WWTP was taken out of service in September 2015. Subsequently the components of the
plant have been removed from the site. The effluent discharge tine was property abandoned
by the insertion of ftowable fill. Documentation of the abandonment of the effluent discharge
tine is attached.

This is to infortri you that the Division of Water Resources did not receive your monthly monitoring report for
August 2015. This is in violation of Part 11,'condition 1 (2) of'the P S permit, as well as 1 A NCAC 2B
.506(a), which requires the submittal ofDischarge Monitoring Reports no later than the last calendar day
followin t e reporting eriocl Failure to submit reports as required will subject the violator to the assessment of
a civil penalty of up to $25,000 per violation.
To prevent further action, please submit the reports within fifteen () days of receipt of this notice.
If this facility is inactive or not constructed, you may submit a written request to suspend monitoring.; The
request should include a begin date and end date for the period of monitoring.
.Additionally, this letter provides notice that this office will recommend the assessment of civil, penalties if future
reports are not receivedwithin the required time frame during the next twelve (l2) retaortin n ontlt . The

regarding the above -referenced Notice of Violation (NOV). The NOV was issued for not monitoring
flow continuously during December 2012. The e-mail message from Ms. Jennifer Seale contained a
scanned version of an amended December 2012 DMR for Mint Hill Festival and noted that the flow
had been recorded in the log book but not transcribed on the December 2012 DMR.
Rased on the submitted information and our understanding that an original signed copy of the
amended December 2012 DMR for Mint Hill Festival would be submitted to the Division's Central
Files this Office is rescinding the above referenced NOV. If you have any further questions

PERMIT.
The current permit bee a e effective on July 1, 2010, and expires on .Tune 30. 2015,. The 0.035 i\/tGD facility
consists of an extended aeration package treatment plant with influent lift stations, bar screen, equalization
basin, aeration basin, a rectangular clarifier, Tablet chlorination, chlorine contact chamber. tablet dechlorination;
continuous recording flow measurement, tertiary sand filters, mud well. clear well. aerobic digester, and post
aeration.
The certification classification for NNC006,3789 requires that the facility have an operator in responsible charge
(f RC) with a Grade 2 Biological Water Pollution Control System (� V- ) certification. The facility is staffed
(ORC and back-up) with personnel that possess the appropriate operator certification.
RECORDS/REPORTS:
Discharge .Monitoring Reports (DMRs) were reviewed for the period January 2010 through December 2010.
The DMRs appeared to be in compliance with the facility's permit. Self -monitoring records were observed at
the time of the inspection:
FACILITY SITE VIEW:
At the time of the inspection the facility generator was being repaired. The treatment system is located within a
fenced area with a locked gate., which is only accessible to Aqua North Carolina, Horizon Engineering and
Consulting, Inc., l ioTech Inc. and L & L Environmental Services, LLC.
EFFLUENT/RECEIVING 'VATEERS.
The facility discharges to Irving Creek, which is a Class C water in the Catawba River Basin. The effluent
discharges into a; concrete structure and could not be observed, However, the receiving water slid not appear to
be adversely affected by the effluent.
FLOW MEASUREMENT:
Flow measurement is accomplished using a V-Notch weir as the primary device and a totalizer/continuous
recording flow meter which is in accordance with. N DFS permit requirements. The flow meter was last
calibrated on July 9, 2010.
SELF -MONITORING PROGRAM:
Discharge Monitoring Reports (DMRs) were reviewed for the period January 2010 through December 2010,
The DMRs indicate that the facility was in compliance with permit monitoring requirements and discharge
limits during the review period.
LABORATORY:
Arta North.. Carolina is certified by the Envision. of Water Quality to perform field parameter laboratory
analyses (NC Laboratory Certification # 50 5) and contracts with Water Tech Labs, Inc. (INC Laboratory-
Certification # 5 ) to perform all other chemical analyses specified in the. pennit. Water Tech Labs, Inc. was not
evaluated in this inspection.

