Dear Mr. Basinger,
Please let this letter serve as Charlotte Waer's formal response to NCDWR's Notice of Violation for an exceedance
of the daily maximum fecal coliform limit. Charlotte Water fakes environmental compliance seriously and has
conducted a thorough review of all data related to the exceedance of the daily maximum fecal coliform limit that
occurred at Oxford Glen on August 24, 2016. Charlotte Water has reviewed the following information in an effort to
better understand the cause of this exceedance:
1) Validated Laboratory Data and its associated audit trail
2) Laboratory Exception Reports
) Laboratory Bench Level Raw Data
4) Other fecal coliform sample 'results and expected values for August 24, 2016
5) Chain Of Custody's associated with this sample, as well as other samples on the same data
6) Oxford Glenn's Daily Operations Data
Unfortunately, at the conclusion of this review, we were unable to determine a definitive cause of the exceedance.
Charlotte Water does, however, find it very unusual that our upstream value and Oxford Glen's effluent value were
both 470 cfu1104m1's. Although we exceeded the daily max limit of 400 cful104ml, at the time of the collection of the
grab sample„ we do not believe that levels were greater than 400 cful104ml over the duration of the entire day.
Charlotte Water's daily operations data from the same date indicated no upsets or unusual circumstances occurred
during this time period.
In addition, while this result does exceed Oxford Glenn's daily maximum permitted limit for fecal coliform of
404cfu1104mis, the limit as expressed, is much more stringent than the applicable water quality standard which is a
weekly geometric mean of 400 eful104ml and a monthly geometric mean of 200 c u1104mis. Therefore, assuming
the results for fecal coliform on August 24th are accurate, the stream would not have been impaired for fecal coliform
and would have continued to meet its designated use. Charlotte Water's subsequent sampling event on August 26,
2016 yielded a result of 3 cf (104mis which resulted in a weekly average of 38 cfu%104mis, well below the water
quality standard.

Dear NPDES Permittee:
The U.S. Environmental Protection Agency (EPA) recently published the National Pollutant Discharge
Elimination System (NPDES) Electronic Reporting Rule. The rule requires NPDES regulated facilities to
report information electronically, instead of filing written paper reports. The rule does not change what
information is required from facilities. It only changes the method by which information is provided (i.e.
electronic rather than paper -based).
EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their
key milestones, are:
• Phase 1—Starting can [December 21, 2016, regulated entities that are required to submit Discharge
Monitoring Reports (DMPs) will begin submitting these reports electronically. If you are currently
reporting your DMR data electronically using eDMR, then you simply need to continue reporting
in the same way as you are now, The key change is that, starting on December 2 , 2016
electronic reporting of D Rs will be required, instead of voluntary.
• Phase 2--Starting on December 21, 2020, regulated entities that are required to submit certain
other NPDES reports will begin submitting these reports electronically, Reports covered in the
second phase include Notices of Intent to discharge in compliance with an NPDES general permit,
Sewer Overflow/Bypass Event Reports, and a number;of other NPDES program reports.

Following the elevated concentration of ammonia on July 11, 2013 Aqua conducted a farther
investigation and found a start capacitor on one of the two blowers that was causing it not to start. We
have replaced the capacitor and since that time the blower has functioned correctly.

Response:
The reason for the elevated ammonia concentrations in the effluent is due to insufficient' air concentrations in the
treatment process. This W WTP is equipped with two blowers and during Aqua's investigation, we found and
replaced bad overloads in one of the blower motors. Also, the operator of the plant has been making adjustments in
air delivery to each drop in the aeration basin.

Recommendation for Enforcement, NGV-2013-1{V-0300, dated May 8, 2013.This violation was for
BOO and ammonia daily maximum and monthly average violations in February 2013.

This facility has been struggling with the movement of air throughout the biological process and as a
result, Aqua exceeded the daily and monthly average for BOD and ammonia for the month of February.
We have evaluated individual components of the air delivery system over the last several weeks and
based on the last set of Modifications, Aqua believes that it has resolved this issue.

