Thank you for allowing us until Dcccmbcr 30, 2020 to complete additional investigation and provide this
response. We offer the following response to the above -referenced Notice of Violation and Intent to Assess
Civil Penalty, which was issued for a singular failure to monitor for Solids, Total Suspended -Concentration
in September 2020.
Aqua's Response:
Waterfall Plantation requires two TSS samples monthly. The first sample was collected on September
8, 2020. Per the Operator in Responsible Charge (ORC) - an Aqua employee - the second sample was
taken on Scptcmbcr 23, 2020 at 9:41 am. Upon in-depth investigation we determined the ORC did not
deliver the sample to the sample delivery point. The ORC has amended the Scptcmbcr 2020 DMR,
and a copy is attached. Aqua continues to review the ORC's conduct and is assessing the extent of its
internal action.
