species W &R reviewed the NC OneMap Viewer GIS website, located at http:// www. nconemap.net/Default.aspx ?tabid =286, to identify if any potential occurrence of endangered species on or near the proposed project boundaries. The review of the GIS database identified three occurrences of Federally endangered species within 1.0 miles of the proposed project. The information given for endangered species on the NC OneMap Viewer GIS website is very general. W &R requested the specific GIS information on the four endangered species from John Finnegan with the NC Natural Heritage Program. The Carolina Madtom is a small fish which is Federally listed as a Federal Species of Concern, and is listed by the State as Threatened. The proposed treated effluent re -use line will be installed beneath the Neuse River by directional drill, which will not result in a disturbance to the Neuse River. Therefore, the proposed project will have no effect on the Carolina Madtom. The second species identified within 1.0 miles of the proposed project was the American Alligator (Alligator mississippiensis). The American Alligator is federally listed as "Threatened Due to Similarity of Appearance" and is listed by the State as "Threatened ". Based on the information obtained from the Natural Heritage Program, the occurrence of the American Alligator occurred in the Neuse River, east of Kinston, prior to 1950 and has not been observed since then. The proposed treated effluent re -use line will be installed beneath the Neuse River by directional drill, which will not result in a disturbance to the Neuse River. Therefore, the proposed project will have no effect on the American Alligator. The third species identified within 1.0 miles of the proposed project was the Bald Eagle (Haliaeetus leucocephalus). The Bald Eagle is listed by the State as "Threatened" and is federally protected under the Bald and Golden Eagle Protection Act (BGPA). The information obtained from the NC Natural Heritage Program identified that an eagle nest (Survey Site Lenoir #1) is located "approximately 0.23 air miles due west of a railroad bridge over the Neuse River, just south of Kinston." Bald eagle's nests are afforded a 750 if Primary Protection Zone and a 1500 if Secondary Protection Zone. Based on the location of the nest obtained from NC Natural Heritage Program, the eagle's nest is located approximately 3,670 if (0.70 miles) from the eastern end of the proposed re -use line. Therefore, the proposed project will have no effect on the Bald Eagle. Proposed Impacts The proposed impacts consist of 0.905 acres of temporary wetland impacts as a result of construction of the proposed re -use line. Avoidance and Minimization Three alternative alignments were explored prior to finalization of the proposed alignment of the reuse line. Wetlands and "Waters" were delineated for each alignment to determine which alignment would result in the least amount of environmental impacts. The proposed alignment has minimized wetland and riparian buffer impacts by utilizing existing road corridors, as well as existing cleared utility corridors to minimize impacts to wetlands. Mitigation Since the proposed wetland impacts will be temporary, there is no mitigation proposed. The current request is for 0.905 acres of temporary impacts to jurisdictional wetlands (see the attached maps and PCN for details). Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Three different alignment options were explored for routing of the proposed re -use line. Wetlands and "Waters" were delineated for each alignment. The route of the proposed alignment was decided upon as it resulted in the least amount of wetland impacts through the use of existing road and utility corridors. By using existing road and utility corridors, the proposed alignment will result in minimal clearing of forested wetlands for construction of the re -use line. All stream crossings, including the Neuse River crossing, will be installed using trenchless methods (i.e. directional drill, jack and bore, etc) in order to avoid stream and riparian buffer impacts completely. W &R reviewed the NC OneMap Viewer GIS website, located at http: / /www.nconemap.net/DefauIt.aspx ?tabid =286, to identify if any potential occurrence of endangered species on or near the proposed project boundaries. The review of the GIS database identified three occurrences of Federally endangered species within 1.0 miles of the proposed project. The information given for endangered species on the NC OneMap Viewer GIS website is very general. W &R requested the specific GIS information on the four endangered species from John Finnegan with the NC Natural Heritage Program. W &R used the GIS information from the NC Natural Heritage Program to determine the species of each occurrence, as well as its specific location. The first species identified was the Carolina Madtom (Noturus furiosus), which was identified within the Neuse River. The Carolina Madtom is a small fish which is Federally listed as a Federal Species of Concern, and is listed by the State as Threatened. The proposed treated effluent re -use line will be installed beneath the Neuse River by directional drill, which will not result in a disturbance to the Neuse River. Therefore, the proposed project will have no effect on the Carolina Madtom. The second species identified within 1.0 miles of the proposed project was the American Alligator (Alligator mississippiensis). The American Alligator is Federally listed as "Threatened Due to Similarity of Appearance" and is listed by the State as "Threatened ". Based on the information obtained from the Natural Heritage Program, the occurrence of the American Alligator occurred in the Neuse River, east of Kinston, prior to 1950 and has not been observed since then. The proposed treated effluent re -use line will be installed beneath the Neuse River by directional drill, which will not result in a disturbance to the Neuse River. Therefore, the proposed project will have no effect on the American Alligator. The third species identified within 1.0 miles of the proposed project was the Bald Eagle (Haliaeetus leucocephalus). The Bald Eagle is listed by the State as "Threatened" and is Federally protected under the Bald and Golden Eagle Protection Act (BGPA). The information obtained from the NC Natural Heritage Program identified that an eagle nest (Survey Site Lenoir #1) is located "approximately 0.23 air miles due west of a railroad bridge over the Neuse River, just south of Kinston." Bald eagle's nests are afforded a 750 If Primary Protection Zone and a 1500 If Secondary Protection Zone. Based on the location of the nest obtained from NC Natural Heritage Program, the eagle's nest is located approximately 3,670 If (0.70 miles) from the eastern end of the proposed re -use line. Therefore, the proposed project will have no effect on the Bald Eagle. 6. Essential Fish Habitat (Corps Requirement) 6a.
