This dam is of high hazard classification. The plans, specifications, and design data submitted were prepared under the supervision of Mr. Daniel Shabeldeen, PE. This letter constitutes approval of the proposal to repair the subject dam according to the plans and specifications received by this Division on March 6, 2015, with the following stipulations: 1. Project construction shall be supervised by Mr. Daniel Shabeldeen, PE. Mr. Daniel Shabeldeen, PE, shall be responsible for field observation of construction as necessary to ensure compliance with approved plans. 2. During construction, the Division of Energy, Mineral, and Land Resources may require such progress reports as are deemed necessary. 3. A drainage outlet, designed and constructed in accordance with NRCS National Engineering Handbook Part 628 Chapter 45 and consistent with that provided for the proposed siphon, shall be provided for the proposed .filter diaphragm serving the existing principal spillway barrel. The as -built configuration of this outlet shall be reflected in the record drawings required by Stipulation No. 5. . 4. Sericea lespedeza shall be removed from the seeding schedule on Sheet 3 of 5 of the repair plans. 5. In accordance with GS 143-215.29 and NCAC 15A-2K .0203, .0212, .0215, and .0216, within 30 days of completion of the project, Mr. Daniel Shabeldeen, PE, shall inspect the completed work and upon finding that the work -has been done as specified and the dam is safe, shall file with the Division of Energy, Mineral, and Land Resources two sets of record drawings and a certificate stating that the work has been completed in accordance with approved plans, specifications, and other requirements. No water shall be impounded behind the dam until final approval for operation of this dam is issued by the Division of Energy, Mineral, and Land Resources. Also, draining of the lake shall be performed in such a manner as to preclude off -site sedimentation. Prior to issuance of final written consent for use of this dam pursuant to these repairs, the requirements of Session Law 2014-122, Section 8 must be met. Session Law 2014-122, Section 8 requires all owners of high and intermediate hazard dams to submit an Emergency Action Plan (EAP) to the Department of Environment and Natural Resources (DENR) and the Department of Public Safety (DPS) no later than March 1, 2015. More detailed information is included in the attachment to this letter. 8. An operation and maintenance (O&M) plan is required for all high hazard dams. The O&M plan should address routine maintenance, frequency of piezometer readings, frequency of inspections by the owner or the owner's representative, and annual operation of the bottom drain to ensure that it is functional. The O&M plan must be received prior to issuance of final written consent for use of the dam pursuant to these repairs. 9. This approval does not convey the right to access the private property of others. Any required access to perform the approved work must be secured prior to initiation of construction activities. 10. You must notify Mr. Zahid Khan, CPESC, Regional Supervisor, Land Quality Section, 610 East Center Avenue, Suite 301, Mooresville, North Carolina 28115, (704) 663-1699 ten days before the start of construction. The Army Corps of Engineers and the Division of Water Resources of this Department should be contacted to determine if additional permits are required. Also, the erosion and sediment control program having jurisdiction should be contacted to determine permit requirements. In any case, sediment must be prevented from entering the waters of the state or flowing onto neighboring property. Construction of the repairs must begin within one year of the date of this letter or this approval is void. II. OVERVIEW: The inspection was conducted at Craftmaster Tools Facility operated under contract by Mr. McClure. Mr. McClure was cooperative and professional. III. DEFICIENCIES, REQUIREMENTS, COMMENTS, AND RECOMMENDATIONS: GENERAL: A. COMMENT: Units of measure were not recorded, or were inconsistently recorded. REQUIREMENT: 15A NCAC 2H .0805 (g) (1) states " Data pertinent to each analysis must be maintained for five years. Certified data must consist of date collected, time collected, sample site, sample collector, and sample analysis time. The field benchsheets must provide a space for the signature or initials of the analyst, and proper units of measure for all analyses." NOTE: A cover statement may be used on the worksheet, or in the log for each parameter. For example: All Dissolved Oxygen readings are in mg/L unless otherwise specified. There would need to