OPERATIONS & MAINTENANCE:
The facility appeared to be well maintained, The permittee was repairing the generator at the time of the
inspection.
SLUDGE DISPOSAL:
Slud�e is removed from the digester and taken off site by pump and haul methods. Sludge, is hauled by Biotech,
Inc. and L & L Environmental Services. Biotech, Inc. and L & L Environmental Services were not evaluated
tinder this inspection.
SEWER OVERFLOW:
Please be advised that pursuant to Part 11, Section E of your NPPE S permit and North Carolina Administrative
Code ('NCAQ 15A 213 .0506 (a)(2), any failure of a collection system, pumping station or treatment facility
resulting in a bypass without treatment of all or any portion of the wastewater shall be reported to the
appropriate regional office (Mooresville Regional Office 704/663-1699) as soon as possible but no later than 24
hours from the time the permittee became aware of the bypass. For spills/bypasses which occur in Mecklenburg
County, it is requested that MCWQP be notified at 704/336-5500. Spills occurring on weekends or holidays
can be reported by calling the North Carolina Division of Emergency Management at 919/73' )-33300, 800/662-
7956, or 800/858-0368. A written report shall also be provided within five (5) days of the time of the incident,
The report shall contain a description of the bypass, and its cause; the period of the bypass, including exact
dates and times, and if the bypass has not been corrected, the anticipated time it is expected to continue; and
steps taken (or planned) to reduce, eliminate, and prevent recurrence of the similar events. Any spill that
reaches surface waters (i.e. any spill that reaches any water already present in a conveyance, stream, ditch,
etc...) or any spill greater than 1,000 gallons on the ground that does not reach surface waters must be reported.
An adequate spill response for those spills reaching surface waters should include an evaluation do-vvnstream of
the point at which the spill entered surface waters to determine if a fish kill occurred. The evaluation should
also include the collection of upstream dissolved oxygen and pH measurements for background information and
dissolved oxygen and PH measurements at multiple points downstream of the entry point to document any
negative impact. Failure to report the bypass of collection system, pumping station or treatment facility subjects
violators to penalties of up to $25,000-00 per day per violation.

GENERAL:
The facility was last inspected by Ms. Olivia Edwards of the Mecklenburg County eater
Quality Program (MCW )p) on November 30, 2002. A Compliance Evaluation Inspection
report was issued on December 18, 2007.
PERMIT:
The current permit became effective on July 1, 2005, and expires on June 30, 2010. The
permit properly describes the facility. The 0.033 MGD facility consists of an extended aeration
package treatment plant with influent lift stations, bar screen, equalization basin, aeration basin,
a rectangular clarifier, tablet chlorination, chlorinecontact chamber, tablet dechlorination,
continuous recording flown measurement, tertiary sand filters, mud well, clear well, aerobic
digester, and post aeration. The facility appears to be adequate for the wash stream being,
treated.
The certification classification for NCO0 3' 89 requires that the facility have an operator
in responsible charge ((SRC) with a Grade 2 Biological Water Pollution Control System (WW-2)
certification. The Division of Water Quality Compliance Database currently shows Mr. Billy
Henson as the ORC and nine qualified. Back-up CRCs. However, the September, October,
and November 2008 Discharge Monitoring Reports note that Mr. Carl Donahue is the
ORC at the Facility. Please complete the. attached ORC form (if not clone already) if there
has been a change to the ORC at the facility, the form mush be submitted. within 120 days`
of an ORC change.
CORDS PORTS
Discharge :Monitoring Reports (DMRs) were reviewed for the period September 2007
through August 2008. The reports appeared to be properly completed. The ORC maintains
detailed visitation logs and calibration records relative to the operation, maintenance, and self
monitoring of the facility. Records and logs were readily available upon request.
FACILITY SITE REVIEW:
All of the existing components of the facility were in service and appeared to be
operating properly at the time of the inspection.
EFFLUENT/RECEIVING WATERS:
The facility: discharges to Irvins Creek, which is a Class C water in the Catawba River
Basin. There was no discharge at the time ofthe inspection. The receiving water slid not appear;
to be adversely affected by the effluent.
FLOW MEASUREMENT:
Flow measurement is accomplished rising a Y}Notch weir as the primary device and a
totalizer/continuous recording flow meter in accordance with NPD S permit it requirements. J.

