This is to advise you that the Pitt County Technical Review Committee conditionally approved
the soil erosion and sedimentation control plan and stormwater plan for KINSAUL PLACE NORTH
on May 13, 2020. Conditions and requirements as a part of this approval are attached below.
Copies of the draft minutes from the meeting will be available upon request prior to the next
Technical Review Committee meeting.
As stipulated on the financial responsibility form, you are responsible for ensuring compliance
with all aspects of the approved plan and the Pitt County Soil Erosion and Sedimentation Control
Ordinance. Your primary objectives include, but are not limited to, preventing offsite
sedimentation, preventing sediment from entering watercourses, and establishing vegetation on
all disturbed areas within 7-14 calendar days, following any completion of a phase of grading.
As of April 1, 2019, all new construction activities are required to complete and submit an
electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the
NCGO10000 Construction Stormwater General Permit. This form MUST be submitted prior to
the commencement of any land disturbing activity on the above named project. The NOI form
may be accessed at deq.nc.gov/NCGOl. Please direct questions about the NOI form to Annette
Lucas at Annette.lucas@ncdenr.gov or Paul Clark at Paul.clark@ncdenr.gov. After you submit a
complete and correct NOI Form, a COC will be emailed to you within three business days.
Please be aware that your project will be covered by requirements of the NPDES
Construction Stormwater General Permit NCGO10000. Please become familiar with all the
requirements and conditions of this permit in order to achieve compliance.
Upon discovery of noncompliance by our office, the following actions may be taken:
1. No further permits for building or other construction will be issued.
2. The authority to continue construction, other than for erosion control measures,
will be terminated.
3. Penalties of up to $5000 per day may begin to accrue. Failure to immediately
comply upon notice of noncompliance will result in injunctive and/or criminal
action.
Other Comments:
4. This erosion control plan shall expire three years following the date of approval if
no land disturbing activity has been undertaken.
5. The Division of Water Quality may pursue legal action against you in order to
enforce requirements of the NPDES, Phase II permit.
6. The Pitt County Soil Erosion and Sedimentation Control Ordinance authorizes
County officials to inspect sites to ensure compliance with the Sedimentation
Pollution Control Act.
Title 15A NCAC 4B .0118(a) requires that a copy of the approved erosion control plan be on file
at the job site. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of
periodic inspection to insure compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring
protection of existing natural resources and adjoining properties. If, following the
commencement of this project, the erosion and sedimentation control plan is inadequate to meet
the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General
Statute 113A-51 through 66), this office may require revisions to the plan and implementation of
the revisions to insure compliance with the Act. Acceptance and approval of this plan is
conditioned upon your compliance with Federal and State water quality laws, regulations, and
rules. In addition, local city or county ordinances or rules may also apply to this land -disturbing
activity. This approval does not supersede any other permit or approval.
Please note that this approval is based in part on the accuracy of the information provided in the
Financial Responsibility Form, which you provided. You are requested to file an amended form
if there is any change in the information included on the form. Land disturbance shall not
begin until a preconstruction meeting has taken place.
Please provide a copy of the certificate of coverage prior to beginning any land disturbance.

CONDITIONS AND REQUIREMENTS

1. Install a temporary rock check dam in the swale at the north end of Windom Court.
2. Any ditches filled will need to be identified on all future plans or plats.

On page C5, show the pipe between Lots 20 and 21 to be removed and grading for the
ditch in that area.

4. Each lot will be evaluated in accordance with rules .1940 of the Laws and Rules for
Sanitary Sewage Collection, Treatment, and Disposal (15A NCAC 18A .1900).
5. No fill material (including construction spoils) is allowed on any area to be used for a
sewage disposal system or 100% repair area. Any amount of fill found on these areas
will be grounds for disapproval of the proposed lot.
6. The location of any proposed berms must be shown on all subsequent maps. The final
dimensions of the completed berm must be shown so that the Environmental Health staff
can verify that no portion of any berms will interfere with the sewage system or 100%
repair locations.
7. Locations of any soil stock pilings should be shown on the construction plan. These
stock pilings should be placed in an area not to be utilized for on -site sewage disposal.
8. If underground electrical lines or natural gas lines cross the property at any point, they
must be flagged by ULOCCO before the site is evaluated by the Environmental Health
staff.
9. The location of any existing or proposed drainage tile must be field located and shown on
a surveyed map provided to Environmental Health staff.
10. A backhoe maybe required for the site evaluations (15A NCAC 18A .1939(b)).
11. Any riparian buffers or floodways must be noted on subsequent maps.

12. NCDOT has previously agreed to delay the required turning lane for this development
until future phases of construction.
13. Waylen Drive is designated as a private drive and will not be eligible for any acceptance
onto the State Highway System.
14. Waylen Drive at its intersection with Kinsaul/Willoughby will needs to have a PUE or
more NCDOT ROW for the intersection.
15. The accommodation for a cluster mailbox system for this subdivision does not have a
turnout area.
16. Any waterline connections to existing lines must be installed without any valves within
any pavement section or invade a 1:1 slope of any proposed pavement section.
17. There is not any sidewalk proposed or provided.
18. Any sign easement should be outside of any revised ROW or PUE

19. Add a 10' Electric Easement along RoW for lots 2-8 and 13-14 on Waylen Drive
20. Add a 10' Electric Easement along ROW for lots 8-11 on Windom Court.
[General Comments]
• Soils located on site include ExA and Ly and possess the following characteristics:
■ Seasonal high water table (all soil types)
■ Shrink -swell potential is moderate (ExA)
• Pinelog Branch Watershed
• Soils are prime farmland or have statewide importance for farming. Development will
remove the site from agricultural production.
• There are no subsurface drain tile maps on file, but it is possible that subsurface drain tile
could be onsite.
• Septic and repair areas must remain out of any limits of disturbance or stock pile areas.
