S&ME has not worked on this site for many years. As we recall, the NPD S discharge permit was
obtained for a subgrade parking deck dewatering system whore groundwater was impacted with
petroleum products from UST releases. It was not part of a groundwater corrective action remediation
system. We were not involved with the project during or after construction of the new building,
however, we believe that the system, , was never activated since groundwater levels dropped after
construction and dewatering was not necessary. The permit may have been renewed in the event that

In 1995, Bank of America acquired a permit to discharge wastewater from its property at 401 North
Tryon Street:
The wastewater was from a system to remediate contaminated groundwater at the site.
RofA was issued Certificate of Coverage NC 510277 under general Permit NCG510000 on /30/19 5.
N G5102 7 was renewed by BofA in 1997 and 2001.
A renewal notice was sent in February 2006; no response to the notice was received.
A Notice of Violation was sent via Certified Mail to Mr. Lincoln Harris of RofA in June 2006; records from
the LISPS show it was received on June 8, 2006 by Cynthia Leonard. No response to the NOV was ever
received by the Division.
NC 5102 7 expired on 9/30/ 006. Any discharge from the system after 9/30/2006 is ILLEGAL.
Your name was included in Division records as a contact for this facility.
Please let me know if RofA is still using the system, or when the system was shut down.
If the system is still in operation, complete and return the attached renewal form IMMEDIATELY.
There are also several unpaid annual fees to be resolved.

If the system has been shut dawn, I will pursue resolution with our inspectors in the NC DEIR
Mooresville Regional Office.

NPDES General Permit NCG510000, under which the subject facility is covered, expires on
September 30 2006. North Carolina. Administrative Code (15A NCAC 2H.0105(e)) requires that an
application for permit renewal be filed at least 180 days prior to expiration of the current hermit. To satisfy
this requirement, your renewal package should have been sent to the Division postmarked no later than
,April 3 2006
The Division has not received a renewal request for the subject CoC. This is a violation of your
permit at fart 11. S. 10, which states "Any permittee that has not requested renewal at least 180 days prior
to expiration..`. will subject the per ittee to enforcement procedures as provided in NCGS 143-215.+6 and 33
USC 1251 et. seq.".
To prevent an assessment of civil penalties you must submit a completed permit application (see
enclosed forms) no later than. Jame 19. 2006. If the system is inactive clue to lack of trust fund payments,
but the'remediation equipment is still on site, the CoC should be renewed.
If all remediation discharge from this facility has ceased and you wish to rescind this COG [or if you
have any other questions], contact Charles Weaver of my staff. Mr. Weaver's telephone number, fax number

The facility listed above is covered under NPDES permit NCG510000 for discharge of remerhated
groundwater. NCG51 0000 expires on September 30, 2006. Federal (40 CFR 122.41) and North Carolina (15A
NCAC 2H.0105(e)) regulations require that permit renewal applications must be filed at least 180 days prior
to expiration of the current permit. If you have already mailed your renewal request, you may
disregard this notice.
To satisfy this requirement, the Division must receive your renewal request postmarked no later than
Apdl & 2006. Failure to request renewal by this date may result in a civil assessment of at least $500.00.
Larger penalties may be assessed depending upon the delinquency of the request.
If any discharge from the remediation system will occur after September 30, 2006, your CoC must be
renewed. Discharge of wastewater without a valid permit would violate North Carolina General Statute 143-
215.1; unpermitted discharges of wastewater may be assessed civil penalties of up to $25,000 per day.
If you have halted remediation activity due to lack of trust fund money, but your site ranking from the
Aquifer Protection Section requires future remediation & discharge, your CoC must be renewed.
If all discharge has ceased at your facility and you wish to rescind this CoC [or if you have other
questions], contact me at the telephone number or e-mail address listed below.

n accordance with your application for an NPDES discharge permit received June 28, 1995 by the
Division, we are herewith forwarding the subject Certificate of Coverage under the state-NP ES general
permit for groundwater remediation facilities and one set of final approved plans and specifications.
.Authorization is hereby granted for the construction and operation of a ;31,000 GPD groundwater
remediation system consisting of a 200 gallon oil/water separator with a 30 gallon product wn , a 275
gallon sump with a 0.5 hp tr sfe ;sump, a 3 tray aif stripper with a 300 cfm (minimum) btow,�r, a 0.5 hp
transfer pump, dual particulate filters in parallel, and dual carbon adsorption units in series with discharge
of treated wastewater into Little Sugar Creek. This Certificate of Coverage is issued pursuant to the
requirements of North. Carolina and the US Environmental Protection Agency Memorandurn of Agreement
dated December 6, 1983 and a�=° vnbsequently amended.

are unacceptable to you y,-=c have the right to submit an individual permit application and letter requesting
coverage under an indii(id-ial permit, unless such demand is made, this decision shall be final and

followed in case of change of ownership or control of this discharge.

eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00
a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, the Certificate ofCoverage, this Authorization to Construct and the
approved plans d specifications. bait the Certification to the Permits and Engineering Unit, P.O. Box
29535, Raleigh, NC 2762+ -0535.
A copy of the approved plans d specifications shall be maintained on file by the Pennittee for the
life of the facility.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 1 3- 1 . C
