Michael,
Thank you for your PCN and attached information, dated 12/24/2020, for the above referenced project. I have reviewed
the information and need clarification before proceeding with verifying the use of Nationwide Permit (NWP) 29
(http://saw-reg.usace.army.mil/NWP2017/2017NWP29.pdf). Please submit the requested information below (via e-mail
is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide
Permit or consider your application withdrawn and close the file:
1) Your PCN included proposed impacts to streams and wetlands, however these and other potentially
jurisdictional boundaries have not been verified by the Corps. A site visit will be required to verify your
delineation of potential waters of the US. Please note that your PCN is considered on hold until your submitted

delineation is verified by our office. Further, additional revisions may be required on the PCN and plans based on
the final Corps -verified boundaries of potential waters of the US. I am currently available to field -verify your
delineation on Tuesday, 1/19/2021 at 11:30am; would this date and time work for you? The site was verified on
January 27, 2021. The attached map documents the site meeting.
2) Please note that this parcel was included in the Brightwood Farm residential development project, originally
authorized via NWP 39 dated 12/17/2002 (see attached). This permit verification authorized impacts to 300
linear feet of stream channel, although not all of them involved the permanent loss of waters and not all were
constructed. Given that this parcel was intended to be part of this larger residential development, and due to
shared infrastructure with this overall development (e.g. access from Preakness Parkway) it is likely that the
Corps will view the proposed stream and wetland impacts as cumulative with Brightwood Farm residential
development. Please provide any information you have regarding the association of the proposed project with
the Brightwood Farm residential development. We also suggest providing a functional assessment (NCWAM) of
the wetland proposed for impact given the proximity of proposed wetland impacts to the typified compensatory
mitigation threshold in Nationwide Permit 29 General Condition 23(c); The client acknowledges that the USACE
may consider the project to be part of a larger development and that impacts may be considered
cumulative. Impacts are still below mitigation thresholds so a functional assessment (NCWAM) was not
completed.
3) Please note that responses to the questions above may prompt additional information requests to allow full
evaluation of the proposed project. Noted, Please let me know if you need additional information in order to
issue the PCN.
