This letter is in response to the above referenced Note of Violation (NOV) for the November
2020 Discharge Monitoring Report (DMR). Our primary and backup ORCs have reviewed the
indicated violations, and have provided the following responses to each:
1j Effluent — Fecal MF, MFC Broth, 44.5 C (31616)
Daily: 11/13/2020 Reported = 770 MPN/100
Monthly: 11/2020 Averaged= 405.93 MPN/100
Although permitted as a Centralized Waste Treatment (CWT) facility, Edge Water Treating,
LLC has not yet begun receiving waste from third party sources. Sanitary waste water from
fewer than ten (10) persons during the five-day business week is being received into the
aeration basin, but no flow leaves that basin over the weir to a secondary clarifier, nor enters
the polishing ponds at this time. The ponds are only catching the run-off from any rain
events, and effluent flow results only from stormwater input.
As mentioned in the comments section of the DMR, more than 100 Canadian Geese were
observed on and around the polishing ponds during the month of November, leaving
significant quantities of feces around the edges of the pond immediately before the Effluent
location. The higher -than -normal Fecal result on 11/13/2020 is almost certainly due to
geese feces run-off resulting from a high rain event on 11/12/20 - 11/13/20 which led to an
effluent flow of 1.144 MGD for that date.

The only other Fecal sample collected during the month, also after a rain event, was on
Tuesday 11/17/2020 and also yielded higher -than -normal Fecal results, though within permit
limits. However, the monthly average was also above permit limits due to the high result on
11 /13/20.
Corrective measures included additional cleaning of the container for Fecal sample
collection, documenting wildlife, and maintaining the grass/shrub buffer area around all
polishing ponds.
2) Effluent — Solids, Total Suspended Solids (QD530)
Daily: 11/13/2020 Reported = 223.16 lb/day
Monthly: 11/2020 Averaged = 55.79 lb/day
An apparent inversion in the final polishing pond at the Effluent location due to a cold front
that dropped temperatures to freezing earlier in the month, combined with the previously
mentioned high rain event on 11/12/20 - 11/13/20 resulted in a high TSS result for the
11/13/2020 date that exceeded permit limits. This one high result also caused the Monthly
Average to exceed permit limits. Options for corrective measures for meteorological impact
are limited, but all details will be documented.
3) Nitrogen, Ammonia Total (as N) (QD610)
Daily: 11/20/2020 Reported = 106.5 lb/day
Monthly 11/20320 Averaged = 26.62 lb/day
The laboratory misattributed the analytical result for another client's sample to ours and
reported the wrong ammonia result. The correct result has been provided by the lab, and a
revised DMR for November 2020 has been submitted with the new ammonia number
showing that the Daily and Monthly permit numbers are in compliance with no violation of
permit limits. Attached is a letter from Statesville Analytical documenting the error.
4) Flow, in conduit or thru treatment plant (50050)
NOV reported Value = 0.55 MGD
Total Average Flow for Month of 11/2020 = 0.202 MGD
The referenced NOV erroneously stated that the monthly average flow was exceeded,
apparently because dates with zero flow were not included in the monthly average. The
total Flow for the month of November 2020 was 6.0494 MG, divided by 30 days equals
0.202 MGD, as correctly shown on the DMR. The Total Average Flow for the month was
well below the permit limit, and no violation should have been indicated.

A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of North Carolina General
Statute (G.S.) 143-215.1 and the facility's NPDES WW Permit. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or
fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.
If you wish to provide additional information regarding the noted violation, request technical assistance, or
discuss overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A
review of your response will be considered along with any information provided on the submitted Monitoring
Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. If no
response is received in this Office within the 10-day period, a civil penalty assessment may be
prepared.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems,
and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by
Consent.
Reminder: Pursuant to Permit Condition 6 in Section E. the Permittee is required to verbally notify the Regional
Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at
the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may
be required within 5 days if directed by Division staff. Prior notice should be given for anticipated or
potential problems due to planned maintenance activities, taking units off-line, etc.

The purpose of this letter is to explain data correction for a NH3 on report for Edgewater taken
11/20/2020. The original result was confused with another client and sample ID# mixed prior to
analysis. Thus resulting in a change of result for this reports amendment. I have no explanation for
this other than human error.

We regret that these mistakes were made, in the future I will take more steps to eliminate such errors.

Report Comments:
Geese on final effluent pond causing violation of daily max for Fecal Coliforms on 11/13/20. left VM for Roberto Scheller on 12/4/20 at 1600. CWT parameters not collected
since no CWT waste has been received or processed. Discharge is nearly 100% storm-water. Effluent average for TSS, Fecal Coliform, and Ammonia Nitrogen were out of
spec. Daily max also out of spec. TSS and Fecals on 11/13. Ammonia Nitrogen elevated on 11/20, which seems out of character with the rest of the sampling results that day.
Verifying results with the lab. Notified Roberto via VM on 12/28/20 at 1430. Geese have taken up residence in the pond system. We have probably over 100 residing in pond 2.
Test results seem OK as long as they don't move into the final pond. Haven't seen more than 25-30 on the final effluent pond. Suspect the non-compliant results this past month
may be due to pond inversion. Revision 1/26/21 - Found out from the lab that the ammonia reading on 11/20/20 was entered incorrectly into the lab database and was actually
non detect (<0.5 mg/l) as usual.
