This letter is in response to the Notice of Violation & Intent to Assess Civil Penalty dated August 29,
2018. We at Mariners Watch'HOA made several improvements to our wastewater treatment plant in
February 2018 that I have written about in a previous response. Our Homeowners Association spent
thousands of dollars on repairs and maintenance as well as numerous physical improvements to the site
in an effort to improve our wastewater treatment facility at that time.
I received communication from our plant operator, Metwater, on April 23, 2018, stating the Wastewater
Treatment Plant has been inconsistent as of late and was showing signs of trouble as before. When l
requested additional details, I was sent a screenshot of lab results that made no sense to me and did not
explain that we had exceeded any daily maximum allowance, Metwater requested we bring in Carolina
Lift Stations to diagnose the issue and provide assistance to Metter. After speaking with Metwater,
e agreed to this and Carolina Lift Stations came to our plant the following day on April 24, 2018:
l was advised by Metwater that Carolina Lift Stations replaced some fuses, ran the station manually, and
reset the station (presumably the timing) to where it should work properly. Carolina Lift Stations stated
that they repaired a wire on the transfer pump and cleaned the screen on the bubbler pump. They also
expressed concerns to Metwater that there might not be enough coming in to the plant to keep the
transfer pump going. To resolve this, Metwater operates the plant in manual mode a little every day.
We take any Notice of Violation seriously along with any concerns regarding the safety of wastewater
coming from our wastewater treatment plant. Since taking over as President of the Mariners thatch
H©A, I have been diligent in resolving any problems with our wastewater treatment plant in an
expeditious manner. Please contact me regarding any additional questions and we hope that you will
not assess any penalties as we immediately respond to any problems with our plant and strive to
improve the quality of our plant. Thank you for your understanding.

The U.S, Environmental Protection Agency (EPA) recently published the National Pollutant Discharge
Elimination System (NPDES) Electronic Reporting Rule. The rule requires NPDES regulated facilities to
report information electronically, instead of filing written paper reports. The rule clues not change what
information is required from facilities. It only changes the method by which information is provided (i.e.,
electronic rather than paper -based).
EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their
key milestones, are:
• Phase 1—Starting on December 21, 2016, regulated entities that are required to submit Discharge
Monitoring Reports (DRs) will begin submitting these reports electronically. If you are currently
reporting your D R data electronically using eDMR, then you simply need to continue reporting
in the same way as you are now. The`key change is that, starting on December 21, 2016,
electronic reporting of DMRs will be required, instead of voluntary.
• Phase 2—Starting on December 21, 2020, regulated entities that are required to submit certain
other NPDES reports will begin' submitting these reports electronically. Reports covered in the
second phase include Notices of Intent to discharge in compliance with an NPDES general permit,
Sewer Overflow/Bypass Event Reports, and a number of other NPDES program reports.
Incorporating Electronic Reporting Requirements n into NPDES Permits
The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic
reporting requirements into NPDES permits beginning December 21, 2015. Under the new rule, the
electronic reporting process supersedes the paper reporting process. According to our files, your NPDES
permit became effective after November 2013, and should contain the requirement to electronically'
report your Discharge Monitoring Reports using NC DWR's eDMR system.
In addition to requiring permitt es to report information electronically, the rule also requires permittees
to identify the initial recipient for the NPDES electronic reporting data [see 40 CER 122.41(I)(9) . initial

NC IWR has submitted a request to EPA to be the initial recipient for the following NPC.ES data

October 2015. This is in violation of fart 11, condition D(2) of the NPDES permit, as well as 15A NCt C
21 .506(a), which requires the submittal of Discharge Monitoring Reports no later than the last calendar
day following tlae relaot titre period. Failure to submit reports as required will subject the violator'to the
assessment of a civil penalty of up to $25,000 per violation.
To revert further action lease submit the reports within fifteen 15 days of receipt of this notice.
If this facility is inactive or not constructed, you may submit a written request to suspend
monitoring.The request should include a begin date and an end date for the period of monitoring.

Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and
specify that, if a state does not establish a system to receive such submittals, then permittees must submit DMRs
electronically to the Environmental Protection Agency (EPA).
NOTE: This special condition supplements or supersedes the following sections within Part 11 of this permit

Beeinnin2 no later than 270 days from the effective state of this emit, the permittee shall begin
reporting discharge monitoring data electronically using the NC i DWR's Electronic Discharge Monitoring Report
(eDMR) internet application.
Monitoring results obtained during the previous month(s) shall be summarized for each month and
submitted electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and
submit DMRs electronically using the internet. Until such time that the state's eDMR application is compliant
with EPA's Cross -Media Electronic Reporting Regulation (CRO E ), permittees will be required to submit
all discharge monitoring data to the state electronically using eDMR and will be required to complete the eDMR
submission by printing, signing, and submitting one signed original and a copy of the computer printed eDMR to
the following address.

