Responses to NCDWR Request for Additional Information
Dear Mr. Trone,
The following includes responses to the additional information request received from the N.C. Division of
Water Resources on January 29, 2021:
1. Your application proposed proposes a total of 56,861 square feet of permanent buffer impacts for the
projects. Please submit a modified buffer impact table that specifically lists each type of buffer impact (e.g.
grading, road crossing, utility crossing, etc.) as outlined in 15A NCAC 02B.0714(10).
The buffer impact table has been revised and is attached for review.
2. Please demonstrate why impacts to Riparian Buffer cannot be avoided or minimized by converting the
SCM discharges to Dispersed Flow prior to entering the buffer. In addition, the Division has concerns that the
perpendicular alignment of these discharges may destabilize the receiving stream banks. Please demonstrate
why further minimization cannot be achieved by re -aligning these discharge points to an oblique angle to the
receiving stream. Please address this for Impact Areas 1,2,3,4,7,8 and 9. [15A NCAC 02b .0714 (9), 15A NCAC
02B .06112(2) and 15A NCAC 02H .0506(b)].
The stormwater control measure discharges referenced are for high flow bypass only and are designed per the
City of Durham Stormwater Requirements. The proposed stormwater management plan for the project has
been reviewed and approved by the City of Durham Stormwater Department.
3. Please clarify the need for a 70-foot right-of-way for Site Drive 2/Hebron Road Extension. The Division
believes that impacts to features SE and SD and associated riparian buffers can be further avoided by a
reduction in width of Site Drive 2/Hebron Road Extension right-of-way. The Division understands the
requirements imposed by NCDOT and DCHC-MPO regarding the need for ingress/egress points, safety and
aligning the Hebron with the existing Wellington Drive as proposed and outlined in the Traffic Impact Analysis.
However, it is unclear if the accommodation of the Hebron Road Extension right-of-way portion of the
roadway is necessary to accommodate traffic for site access. Please clarify if Hebron Road Extension is

approved as part of a Transportation Improvement Plan (or similar) or is speculative based on an anticipated
future traffic demands, considering that this roadway extension project is not part of the City -County of
Durham Capital Improvement Plan and has not been scheduled or funded. In addition, please clarify if the
proposed Hebron Road Extension is planned to connect to existing Hebron Road to the east [15A NCAC 02H
.0506(b)(1)].
The Durham -Chapel Hill-Carrboro (DCHC) Metropolitan Planning Organization adopted Comprehensive
Transportation Plan (CTP) shows Hebron Road extending from Denfield Street to Wellington Dive and is titled
the Hebron Road Extension. This extension is classified as a minor thoroughfare.
Since the Hebron Road Extension is classified as a minor thoroughfare, the City of Durham requires a 70 foot
right-of-way with 3 travel lanes, bike lanes and sidewalks on both sides. (i.e. the width of the impact is
determined by the Authority Having Jurisdiction-AHJ).
The City requested that the DPS and the site plan reflect a 70 foot wide land reservation for future right-cf-
way shall the Hebron Road extension ever be constructed. However, this extension is not currently on any
jurisdictional Capital Improvement Plan (CIP) and is not scheduled or funded.
All site improvements shown on the plan submitted are required by authorities having jurisdiction to support a
private site driveway for a high-school use only. Improvements shown are NOT in support of anything having
to do with the future Hebron Road extension.
4. Impact Area 1 (Site Drive 2/Hebron Road Extension) is proposed to impact stream feature SD through the
addition of two culverts, fill and rip rap resulting in 187 linear feet of impact. Information provided in the
application indicates the width of this crossing to be, at least in part, due to the addition of stacking lanes
along the Hebron Road Extension resulting in a much wider road. Please demonstrate why it is infeasible to
begin lane stacking after the crossing of stream feature SD. [15A NCAC o2H .0505(b)(1)].
In a letter from NCDOT, John Sandor, PE District Engineer to Joshua Reinke, PE, Ramey Kemp & Associates, Inc.,
Durham County Public Schools Traffic Engineer hired consultant dated June 17, 2020: (stating improvements
required)
US 501 at Wellington Drive/Site Drive 2
• Site Drive shall be constructed with one ingress lane and three egress lanes. The egress lanes shall consist
of one exclusive left -turn lane with 150 feet of storage, a shared left -through lane, and an exclusive right -turn
lane with 250 feet of storage. The egress shall also contain 100 feet of Internal Protected Storage (IPS) before
any parking or crossing maneuvers.

5. Please provide a detailed engineering plan, profile view, and cross-section of the proposed culvert for
Stream SE. These drawings must include details regarding stream alignment in relation to pipe alinement, pipe
slope, pipe burial, and dissipator pad [15 NCAC 02H. 0502(a)(9)].
Detailed engineering plan & profile views are found on Sheets C-7 and C-8 Culvert Profile. See attached impact
maps.
6. Please explain how the width of the road crossing at Impact Area 5 has been minimized to the maximum
extent practicable. [15 NCAC 02H .0506(b)(1)]
Retaining walls are proposed to reduce the overall slope impacts and minimize long-term bank erosion. A
thirty-foot wide drive is provided to support emergency, service and pedestrian vehicles. An 8-foot wide walk is
provided on the north side for safe pedestrian travel to and from the student parking lot which is used after-
hours for event parking to the stadium. Utilities to support the new school and auxiliary structures run parallel
to the drive on the south side.
7. The angle of stream SD as it enters the proposed culvert at Impact Area 5 is likely to result in accelerated
erosion and underscoring to the area on the outside of this bend as it enters the culvert. Please describe how
potential problems such as erosion and underscoring will be prevented in this area and if an alternate crossing
location has been explored [15 NCAC 02H .0506(b)(1)].
Per NCDOT, the Argonne Drive entrance must include the installation of channelized south bo und/north bound
left turn lanes on US 501. The drive will be constructed as a limited movement intersection with one ingress
and one egress lane. Furthermore, Argonne Drive will be restricted to a right -turn lane only.
The location of this entrance is mandated based on requirements from the DPS in conjunction with the State
Board of Education -NC Department of Public Instruction, the City -County of Durham and the N.C. Department
of Transportation. The guidelines require at least two entrances to the school be accessed from a public road,
that entrances be at least 600 feet apart to comply with public safety standards, and that the entrance be
aligned with Argone Drive.
Other culvert alignments were explored and were determined to result in larger stream impact amounts. An
alignment that betters the flow entrance would lengthen the culvert and would generate an outlet angle that
may not be preferred. Another option may be to place a bend in the middle of the culvert to maximize the
inflow and outflow alignment, but would lengthen the impact and raise questions on how to model.

8. Please clarify that stream impacts were calculated based on stream length, not culvert length and update
impact table if necessary. [15 NCAC 02H. 0502 (a) and (c)].

9. Mitigation is required for losses of equal to or greater than 300 linear feet of perennial stream. Please
provide a mitigation plan that confirms to the requirements of 15A NCAC 02H .0506. Furthermore, buffer
mitigation is required for some of the prosed buffer impacts. Please submit a mitigation plan in compliance
with 15A NCAC 02B .0295 [15A NCAC 02H 0506 and 15A NCAC 02b. 0714(12)]
A final mitigation plan will be provided once impacts amounts are approved and quantified by both agencies.
10. If the U.S. Army Corps of Engineers request a response to any of the comments received as a result of the
Public Notice, please provide the Division with a copy of your response to the USACE {15 NCAC 02H .0502( c)].
If a response is requested, a copy will be provided to both DWR and USACE.
