Therefore, in accordance with your request, NPDES Permit NCO067644 is rescinded, effective immediately. If in the future your company wishes to discharge wastewater to the State's surface waters, they must first apply for and receive a new NPDIES permit. Discharge of wastewater without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. The foe requirement is documented. in Part II., Section B. 14 of your current permit. As of toda 's date, the following annual fees have not been paid as required by the subject permit. Annual Fee Period Amount Due November 1, 2106 - October 31, 2007 $715.00 November 1, 2007 - October 31, 2008 $860.00 November 1, 2008 - October 31, 200 $860.00 The total amount of overdue fees is $2,45.00. Failure to pay annual fees places you in noncompliance with the terms of your NPDES permit and is grounds for its revocation, as documented. in Part 11. Section B. 13 and B. 14. This matter must be promptly resolved. This letter serves as final notice that the Division will refer the fees noted above to the North. Carolina Attorney General's Office for collection through the courts unless payment in the amount of $2,435 00 is received by May 1, 2009. Make your chock payable to NC DENT and clearly denote the permit number for which you are submitting payment. Should the fees not be paid by the date noted in the paragraph above, the Division will be compelled to take further action. The current, effective NPDES permit has expired, and an application for renewal has been submitted. Under the existing circumstances, the Division will :not process the application. Before this review can be completed, the following information needs to be prodded: 1. As required by 15A NCAC 2 .0219 0)(9), a minimum of thirty days of residual sludge holding must be provided. Also this package does not mention any sludge management plans. Please verify the thirty days holding and submit a plan for the management of the sludge from this facility. 2. Again as required by 1 A iNC:AC" 2H ,021 0)(3), some form of reliability must be supplied. This section lists several options to cover the requirement of reliability. The Division prefers a standby power supply on site.. However, if either A or B applies then standby power is not required; A. If the facility can show that. 1. the plant serves a private water distribution system which has an automatic shut-off at power failure and no elevated tanks, and 2. has sufficient storage capacity that no potential for overflow exists, and 3. can tolerate septic wastewater due to prolonged detention B. where the waters that would be impacted by a power failure are classified as "C:" waters (this facility), the applicant may be allowed to show a history of power reliability ( at least three years where the power outage was not longer than the storage capacity of the treatment facility) that would demonstrate that an alternative power source or other source or reliability measures would not be needed.