requested that MCQP be notified at 704t336-5500. Spills occurring on weekends or holidays
can be reported by calling the North Carolina Division of Emergency Management at 919f733-
3300 800/662-7956, or 800/8 -036 . A written report shall also be provided within five (5)
days of the time of the incident. The report shall contain a description of the bypass, and its
cause; the period of the bypass, including exact dates and times, and if the bypass has not been
corrected, the anticipated time it is expected to continue; and steps taken (or planned) to reduce,
eliminate, and prevent recurrence of the similar events. Any spill that reaches surface waters
(i.e. any spill that reaches any water already present in a conveyance, stream, ditch, etc...) or any
spill greater than 1,000 gallons on the ground that does not reach surface waters must be
reported.
An adequate spill response for those spills reaching surface waters should include an
evaluation downstream of the point at which the spill entered surface waters to determine if a
fish kill occurred. The evaluation should also include the collection of upstream dissolved
oxygen and pH measurements for background information and dissolved oxygen and p
measurements at multiple points downstream of the entry point to document any negative
impact. Failure to report the bypass of collection system:., pumping station or treatment facility
subjects violators to penalties of up to $25,000.00 per day per Violation.

70'ri-FMONITORING PROGRAM:
Discharge Monitoring Reports (DMRs) were reviewed for the period September 2006
through. August 2007. The reports indicate that the facility was meeting permit effluent limits
during this period and that all parameters are being monitored at the proper frequency and
location. All DMRs were properly completed and no permit violations were noted. Records,
reports and logs are clear and well maintained:
LABORATORY:
Aqua North Carolina is certified by the Division of Water Quality to perform field
parameter laboratory analyses (NC Laboratory Certification 5035) and contracts with Water
Tech Labs, Inc. (NC Laboratory Certification ##5) to perform all other chemical analyses
specified in the permit. Water Tech` Labs, Inc. was not evaluated in this inspection.
:field instruments are calibrated before each use. A review of the documentation and
instrumentation associated with field parameter laboratory analyses was completed during the
inspection. No deficiencies were found. Flow proportional composite samples are being
collected.
OPERATIONS & MAINTENANCE:
The facility and site appeared to be properly operated 'and maintained. The current
overall operating strategy of the ORC appears acceptable for the size and type of the facility.
Staffing is sufficient for the facility and the CRC or backup is available to be contacted during
off hours should problems occur. The ORC visits the facility daily and has adequate backup
assistance when needed.
SLUDGE DISPOSAL:
Sludge is removed from the digester and taken tiff site by pump p haul methods.
Sludge is hauled by Liquid Waste, Inc. and is disposed of at an approved POTW (Charlotte -
Mecklenburg Utilities) disposal site. Liquid Waste, Inc. was not evaluated under this inspection.
SEWER OVERFLOW:
Please be advised that pursuant to Part 11, Section E of your NPDES permit and North
Carolina Administrative Code (NCAC) 15A 2B 0506 (a)( ), any failure of a collection system.,
pumping station or treatment facility resulting in a bypass without treatment of all or any portion
of the wastewater shall be reported to the appropriate regional office (Mooresville Regional
Office 704/6 3-1699) as soon as possible but no later than 24 hours from the time the permittee
became aware of the bypass. For spills/bypasses which occur in Mecklenburg County, it is
requested that MCWQP be notified at 704/336-5500. Spills occurring on weekends or holidays
can be reported by calling the North NCarolina Division ofEmergency Management at 919 733-

