DWQ Project No 11 0210 S &ME Project No 1357 10 012 Dear Messrs Brown and McMillan This letter is in reference to the Piedmont Natural Gas (PNG) Wayne Project The proposed project involves installation of approximately 37 miles of 20 inch steel transmission pipeline in Wake Johnson and Wayne Counties The pipeline will originate near Guy Road south of U S Highway 70 in Clayton North Carolina (35 671280 N 78 5212° W) and end on the Progress Energy property located at the existing H F Lee facility (35 3749'N 78 0911 ° W) near Goldsboro North Carolina The purpose of this letter is to revise the existing permit authorizations to account for 1) additional temporary work space (TWS) needed to adequately segregate and stockpile spoil material at one location and 2) change the method of construction at one stream/wetland crossing The relevant revised Jurisdictional Waters of the U S and Riparian Buffer Impact Plan Drawings (Appendix I) along with the appropriate check ($240 00) to DWQ are also included with this submittal PERMITTING HISTORY The project received initial authorization from the U S Army Corps of Engineers (USACE) in accordance with Nationwide Permit No 12 on May 6 2011 The project S &ME INC / 9751 Southern Pine Boulevard / Charlotte NC 28273 5560 / p 704 523 4726 f 704 525 3953 / www smeinc corn Revision to Existing Permit Authorization SBME Project No 1357 10 012 PNG Wayne Protect Wake, Johnson and Wayne Counties, N C December 19 2011 was granted authorization by the North Carolina Division of Water Quality (NCDWQ) under General Water Quality Certification No 3819 on April 18 2011 To account for minor pre construction modifications to the proposed alignment the project received revised authorization from the USACE on October 19 2011 and by DWQ on October 6 2011 A Neuse River riparian buffer impact modification request was also submitted to DWQ on November 9 2011 To date authorization for the buffer impact modification has not been received PROPOSED REVISIONS The purpose and need for each area subject to this permit revision are identified in detail below Wetland WCG Wetland WCG is located south of Old Smithfield Road and east of Ferry Bridge Road in Wayne County Installation of the new gasline through Wetland WCG is currently permitted to occur within a 50 foot right of way 30 feet of which will be permanently maintained and 20 feet of which consists of TWS During initial clearing operations the project contractor encountered water levels within Wetland WCG that were higher than anticipated Based on these conditions the contractor anticipates that the currently authorized 50 foot ROW will be insufficient to adequately accommodate retrieval /storage of trench spoil and segregation of wetland topsoil Test observations indicated that under such conditions portions of the excavated material are likely to consist of a slurry that will make containment of the material difficult within the confines of the 50 foot ROW To address the issue the contractor first explored seeking authorization to extend the sediment and erosion control measures along the edge of the 50 foot ROW through the wetland However it was determined that equipment necessary to install silt fence through the wetland would be incapable of performing the work given the saturated conditions Further the existing substrate is likely incapable of supporting the measures in a manner that would adequately prevent migration of the excavated material outside of the ROW and into the adjacent undisturbed wetland Additionally insufficient high ground exists in the vicinity of the ROW to haul the excavated material off site for temporary storage The existing 50 foot ROW is paralleled to the south by a large earthen berm that supports an elevated gravel roadway The elevated roadway demarcates the edge of an inactive ash disposal area associated with the neighboring Progress Energy facility Sufficient ground to accommodate the excavated material is located between the existing ROW and the elevated roadway The area consists of a mixture of previously delineated wetlands and smaller high ground knolls Accordingly PNG is requesting that an additional 25 feet of TWS be added to the south side of the existing ROW from approximately Station 1929 +04 to Station 1942 +90 (1 386 linear feet) in order to temporarily store the spoil material Use of the additional TWS will involve hand removal of trees within the area with the stumps left in place Material excavated from the trench will then be temporarily sidecast 2 Revision to Existing Permit Authorization SWE Project No 1357 10-012 PNG Wayne Proiect Wake, Johnson and Wayne Counties, N C December 19 2011 and contained within the new TWS The additional TWS will provide better management of potentially fluid material from the trench excavation and reduce the potential of off site sedimentation The existing elevated road bed that parallels the additional TWS will provide additional containment and greatly reduced the risk of off site sedimentation The new 25 foot TWS will result in an additional 0 374 acre of temporary impact to Wetland WCG The new TWS will not result in additional stream or riparian buffer impacts The appropriate Waters of the U S and Riparian Buffer Impact Drawings associated with Wetland WCG (Sheets 175 180 of 186) have been modified to reflect the proposed additional 25 foot TWS (Appendix I) No work within the new 25 foot TWS will be performed until USACE and DWQ approval for this revision has been obtained Similarly PNG will obtain the necessary approval from NCDENR s Land Quality Section for modification to their existing sediment and erosion control plan before the work occurs Wetland WBV and Stream S43 Wetland WBV and Stream S43 are co located west of Massey Holt Road in Johnston County PNG originally proposed to install the gashne beneath this wetland stream complex through use of a honzontal bore as efforts were made to cross riparian wetlands with trenchless methods on a project wide bans However the contractor determined that in order to cross the complex with a bore excessive excavation work would be necessary to reduce the adjacent hill sides to appropriate grade for safe construction of the borepits An adjacent cemetery and additional wetland areas preclude lateral expansion of TWS in high ground to accommodate the enlarged pits These constraints require that the pipe be installed through this area by conventional rather than trenchless means However to minimize impacts the contractor has agreed to perform the work entirely within the currently authorized 40 foot ROW and within a 24 hour period Installation of the pipe will be otherwise performed in accordance with the construction methods and conditions utilized at other conventional crossings within the project If insufficient area within the existing 40 foot ROW is available to temporarily segregate and stockpile soil excavated from the trench the material will be trucked to a suitable high ground location Work within Stream S43 will be performed in the dry and affected streambanks will be restored in accordance with the project s existing restoration plan This revision will result in 24 if of additional temporary stream impact Because the work will be limited to the currently authorized 40 foot ROW no additional wetland or riparian buffer impacts will occur as a result of installing the pipe conventionally The appropriate Waters of the U S and Riparian Buffer Impact Drawings associated with Wetland WBV and Stream S43 (Sheets 152 153 of 186) have been modified to reflect the proposed change in construction method (Appendix I) K, Revision to Existing Permit Authorization SWE Protect No 1357 10-012 PNG Wayne Proiect Wake, Johnson and Wayne Counties, N C December 19 2011 None of the work associated with crossing Wetland WBV /Stream S43 conventionally rather than by bore will occur until USACE and DWQ approval has been obtained Similarly PNG will obtain the necessary approval from NCDENR s Land Quality Section for modification of the existing sediment and erosion control plan before the work occurs REVISED PROJECT WIDE IMPACTS Revisions to the proposed project will result to an additional 0 374 acre of temporary wetland impact None of the affected wetlands will be permanently converted following construction The revisions will result in 21 linear feet (if) of additional temporary stream impact As with those impacts currently authorized by the existing permit none of the additional impacts described herein will result to a loss of waters of the U S Revised project wide wetland and stream impacts including those proposed by this