Aqua North Carolina, Inc. (Aqua) offers the following response to the Notice of Violation and Notice of
Recommendation for Enforcement, NOV-2013-LV-0093, dated February 11, 2013. This violation was
for BOD daily maximum and monthly average violations in October 2012 and dissolved oxygen daily
minirnum violation on November 3, 2011
Response.
,rhe'back-up Operator in Responsible Charge (ORC) who was operating Oxford Glen WW`I'P at the time
of the NOV is not aware of what happened on the two days in which the daily maximum for BOD was
exceeded. All of the plant processes were working as usual. Aqua will ensure that it corrects any
problems that it may find in an effort to remain compliant with the self assessment monitoring and
reporting program,

On July 5, 2012, this Office was contacted (via e-mail) by Aqua North Carolina, Inc. personnel
regarding the above -referenced Notice of Violation and Notice of Recommendation for Enforcement
(NE V-NRE). TheNOV-NRE was issued for an exceedance of the ammonia monthly average permit
limit in Larch 2012. The e-mail message from Ms. Jennifer Nall contained a scanner version of an
amended March 2012 DMR for Oxford Men and noted that the ammonia and total suspended solids
concentrations reported on March 9, 2012, had been transposed. The revised ammonia
concentration therefore did not result in a monthly ;average permit limit exceedance.
Based on the submitted information and our; understanding that an original signed copy of the
amended March 2012 DMR for Oxford Glen would be submitted to the Division's Central Files this
Office' is rescinding the above referenced NtV-NRE. If you have any further questions concerning

(50060) column. Please submit an amended DMR to the Mooresville Regional Office of the
Division of Water Quality.
FACILITY SITE REVIEW:
All of the existing components of the facility were in service and appeared to be
operating properly. A propane -powered generator at the site provides a secondary power source.
The ORC reports that there have been no system malfunctions that resulted in, overflows or
bypasses.
FLOW MEASUREMENT:
Flow measurement is accomplished using a V-.notch weir as the primary device and a
totalizer/continuous recording flow meter, which is in accordance with NPDES pen -nit

requirements. The flow meter was last calibrated on September 20, 2005, by J. Thurman Horne,
P.E., of Horizon Engineering and Consulting, Inc.
LABORATORY:
Aqua North Carolina is certified by the Division of Water Quality to perform field
parameter laboratory analyses (NC Laboratory Certification #5035) and contracts with Water
Tech Labs, Inc. (NC Laboratory Certification #50). Water Tech Labs, Inc. was not evaluated in
this inspection. A review of documentation/instrumentation associated with field parameter
laboratory analyses was completed during the inspection. No deficiencies were found.
EFFLUENT/RECEIVING WATERS.
The effluent was clear and did not appear to have a negative impact on the receiving
stream at the time of the inspection. The facility discharges to Stevens Creek, which is a Class
water in the Yadkin -Pee Dee River Basin and a tributary to Crouse Creek. Please note. The
recently passed Site Specific "Water Quality Management Plan for the Goose Creek
Watershed includes a 0.5 m or less total ammonia level for toxicity control (Effective
elate —`February 1 2009.
SELF -MONITORING PROGRAM:
Discharge Monitoring Reports (DMRs) were reviewed for the period January 200
through December 2008 and appeared to be ,properly completed with the exception of the August
2008 DMR as stated above in the Records/Report Section. The reports indicate that the facility
was meeting permit effluent limits and monitoring requirements during this period and that all
parameters are being monitored at the required locations.
OPERATIONS & MAINTENANCE:
The facility and grounds appeared to be properly operated and maintained. The current
overall operating strategy appears acceptable for the size and type of the facility. All field
instruments are calibrated each time before use. Heater Utilities completes all equipment repairs
and routine maintenance. The system is located within a fenced area with a lacked gate, which is
only accessible to .Aqua North Carolina, Horizon Engineering and Consulting, Inc., BioTech,
Inc. and L & L Environmental Services, LLC.
SLUDGE DISPOSAL:
Sludge is removed from the digester and taken off site by pump and haul methods. Sludge is
removed by I ioTech, Inc. and L & L Environmental Services, I. LC. These companies were not
evaluated under this inspection.
SEWER OVERFLOW:
Please be advised that pursuant to Part II, Section E of ;your NPDES permit and North

istrative Code (NCAQ 15A 2B .0506 (a)(2), any failure of a collection system,
or treatment facility resulting in a bypass without treatment of all or any portion
,r shall be reported to the appropriate regional office (Mooresville Regional

