HomeMy WebLinkAboutGC 1332R_Page_1State of North Carolina ...._._ GENERAL CERTIFICATION THIS GENERAL CERTIFICATION is issued in conformity with the requirements of Section 401; PL 92-500 and PL 95-217 of the United States and subject to the North Carolina Division of Environmental Management Regulations in 15NCAC2H, Section .0500 to the U.S. Army Corps of Engineers District herein specified to conduct certain maintenance dredging activities in the coastal navigable waters of the state. This certification is valid for maintenance dredging activities authorized by the Rivers and Harbors Act of 1899 and which are initiated by the District Engineer of the ~)ilmington District t).S. Army Corps of Engineers. The State of North Carolina certifies that the maintenance dredging activities herein specified will rn~t violate Sections 301, 302, 303, 306, and 307 of the Federal Clean Water Act if conducted in accordance with terms and conditions hereinafter set forth: 1. The certification is applicable only when a rapid response is required for frequent and unpredictable sand shoals forming in an authorized channel such that it posea an immediate threat to navigation. 2. This certification is valid only when the District Engineer makes the determination that the situation set forth in condition No. 1 exists, and obtains concurrence from the Division of Environmental Management. The Director of the North Carolina Division of Environmental Management may require submission of a formal application for certification for any project of this type, if is is deemed necessary to assure the protection of water quality standards. Public hearings may be held for specific applications or groups of applications prior to certification if deemed in the public's best interest by the Director. 3. The U. S. Army Corps of Engineers shall dredge by sidecasting or other means most readily available and shall dispose the spoil in open -water adjacent to the channel, in a suitable diked highground disposal area, or along the ocean beaches. .. 2 4. The spoil material shall be predominantly sand. The turbidity plume must not impede the free passage of fish adjacent to or downstream from the project. ~T~is Certification does not relive the Corps of Engineers or their contractors from potential liability with respect to any fish kills that may result from excessive turbidity in the receiving waters. Non-compliance with or violation of the terms and conditions herein set forth shall result in revocation of this Certification. This the 12th day of June, 198?.