GENERAL: -
The Mecklenburg County Water Quality Program (MCWQP) last inspected the facility
on June 9, 2005. A Compliance Evaluation inspection Report was issued to Heater utilities, Inc.
on ,Tune 21, 2005. Since the last inspection, Heater utilities, Inc. has changed names and is now
Aqua North Carolina.
PERMIT:
The current permit became effective on July 1, 2005 and expires on June 30, 20 10.
The 0.035 MGD facility consists of an extended aeration package treatment plant with
influent lift stations, bar screen, equalization basin., aeration basin, a rectangular clarifier, tablet
chlorination.., chlorine contact chamber, continuous recording flow measurement, tertiary sand
filters, mud well, clear well, aerobic digester, and post aeration.
RECORDS/REPORTS:
Discharge Monitoring Reports (I.JMR's) were reviewed for the period March 2005
through January 2006. The reports appeared to be properly completed. The ORC maintains
detailed lags and calibration records relative to the operation & maintenance and self -monitoring
of the facility,
FACILITY SITEREVIEW:
The facility discharges to Irvins Creek, which is a Class C water in the Catawba River
Basin,
The CIR.C, Billy R. Henson, maintains a North Carolina Operators Certification. Grade IV
(certificate number 7106), which is acceptable for the class of the facility.
All of the existing; components of the facility were in service and appeared to be
operating; properly at the time of the inspection.'
FLOW MEASUREMENT:
Flow measurement is accomplished using, a V-Notch weir as the primary device and a
totalizer/continuous recording flow meter in accordance with. NP DES permit requirements. J.
Thurman Horne P.E., of Horizon Engineering and Consulting, Inc. last calibrated the flow meter
on July 3, 2005.
EFFLUENT/RECEIVING WATERS:
The effluent could not be visually inspected daring the inspection due to elevated stream
levels. The receiving stream was impacted by storm water at the time of the inspection, and no
detrimental impacts were observed.

LABORATORY:
Water Tech Labs, Inc. has been contracted to provide analytical st
laboratory in the state of North Carolina, Water Tech Labs, Inc. was not
inspection.

received on January 20, 2006, by the Division. Authorization is hereby granted for the
construction of modifications to the existing Mint Hill Festival W TP, with discharge of treated
wastewater into McEwen Labe in the Catawba River Basins
This authorization results in no increase in design or permitted capacity and is awarded
for the construction of the following specific modifications.
Installation of a tablet dehlorination system pursuant to the fast track application
received on January 20, 2006, and in conformity with the Minimum Design
Criteria for Dehlorination Facilities.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of
NPDES Permit No. NCO063789 issued May 1, 2005, and shall be subject to revocation unless
the wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified. in Permit No. NC0063789
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by this Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.

James Wilson of the Mecklenburg County Water Quality Program (MCWQP) last
inspected the facility on May 6, 2003. A Compliance Evaluation Inspection Report was issued
to Heater Utilities, Inc. on May 23, 2003.
PERMIT:
The current permit became effective on March 1, 2002 and expires on May 31, 2005.
The 0.035 MGD facility consists of an extended aeration package treatment plant with
influent lift stations, bar screen, equalization basin, aeration basin, a rectangular clarifier, tablet
chlorination, chlorine contact chamber, continuous recording flow measurement, tertiary sand
filters, mud well, clear well, aerobic digester, and post aeration.
RECORDS/REPORTS:
through January 2004. The reports appeared to be properly completed. The ©RC maintains
detailed logs and calibration records relative to the operation & maintenance and self -monitoring
of the facility.

Basin.

All of the existing components of the facility were in service and appeared to be
operating properly at the time of the inspection.
FLOW MEASUREMENT:
Flow measurement is accomplished using a V-Notch weir as the primary device and a
totalizer/continuous recording flow meter in accordance with NPDES permit requirements. J.
Thurman Home, PE, of Horizon Engineering and Consulting, Inc. last calibrated the flow meter
on July 16, 2003.
EFFLUENT/RECEIVING WATERS:
The effluent was clear and did not appear to have a detrimental effect on the receiving
stream at the downstream monitoring location at the time of the inspection.