GENERAL
Mr. Christopher Elmore of the Mecklenburg County Water Quality Program (MCWQ)
last inspected the facility on March 13, 2007. A Compliance Evaluation Inspection Report was
issued. on April 4, 2007
PERMIT:
The current permit properly describes the facility and appears adequate for the
wastewater being treated. The current permit became effective on February 4, 2004, and will
expire on October 1, 2008.
The 0.075MGD facility consists of an extended' aeration package treatment plant with an
influent lift station, a bar screen, an equalisation basin, two aeration basins connected in series, a
rectangular clarifier, an ultra -violet ( disinfection system, continuous recording flow
measurement, dual tertiary sand filters, a filter backwash tank, post aeration, and an aerobic
sludge digester.
The certification classification for NCO0635 84 requires that the facility have an Operator
in Responsible Charge (CIRC) with a Grade 2 Biological Water Pollution Control System (WW-
2) certification. The facility is staffed (ORC and back-up) with personnel that possess the
appropriate operator certification.
RECORDSIREPORTS:
Discharge Monitoring Reports (DMRs) were reviewed for the period January 2007
through December 2007 and appeared to be properly completed. Records, reports, and logs are
clean and well maintained.

PERMIT:
The current permit properly describes the facility and appears adequate for the
wastewater being treated. The previous permit expired. on August 31, 2003. The current permit

became effective can February 4, 2004.
The 0.075; MGD facility consists of an extendedaeration package treatment plant with
influent lift station, bar screen, equalization basin, two aeration basins connected in series, a
rectangular gular clarifier, ultra -violet (UV) disinfection system, continuous recording flaw
measurement, dual tern sand filters, filter backwash , tank, post aeration, and aerobic sludge
digester.
e Operator in Responsible Charge (ORC) is Mr. Bill Henson. He maintains a North
Carolina Operators Certification Grade IV Certification 710 , which is acceptable for the class
of the facility.
.RECO PORTS:
Discharge Monitoring Reports (I MRs) were reviewed for the period March 2005
through February 2006 and appeared to be properly completed. Records, reports; and lags are
clean and well maintained.
FACILITY SITE 'III:
All of the major components;of the facility were in service and appeared to be operating
properly. A new propane powered generator has been added to the site to provide a secondary
power source. The ORC reports that there have been no system malfunctions that resulted in
overflows or bypasses in the last twelve months,
FLOW MEASUREMENT:
Flow measurement is accomplished using a V-notch weir as the primary device and a
totalizer/continuous recording flow meter, which: is in accordance with NP3ES permit
requirements. The flow meter was last calibrated in July 2005 by Horizon Engineering;and
Consulting; Inc.
LABORATORY:
Analysis of effluent, upstream, and downstream samples are conducted by Water Tech
Labs, Inc, (NC Certification ). Water Tech Labs, Inc. was not evaluated under this inspection.

stream at the time of the inspection. The facility discharges to Stevens Creek, which is a Class C
water Yadkin -Pee Dee River Basin.
SELF -MONITORING PROGRAM:
Discharge Monitoring Reports (D were reviewed for the period January 2004
through February 2005 and appeared to be properly completed. Records, reports, and logs are
clear and well maintained. The reports indicate that the facility was meeting permit effluent
limits and monitoring requirements during this period and that all parameters are being
monitored at the required locations.
OPERATIONS & MAINTENANCE:
e facility and grounds appeared to be properly operated and maintained. The current
overall operating strategy appears acceptable for the size and type of the facility. All field
instruments are calibrated each time before use. Heater Utilities completes all equipment repairs
and routine maintenance, The system is located within a fenced area with a locked gate, which is
only accessible to Heater Utilities and Liquid Waste.
SLUDGE DISPOSAL:
Liquid Waste, Inc. hauls waste solids off site. The sludge is discharged to the CMU
system through an approved permit. Liquid Waste, Inc. was not evaluated under this inspection.

Please be advised that pursuant to Part 11, Section E'ofyour SAES permit and
North,Carohna Administrative Code (NCAQ 1 A 2B .0506 (a)(2) any failure of a collection
system, pumping station or treatment facility resulting in a bypass without treatment of all or any
portion of the wastewater shall be reported to the appropriate regional office (Mooresville
Regional Office 704/663-16 9) as soon as possible but no later than 24 hours from the time the
permittee becomes aware of the bypass. For spills/bypasses that occur in :!Mecklenburg County,
it is requested that MC QP be notified at 704/ 36-5500. Spills occurring on weekends or
holidays can be reported by calling the North Carolina Division of Emergency Management at
00/66 -- 6, 0/ 5 -0 6 , or t /733- 30 . A written report shall also be provided within
five (5) days of the time of the incident. The report shall contain a description of the bypass, d
its cause, the period of the bypass, including exact dates and times, and if the bypass has not
been corrected, the anticipated time it is expected to continue; and steps taken (or planned) to
reduce, eliminate, and prevent recurrence of the similar events. Any spill that reaches sace
waters (i.e. any spill that reaches any water already present in a conveyance, stream, ditch, etc.)
or any spill greater than 1,000 gallons on the ground that does not reach surface waters must be