be a cover statement for each parameter and it would need to be printed on each sheet, or documented in each log book (on the inside front cover for example). TOTAL RESIDUAL CHLORINE: B. COMMENT: The chlorine meter is an older analog type instrument. It was difficult to determine if the gel - standard check was within 10% since it was necessary to estimate between two meter graduations. RECOMMENDATION: It is strongly suggested that this meter be replaced with a more up to date digital unit in order to obtain more accurate readings. C. COMMENT: The meter calibration procedure is unclear. It appears that no actual calibration is used to set the meter, only a three buffer check is performed. Please review the calibration procedure specified in your meter instruction manual. Indicate the procedure in your response to this report. You may submit a photocopy of the calibration instructions if you prefer. Page 2 Ron McClure REQUIREMENT: For routine work use a pH meter accurate and reproducible to 0.1 pH unit with a range of 0 to 14 and equipped with a temperature compensation adjustment. Analyze a third buffer below pH 10, approximately 3 pH units different from the second; the reading should be within 0.1 unit for the pH of the third buffer. The results of the third buffer must be documented. Ref: Standard Methods, 18th Edition - Method 4500 - H+ B (2) and (4) (a) and Ref: 15A NCAC 2H .0805 (a) (7). It is generally recommended that the laboratory calibrate the pH meter with the 4 and 10 buffers and read a 7 as the third buffer. D. COMMENT: Expiration dates for pH buffers were not available. Please maintain documentation for pH buffers in use. If these are obtained in small quantities from a commercial facility record the date obtained and the lot numbers and expiration dates for those buffers. This information can be recorded in the operator's logbook. This information should be documented each time the buffers are replaced. REQUIREMENT: Chemicals All chemicals must be dated when received and when opened. Ref: 15A NCAC 2H .0805 (a) (7) (L). E. COMMENT: Mr. Bell observed that the temperature probe was not in the sample during pH analysis. Where a combination probe is not used the temperature sensor is usually inserted in the sample with the pH probe to compensate for temperature variance. Please review the analytical procedure specified in your meter instruction manual. Indicate the procedure in your response to this report. You may submit a photocopy of the calibration instructions if you prefer REQUIREMENT: Always report the temperature at which pH is measured. The pH' measurements are affected by temperature. Ref: Standard Methods, 18th Edition - Method 4500-H+, page 4-66. (1)(b). TEMEPERATURE: F. COMMENT: The pH meter is used for temperature measurement. REQUIREMENT: A copy of documentation verifying that the meter has been checked on an annual basis must be available for review. If calibration verification was performed at a commercial laboratory this information must include the name of the laboratory, the date the calibration was performed, the make and NIST #of the thermometer used to perform the verification, and the individual that performed the calibration. Any correction factors must be posted. The commercial laboratory should provide you with a document containing this information. Please verify the above with your response to this report. DISSOLVED. OXYGEN: G. COMMENT: The elevation used to set up the D.O. meter calibration is not documented. This information may be documented in the operator's log. IV. CONCLUSION: Correcting the above -cited comments and implementing the recommendations will help this facility to produce quality data and meet certification requirements. Dear Ms. Griffin: Chapter 143, Article 21A of the North Carolina General Statutes (NCGS) authorizes and directs the Environmental Management Commission of this Department to protect and preserve the water and air resoufces of the State. The Division of Water Quality has the delegated authority to enforce adopted pollution control rules and regulations. On December 6, 2001, Mr. Samar Bou-Ghazale of this Office received a complaint of an alleged illegal oil spraying for dust control on the driveway at the subject address. The spraying of used oil for dust control is no longer allowed. The discharge of oil onto lands or into waters within this State is a violation of NCGS 143-215.83(a). Furthermore, the failure to immediately notify this department of the oil discharges and to immediately undertake to collect and remove the discharges of oil are violations of NCGS 143-215.85 and 143- 215.84(a), respectively.