LABORATORY:
Water Tech Labs, Inc. has been contracted to provide analytical support and is a certified
laboratory in the state of North Carolina. Water Tech Labs, Inc. was not evaluated during this
inspection.
SELF" -MONITORING PROD
Discharge Monitoring Reports (D 's) were reviewed for the period February;2003
through January 2004. The reports indicate that all parameters are being monitored at the
required frequencies and locations. Flow proportional composite samples are being collected.
Field instruments are calibrated before each use. All D 's were properly completed and no
permit violations were noted..
OPERATIONS & MAINTENANCE:
The facility and site appeared to be properly operated and maintained. The current
overall operating strategy of the ©RC appears acceptable for the size and type of the facility.
Staffing is sufficient for the facility and the ORC or backup is available to be contacted during
off hours should problems occur.
The Operator -in -Responsible Charge (ORC) visits the facility daily and has adequate
backup assistance when needed.
SLUDGE DISPOSAL
Sludge is removed from the digester and taken off site by pump and haul methods.
Sludge is hauled. by Liquid. Waste, Inc. and is disposed of at an approved POTW (C dispersal
site. Liquid Waste, Inc. was not evaluated under this inspection.
SEWER OVERFLOW:
Please be advised that pursuant to Part 11, Section E of your NPDES permit and North
Carolina Administrative Code (NCA ) 15A 21 .0506 (a)(2), any failure of a collection system,
pumping station or treatment facility resulting in a bypass without treatment of all or any portion
of the wastewater shall be reported to the appropriate regional office (Mooresville Regional
Office 704/663-1699) as soon as possible but no later than. 24 hours from the time the permittee
became aware of the bypass. For spills/bypasses which occur in Mecklenburg County, it is
requested that M WQP be notified at 704/336-5500. Spills occurring on weekends or holidays
can be reported by calling the North Carolina Division of Emergency Management at 919/733-
3300, 800/662-796, or 800/858-0368. A written report shall also be provided within five (5)
days of the time of the incident. The report; shall contain a description of the bypass, and its
cause; the period of the bypass, including exact dates and times, and if the bypass has not been

corrected, the anticipated time it is expected to continue; and steps taken (or planned) to reduce,
eliminate, and prevent recurrence of the similar events. Any spill that reaches surface waters
(i.e. any spill that reaches any water already present in a conveyance, stream, ditch, etc...} or any
spill greater than 1,000 gallons on the ground that does not reach surface waters must be
reported.

GENERAL. -
James Filson of the Mecklenburg County Water Quality Program (MCWQP) last
inspected the facility on April 11, 2002. A Compliance Evaluation Inspection Report was issued.
to Heater Utilities, Inc. on April 29, 2002.
PERMIT:
The current permit became effective on March 1, 2002 and expires on May 31, 2005.
The 0.035 MGD facility consists of an extended aeration package treatment plant with
fluent lift stations, bar screen, equalization basin, aeration basin, a rectangular clarifier, tablet
chlorination, chlorine contact chamber, continuous recording flow measurement, tertiary sand
filters, mud well, clear well, aerobic digester, and post aeration.
CCU PORTS:
Discharge Monitoring Reports (I MR's) were reviewed for the period.. March 2002
through February 2003. The reports appeared to be properly completed. The ORC maintains
detailed lags and calibration records relative to the operation & maintenance and self -monitoring
of the facility.
FACILITY SITE REVIEW:
e facility discharges to Irwin Creek, which is a Class C water in the Catawba ba River
Basin.
The ORC, Billy R_ Henson maintains a North Carolina Operators Certification GradeIV
(certificate number 7106), which is acceptable for the class of the facility.
All of the existing components of the facility were in service and appeared to be
operating :properly at the time of the inspection.
FLOW MEASUREMENT:

Flow measurement is accomplished using a'V-Notch weir as the primary device and
totalizer/continuous recording flow meter in accordance with NPDES perrait requirements. J.
Thurman Home, PE, of Horizon Engineering and Consulting, Inc. last calibrated the flaw meter
on August 24, 2001.
EFFLUENT/RECEIVING WATERS:
The effluent was clear and did not appear to have a detrimental effect on the receiving
stream at the downstream o o ` g location at the time of the inspection.

