PROJECT SUMMARY: The applicant is proposing to construct a residential subdivision, 6' Y 1,345' access pier, four elevated finger piers and four 6' x 28' floating docks. PROJECT DESCRIPTION: Land Management Group, representing Clarendon Landing, LLC, has requested that the attached application be processed under the Express Permit Review Program. The subject property is located adjacent to Smith Creek, along King Street, in Wilmington, New Hanover County. To access the project site, take Hwy 17 south from Wilmington and turn right onto North 17`~ Street. Turn left onto Rankin Street and then right onto 11 `~ Street. North 11 `h Street becomes King Street. Continue along King Street and the project site will be located at the end of the road, adjacent to Smith Creek. The property is approximately 17.0 acres in size with approximately 1,047 linear feet of water frontage. Elevation at the property varies from 2'-22' above normal high water. Residential properties surround the site to the south and Smith Creek borders the property to the north. Carolina Power and Light and the City of Wilmington own property east and west of the site, respectively. The high ground portion of the tract has little vegetation, but does include species such as Live Oak (Ouercus virginiana), Cypress (7' distichum var. nutans), Wax myrtle (Myrica cerifera), Long-leaf Pine (Pinus palustris) and Maple (Ater rubrum), located along the banks of Smith Creek. The northern portion of the property consists of "404 type" wetlands and coastal marsh. Coastal wetlands vegetation consists primarily of Cattail (Typha), intermixed with Giant Cordgrass (Spartina cynosuroides) and Sawgrass (Cladium jamaicense). The waters of Smith Creek, adjacent to the proposed project area, are classified "SC" by the Division of Water Quality. This section of Smith Creek is NOT designated as a Primary Nursery Area by the Division of Marine Fisheries. According to maps provided by Shellfish Sanitation, the area is CLOSED to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to construct a 1 ~4-lot residential subdivision, a 6' x 1,34' access pier, four elevated finger piers and four 6' x 28' floating docks. Please note that the upland work associated with the subdivision portion ofthis project is located outside of the 30' Coastal Shoreline buffer. Furthermore, the water's of Smith Creek, located adjacent to the project site, are listed by the N.C. Division of Marine Fisheries as Inland Waters and therefore, the 7~' Area of Environmental Concern (AEC) \does not apply. The development activities that have taken place to date did not require any permit authorization under the CAMA. At the time of the site visit, the applicant had already installed the access road, stormwater collection pond and utilities. Because the upland development activities are nearly complete, and because they are located outside ofthe 30' AEC buffer, those activities will not be described in detail in this field investigation report. Please find below a brief description of the upland development activities that are proposed, or have been completed at the subject site. Access to the site is provided by King Street, which branches off to Clarendon Street, Stanley Street and Corbett Street. These streets each have a 50-foot right-of--way and drain to two stormwater collection ponds located on the northern side of the property. The site is cleared of vegetation with the exception of a small stand of mixed hardwoods and wetlands, located along the water's edge. Twelve single-family residential lots would be developed along the southern side of Smith Creek, however, according to the application package and site drawings, these lots would not have riparian access. Instead, the applicant has conveyed riparian rights to the common area, which lies between the upland lots and the normal high water line. The common area spans the entire length of the shoreline. Clarendon Holdings, LLC Page Three In addition to the subdivision, the applicant proposes to construct a 6' x 1,345' access pier, four finger piers (6' x 31', 6' x 27', 6' x 21' and 6' x 20') and four floating docks (6' x 28'). The access pier would originate on high ground (along the sidewalk) in the northeast corner of the property at the end of Stanley Street. The pier would span in an easterly direction and wrap around the existing stormwater pond before transcending towards Smith Creek. The access pier would cross a very narrow section of "404" and coastal wetlands before turning westward, and running parallel to the shoreline. The pier would be located just waterward ofthe outer limits of coastal wetlands and normal high water line. The access pier would continue along this line towards the west and ultimately turn back towards the high ground, roughly 80' from the western property/riparian line. The pier would cross a broader section of `'404" and coastal wetlands vegetation in this area (approximately 200' in width) before terminating on high ground, at the end of Corbett Street. Four finger piers would be constructed along the northern side of the access pier, extending into Smith Creek. These finger piers would be located along the western side of the access pier and would provide access to four floating docks. As proposed, these fixed and floating structures would be located within'/4 ofthe width of the waterbody. Water depths in the vicinity of each ofthe floating docks range from -~' to -12', relative to normal low water. The applicant has received aHigh-Density Stormwater Permit from the North Carolina Division of Water Quality. The Stormwater permit was issued on 07/21/06, under project number SW8060250. The applicant has obtained approval of a Sedimentation and Erosion Control Plan (SECP) from the City of Wilmington. The plan was issued under permit #80-0~. Additionally, the applicant has received approval from the li.S. Army Corp of Engineers and the Division of Water Quality, for "404" wetlands fill. The Corp authorized the impacts under a Nationwide 18 (Action ID 2006-32868) and the Division of Water Quality authorized the project under Water Quality Certification #3402 (project #060932). 10. ANTICIPATED IMPACTS The pier, and associated structures, would result in the shading of approximately 948 sq. ft. of coastal and "404 type" wetlands species. The proposed pier, finger piers and floating docks would incorporate approximately x,301 square feet of public trust area. Approximately 3,096 sq. ft. of high ground would be disturbed as a result of pier construction. The proposed structure could be built with in the applicant's area of riparian access and with '/4 of the width of the waterbody. Minor increases in turbidity should be expected during construction. The property abuts Smith Creek, is zoned R-3, and totals approximately 17 acres. All land along Smith Creek has been deemed common area for the residents of Clazendon Pazk Subdivision. Smith Creek waters aze classified as SC waters by the NC Environmental Management Commission, and aze not classified as PNA by NC Marine Fisheries. T'he applicant proposes to construct a 6' wide 1345' long boazdwalk/access pier extending from the sidewalk along the subdivision road down to Smith Creek, where it will run along the creek to the other side of the property. The boardwalk/ access pier will provide access to four floating docks. One dock will be for community use by residence of Clazendon Park Subdivision. The other three will be deeded to individual lot owners. Each floating dock will be 6' by 28' with a 4' by 6' extension to provide extra azea for ramp movement.
