Chapter 143, Article 21 of the North Carolina General Statutes (G.S.) authorizes and directs the Environmental Management Commission -of the Department of Environment & Natural Resources to protect and preserve the water resources of the State. The Division of Water Quality (DWQ) has the delegated authority to enforce adopted water pollution control rules and regulations. Enclosed please find a copy of a Complaint Investigation Report for the investigation conducted on June 15, 2007, by Mr. Wes Bell of this Office. As a result of the investigation, the following condition was found to be in violation of G.S. 143-215.1: The washwater resulting from the cleaning of tractor trailer trucks was being discharged into an unnamed tributary to Lower Little River via stormwater drainage system. Detergent foam was also observed in the tributary downstream of the washwater discharge location. Be advised that G.S. 143-215.6A provides for a civil penalty assessment of riot more that twenty- five thousand dollars ($25,000.00), or twenty-five thousand dollars ($25,000.00) per day when the violation is of a continuing nature, against any person who is required but fails to sepure and/or abide by a permit required by G.S..143-215.1. Penalties may also be assessed for any damage to the surface waters of the State that may result from the unpermitted discharge. 3w ? COPIES TO: Alexander County Health Department REPORT: On June 4, 2007, this office received a complaint regarding washwater being discharged to a creek at the Carrigan & Sons Trucking, Inc. (CSTI) business site. Mr. Wes Bell of this office investigated the complaint on June 15, 2007. Mr. Bell met with Mr. Jeffery Carrigan, CSTI, at the business site. The washwater from the washbay was being discharged into an adjacent stormwater drain. This stormwater drainage system discharged the washwater directly to an unnamed tributary to Lower Little River (tributary). The tributary contained detergent foam downstream of the washwater discharge. Mr. Carrigan indicated that approximately one to two tractor trailer trucks were washed per day and the detergents used were biodegradable. The facility has a total of nine tractor trailer trucks. All domestic wastewater water is disposed/treated by a septic tank/drain field subsurface system. Mr. Bell discussed the relevant environinental regulations and penalties regarding the illegal discharge. In addition, Mr. Bell -recommended contacting the Alexander County Health Department (Environmental Health Section) and the Division's Aquifer Protection Section regarding nondischarge treatment options. Mr. Carrigan was very helpful and courteous during the investigation. A follow-up investigation by this Office may be necessary to verify the facility's corrective actions. During the investigation, it was learned that diesel fuel was discharged from a fuel tank that you oum into an unnamed tributary to South Yadkin River (see attached inspection report)_ The discharge of wastewater (creating of an outlet) without a permit is a violation ofNTCGS 143-215.1(a)(1). The discharge of oil into the waters of the State that resulted in a violation of the water quality standards is a violation of NCGS 143-215. 1 (a)(6). Also, the discharge of oil onto land and waters of the State is a violation of NCGS -1431- 215.83(a) (Oil Pollution and Hazardous Substances,Control Act of 1978)_ To comply with the General Statutes, it will be necessary to immediately discontinue allf wastewater discharges. A permit for the construction and operation of adequate wastewater treatment facilities and for the creation of an outlet to lands or waters of the State, for the disposal of wastewater, must be obtained if the discharge is to continue. COPIES TO: Alexander County Health Department . e1w In response to the above referenced oil spill complaint received on April 17, 2003 from the Public Water, Supply Section in the Mooresville Regional Office (MRO), an investigation was immediately conducted by Mr. Samar Bou-Ghazale of this Office. The investigation revealed that Mr. Houser, owner of Houser Farms, Inc., recently bought a 10,000 gallon underground storage tank and installed it at his property in order to use it as a water reservoir. He connected a 2" PVC pipe from a spring -head to this tank in order to flush out the tank. The tank overflowed with the spring water/diesel fuel mixture into a tributary that flowed into the South Yadkin River. The discharge flowed approximately 2.5 miles downstream to an Energy United water treatment plant in Stoney point. Alexander County Emergency Management personel placed absorbent booms and pads above the WTP intake and at the Houser Farms, Inc. site. These activities require a 401 Water Quality Certification from the North Carolina Division of Water Quality (DWQ) in accordance with 15A NCAC 2H .0500. Authorization for these impacts has not been issued by the DWQ. In addition, the impacts to the unnamed tributary to Muddy Fork Creek, a Class C waters, constitutes a violation of 15A NCAC 2B .0211(2). According to your consultant, Chris Huysman, the bulk of the restoration measures in your restoration plan were completed as of July 13, 2000. These measures involved the placement of clay plugs in the drainage ditches and the restoration of wetland contours along with the placement of rock vanes in the stream channel. The stream banks were also pulled back so that the stream would be allowed to fill back in and re-establish its sinuosity. The plan indicates that no plantings will be done at this time, but will be done after three years in the wetland area if needed and in the spring along the stream banks if needed. On August 17, 2000, Mr. Pete Colwell made a site visit to Brent -Will Estates to evaluate the measures that you have undertaken to restore the impacted wetland areas and stream. Mr. Colwell found that the ditches in the wetland area have been filled in and that eight rock check dams had been placed in the stream. At the time of his site visit, the restored wetland area was dry and appeared to be higher in the center. Very little vegetation had re -colonized the area. Mr. Colwell found that little sediment had accumulated behind the check dams to begin the stream restoration process. Since the impacted areas have not yet returned to an acceptable level of restoration, the Division will. keep the violation file open until, the. areas can be re-evaluated this winter and spring. Should the restored areas still not be acceptable, further modification and plantings may be needed. The Division also recommends that you retain an easement on the wetland and stream areas and place a deed restriction on those lots to maintain access in case further restoration work is needed. The Division is still seeking a plat showing the lots and infrastructure of your proposed development. Your immediate attention to this matter is appreciated.