LABORATORY:
Water Tech Labs, Inc. has been contracted to provide analytical support and is a certified
laboratory in the state of North Carolina. Water Tech Labs, Inc. was not evaluated during this
inspection.
SELF -MONITORING PROGRAM:
Discharge Monitoring Reports (DMR's) were reviewed for the period March 2002
through February 2003. The reports indicate that all parameters are being monitored at the
required frequencies and locations. Flow proportional composite samples are being collected.
Field instruments are calibrated before each use. All DMR's were properly completed and no
permit violations were noted.
OPERATIONS & MAINTENANCE:
The facility and site appeared to be properly operated and maintained. The current
overall operating strategy of the ORC appears acceptable for the size and type of the facility.
Staffing is sufficient for the facility and the RC; or backup is available to be contacted during
off hours should problems occur.
The Operator -in -Responsible Charge (ORC) visits the facility daily and has adequate
backup assistance when needed.
SLUDGE DISPOSAL:
Sludge is removed from the digester and taken off site by pump and haul methods.
Sludge is hauled by Liquid Waste, Inc. and is disposed of at an approved POTW (CMU) disposal
site. Liquid Waste, Inc. was not evaluated under this inspection.
SE OVERFLOW:
Please be advised that pursuant to Part 11, Section E of your NPDES permit and North
Carolina Administrative Code (NCAC) 15A 2B .0506 (a)(2), any failure of a collection system,
pumping station or treatment facility resulting in a bypass without treatment of all or any portion
of the wastewater shall be reported to the appropriate regional office (Mooresville Regional
Office 704/663-1699) as soon as possible but no later than 24 hours from the time the permittee
became aware of the bypass. For spills/bypasses which occur in Mecklenburg County, it is
requested that MCWQP be notified at 704/336-5500. Spills occurring on weekends or holidays
can be reported by calling the North Carolina Division of Emergency Management at 919/733-
3300, 800/662-7956, or 800/858-0368. A written report shall also be provided within five (5)
days of the time of the incident. The report shall contain a description of the bypass, and its
cause; the period of the bypass, including exact dates and times, and if the bypass has not been

corrected, the anticipated time it is expected tocontinue; and steps taken (or planned) to reduce,
eliminate, and prevent recurrence of the similar events. Any spill that reaches surface waters
(i,e spill that reaches any water already present in a conveyance, stream,ditch, etc._.) or any
spill greater than 1,000 gallons on the ground that does not reach surface waters must be
reported.
An adequate shill response for those spills reaching surface waters should include an
evaluation downstream of the point at which the spill entered surface waters to determine if
fish kill occurred. The evaluation should also include the collection ofupstream dissolved
oxygen and ply measurements for background information d dissolved oxygen and 1
measurements at multiple points downstream of the entry paint to document any negative
pact. Failure to report the bypass of collection system, pumping station or treatment facility
subjects violators to penalties of up to $25,000.00 per Clay per violation.

The facility was last inspected by MCDEP on May 29, 2001. A Compliance Evaluation
Inspection Report/ Notice of Violation was issued to Mid South Water Systems, Inc. on June 18,
2001.
PERMIT:
The current permit, issued on January 28, 2002, properly describes the facility. 'fhe
current permit became effective on March 1, 2002 and expires on May 31, 2001 The facility
operated under a previously issued permit in the review period.
The 0.035 MGD facility consists of an extended aeration package treatment plant with
influent lift stations, bar screen, equalization basin, mud well, aeration basin, a rectangular
clarifier, tablet chlorination, chlorine contact chamber, continuous recording flow measurement,
tertiary sand filters, aerobic digester, and post aeration.
