Reference is made to your request for rescission of the subject Groundwater Remediation Permit. Staff from the
Mooresville Regional Office has confirmed that this Permit is no longer required. Therefore, in accordance with Your
request, Groundwater Remediation Permit Number WQ000603 )6 is rescinded, effective immediately,
You are required to close the infiltration gallery at your facility in accordance with the July 8, 2003 policy
"Guidelines for Infiltration Gallery Closure and Injection Well Abandonment at Groundwater Remediation Sites." This
policy is available online at I-ittwHaw.elmr.state.tic.us/ under the Publications link. Please note that this guidance requires
docurnentation of closure activities upon completion, which should be submitted to the Aquifer Protection Section at the
address below. Any abandonment of wells, either temporary or permanent, must be in accordance with 15A NCAC 2C
.01 13.
If, in the future, you wish again to operate a groundwater remediation system, you must first apply for and receive
a new Groundwater Remediation Permit, Operating a groundwater remediation system without a valid permit will subject
the responsible party to a civil penalty of up to;$25,000 per day,

As of this date, our records indicate that the above referenced permit, which was issued on December 14, 1992
and expired on November 30, 1997, has not been renewed. It is sloth a condition of your pewit and required 'by 13A
NCAC 213 .0211 to request a renewal of your permit at least 180 calendar days prior to its expiration date. Failure to
apply for permit renewal, and continued operation of your facility without an active permit may result in an enforcement
action by the Division, in accordance with North Carolina General Statute 1 3-213.6A to 1 3- 15. C. Therefore, it is
imperative that you submit a Permit renewal application for review as soon as passible.
Although the Underground Storage Tank (UST) Section may have informed year that groundwater remediation is
temporarily not being directed at your facility due to Session Law 200 -1 4, you are still required to submit either a:
permit rescission request" or a permit renewal application to the Aquifer Protection Section (APS). To comply with the
permit requ irenwents set forth in your permit and 21-1. 211, the APS is snaking the following options available to you:
1. Permit renewal. When you apply for and receive a renewal, operation of the groundwater
remediation system will be permitted to continue. As such, annual fees, all requirements for sampling
and annual reports, and any operation and maintenance specified in your previous permit will be
required.
1 Permit Renewal with Sus ended Actions. Linder this option, you must still apply fora permit
renewal. However; you may indicate that operation of the remediation system has been suspended,
but you desire to maintain the permit should the need arise to restart the system. As such, operation
of the renediation system will be prohibited until such time that a permit modification is obtained
from the Division allowing operation of the syFsteln. Under the "Permit Renewal with Suspended
Actions" option, all monitoring and annual .reports will be suspended until othersvise notified...
Infiltration galleries will be directed to be winterized as a permit condition, as wwe ll as temporary
abandonment of any monitoring wells in accordance with I A NCAC 2C .01 13(a). Annual fees will
still be required, but may be reimbursed under the. elf' State Trust Fund as a directed cost. This
option allows you to peep your system inactive until recnediation is once again directed by the UST
Section. At that point, you will need to request a modification to your permit to activate your system.
. Permit Rescission. To apply for a rescission, you must request your permit be rescinded in writing,,
