Joint Meeting: February 28, 2011
The Spindale Board of Commissioners held a joint meeting- with the Town of
Rutherfordton in the Dining Room of the Spindale House. The following elected officials
were present: Mayor Mickey Bland; Commissioners Nancy Walker, Toby Tomblin and
Tommy Hardin. Rutherfordton elected officials present included: Mayor Jimmy Dancy;
Councilmen Terry Cobb, Stan Clements, Christy Bare and Bob Jones. Staff present
included Cameron McHargue, Town Manager; Karen Andrews, Rutherfordton Town
Manager; Cathy Swafford, Town Clerk; Lee Edwards, Spindale Code Enforcement
Officer; Keith Ward, Rutherfordton Public Works Director; Donald Hutchins,
Rutherfordton Code Enforcement Officer and David Lloyd, Rutherfordton Town
Attorney.
Guests present included David Odom, Odom Engineering, PLLC; and Bill Diuguid and
Mike Randall from the NPDES Stormwater Program.
Mayor Bland called the meeting to order at 6:00 pm and welcomed Rutherfordton's
Town Council and guests to the meeting.
Mr. Odom gave some background information on the NPDES stormwater program that
was established in 1990. Phase I covered municipalities with populations of 100,000 or
more. Phase II, which is where Spindale and Rutherfordton fall, was established in
2006 and applies to certain communities with populations less than 100,000. North
Carolina administers this program through the Division of Water Quality under the
authority of the Environmental Management Commission.
Spindale and Rutherfordton were selected due to degraded water quality in streams
located in both towns. Phase II rules require that the Towns reduce the discharge of
pollutants to the "maximum extent practicable", protect water quality and satisfy the
appropriate water quality requirements of the Clean Water Act.
Specifically, the Towns have six items that are considered minimum control measures:
o Public Education and Outreach
o Public Participation/Involvement
o Illicit Discharge Detection and Elimination
o Construction Site Runoff Control
o Post -Construction Runoff Control
o Pollution Prevention/Good Housekeeping
The permit application is due to NCDWQ 18 months from the date of the notification
letter, which was received by the Towns in February 2010. The Public Education
Program must be in place within 12 months after the permit is issued. Once the State
receives the application it takes an average of 6 months for the permit to be issued.
The first expenditures will be in FY 2012-13 and would involve the public education and
outreach component of the permit. A stormwater ordinance regulating development
activities must be adopted within 24 months after the permit is issued.
The practical implication of this ordinance would require that all new construction
activities that disturb more than one acre of land will be required to utilize approved Best
Management Practices (BMPs) to treat stormwater runoff to remove 85% of Total
Suspended Solids if the proposed construction activity exceeds 24% Built Upon Area.
There are a variety of Best Management Practices that may be utilized to satisfy this
requirement.
BMPs must be monitored by the Town to ensure compliance with operating
requirements. There are several steps involved:
o Ensure BMPs are part of the project approved process
o Ensure access easements and operational agreements are in place for each
project
o Maintain an updated map identifying the location of the BMPs
o Ensure required inspects with maintenance is completed for each BMP
o Requires stormwater compliance review to be part of the construction permitting
process
o Requires a stormwater management panel be established to oversee stormwater
issues
o Requires someone to oversee, manage and document the Public Education
Component and includes progress measurements
o Requires staff training to ensure compliance with good housekeeping practices
including the development of procedures for Town owned properties
o Requires the development of a map identifying major outfalls, BMPs and Town
owned facilities
Mr. Diuguid and Mr. Randall work with the NPDES stormwater program and help Towns
with the implementation of these regulatory permits.
Commissioner Tomblin asked what criteria was used to determine that Spindale and
Rutherfordton had to meet these requirements. Mr. Diuguid explained the process that
was used and who made those decisions.
Concerns expressed from each Council include the following:
o How to pay for this unfunded federal mandate
o How it would affect future growth and development — since it appears that it puts
the Towns at a disadvantage in competing with areas that do not have
stormwater issues
o How and why Spindale and Rutherfordton were chosen
o What is the specific pollution going into the streams to make them impaired
o Is it possible to protest
o Explanation to our citizens
o Co -permitting
o County's role in process
Guests from the NPDES Stormwater Program left the meeting at 8:00 pm and the
meeting took a short 5 minute recess before continuing.
Upon return, the two Boards came up with a plan of action to. include asking for a 6-
month permit extension and requesting that our local legislatorsattend a joint meeting
for the Towns to discuss the impact of these requirements on the two Towns'. It was
also suggested that Walter Dalton be invited to this same meeting.
Commissioner Hardin made a motion to adjourn. Commissioner Tomblin seconded and
the motion carried unanimously.