PERMIT:
The current permit properly describes the facility and appears adequate for the
wastewater being treated. The previous permit expired on August 31, 2003. The current permit
became effective on February 4, 2004.
The 0.075 MGD facility consists of an aeration package treatment plant with
influent lift station, bar screen, equalization basin two aeration basins connected in series, a
rectangular clarifier, ultra -violet ) disinfection system, continuous recording flow
measurement, dual tertiary sand filters, filter backwash tank, post aeration, and aerobic sludge
digester.
e Operator in Responsible Charge (CORC) is Mr. Bill Henson. He maintains a North
Carolina rators Certification Grade IV, Certification #710 , which is acceptable for the class
of the facility.
CO PORTS:
Discharge Monitoring Reports (D ) were reviewed for the period January 2003
through December 2003 and appeared to be properly completed. Records, reports, and logs are
clear and well maintained.
FACILITY SITE VIEW:
All of the major components of the facility were in service and appeared to be operating
properly except for the sand filters which were being replaced at the time of the inspection.
During the review period the facility installed an ultra -violet disinfection system which
eliminated the need for Total Residual Chlorine (TRC) limits and monitoring. The UV system
began operation in July 2£103. e ORC reports that there have been no system malfimctions that
resulted in overflows or bypasses in the last t el ve months.
FLOW MEASUREMENT. -
Flow measurement is accomplished using a V-notch weir as the primary device and a
totalizer/continuous recording flow meter,; which is in accordance with NPDES permit
requirements. The flow meter was last calibrated in July 2003.
LABORATORY:
Analysis of effluent, upstream, and downstream samples ,are conducted by Water Tech
Labs, Inc. C Certification 0). Water Tech Labs, Inc. was not evaluated der this inspection.

DENT +CE NG WATERS:
The effluent was clear d did not appear to have a negative impact on the receiving
at the time of the inspection. The facility discharges to Stevens Creek, which is a Class C"
fa -Pee Dee River Basin.
OPERATIONS & MAINTENANCE:
The facility and grounds appeared to be properly operated and maintained. The current
overall operating strategy appears acceptable for the size d type of the facility. All field
instruments are calibrated each time before use. Heater Utilities completes all equipment repairs
d routine maintenance. The system is located within a fenced area with`a locked gate, which is
only accessible to Heater Utilities and Liquid Waste.
SLUDGE DISPOSAL:
Liquid Waste, Inc. hauls waste solids offsite. The sludge is discharged to the CMU
system through an approved permit. Liquid Waste, Inc. was not evaluated der this inspection.
SEWER OVERFLOW:
:
Please be advised that pursuant to Part IL, Section E of your LEES permit, and forth
Carolina Administrative Code (1'4CAC) l A 2B .0506 (a)(2), any failure of a collection system,
pumping station or treatment facility resulting in a bypass without treatment of all or any portion
of the wastewater shall be reported to the appropriate regional office (Mooresville Regional
Office 04- 63-1n99) as soon as passible but no later than 24 hours from the time the permittee
became aware of the bypass. Spills occurring on weekends or holidays can be reported to the
Division's Emergency Respoe personnel at 800/66 -79 i, 800/8 8-03o8 or 9I9-73 -3300. A
written report shall also be provided within five (:) days of the time of the incident. The report
shall contain a description of the bypass, d its use, the period of the bypass, including exact
dates and times, and if the bypass has not been corrected, the anticipated time it is expected to
continue; and steps taken or planned) to reduce, eliminate, d prevent recurrence of similar
events. Any spill that reaches surface waters (i.e. any spill that reaches any water already present
in a conveyance, stream, ditch, etc...) or any spill greater than 1,000 gallons on the ground that
does not reach surface waters must be reported

SEWER OVERFLOW (cant.):
An adequate spill response for those spills reaching surface waters should include an
evaluation downstream of the point at which the spill entered surface waters to determine if
fish kill occurred. The evaluation should also include the collection of upstream dissolved
oxygen and pH measurements for background information d dissolved oxygen and pH
measurements at multiple points downstream of the envy paint to document any negative