If a per ittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being
physically located in an area where less than 10 percent of the households have broadband access, then a
temporary waiver from the NPDES electronic reporting requirements may be granted and discharge: monitoring
data may be submitted on paper DMR forms (MR 1, 1. 1, 2„ ) or alternative forms approved by the Director.
Duplicate signed copies shall be submitted to the mailing address above.
Requests for temporary waivers from the NDES electronic reporting requirements must be submitted in
writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required-
under this permit to begin using eDMR. Temporary waivers shall be valid for twelve (12) months and shall
thereupon expire. At such time, DMRs shall be submitted electronically to the Division unless the permitte re-
applies for and is granted a new temporary waiver by the Division.

Regardless of the submission method, the first DMR is due on the last day of the month following the

Inspection report for the inspection conducted on January 6, 2012 at the Mariners Watch
Subdivision WWTP/Permit No. 0068705.
1 RECORDS/REPORTS: Attached is a letter providing written verification that
the C).RC (James Allison) has been designated as a duly authorized representative
ofMariners Watch Homeowners Association for report submission.
1 FLOW MEASUREMENT: Attached is a letter explaining the flow
measurement method used for this WWTP, and a separate memorandum from the
7RC stating the results of his last annual flaw measurement and analysis. 'Please
note that this WWTP dries got operate with. a continuous flaw and is not equipped
with a flaw meter. This WWTP is a small, controlled batch system that
discharges for short durations several times a day. Our Permit requires an
"Instantaneous to w Measurement" which, by definition is a sample of the
measure of flow that is rgprgs to iv of the total discharge. The c RC employs a
"time -measured drawn down method" to calculate the flow in a given time period.
A complete copy of the Inspection Report has been forwarded to the ORC.

Can June 30, 2011, 1 conducted my annual measurement of the flow for the Mariners Watch
Wastewater Treatment Plant, The results of this measurement allow us to accurately estimate the
effluent flow from the treatment plant each day hosed on run -tunes of the discharge pumps.
The results were as follows:

69 gallons = 115 gallons per foot = 9.6gallons per inch

contact disinfection chamber, sodium sulfite dechlormation system, and an effluent pump station.
The certification classification for N C006 05 re pubes that the facility have an Operator in Responsible Charge
(C RC) with a Grade 2 Biological Water Pollution Control System (WW-2) certification: The facility is staffed
(ORC and back-up) with personnel that possess the appropriate operator certification.
MCWQP reviewed Discharge Monitoring Reports (DMRs) for the period Februarys 2010 through January 2011.
The CRC maintains detailed and accurate logs and calibration records relative to the operation, maintenance,
and self -monitoring of the facility.
FACILITY SITE REVIEW:
The facility is located in the Mariners Watch Subdivision adjacent to a residence at 1617 Mariners Watch
Court, The facility currently services five single-family residences. Established 1 hustings, a fence, a locked
pate, and a'daily inspection of the plant by Mr. Pahl Davis appear to provide adequate screening and security for
the facility:
EFFLUENT/RECEIVING WATERS:
This facility discharges via an`effluent pump station to Lake Wylie (Catawba River), which is classified as WS-
and B waters in time C tavvba River Basin. All components of the system appeared to be functioning property
at the time of the inspection.
'LOW MEASUREMENT:`
Effluent flow is :measured using a flow timer and known (measured) pump capacity. The reported effluent flow
remains well below the permitted discharge limit. The flow meter was last calibrated on June 11, 2010
SELF-MONITORING PROGRAM:
The facility's Discharge Monitoring Reports (DMRs) were reviewed for the time period February 2010 through
January 2011. The DMRs indicate that the facilitywas as in compliance with peirnit monitoring requirements and
discharge limits during; the review period.
P & A Testing & Training, Inc. is certified by the Division of Water {duality to perform field parameter
laboratory analyses (NC Laboratory Certification 5032) and the peirnittee contracts with K & W Laboratories
(NC Laboratory Certification ## 55 ) to performall other analyses specified in the permit and equipment
calibrations. K & W Laboratories was not evaluated under this inspection.

OPERATIONS & MAINTENANCE:
The facility appeared to be in good operating condition. However, a high level float switch in the influent
receiving chamber was not functioning when activated. Please investigate and repair the high level alarm in
the influent receiving ehamber. The relay box that routes the pump and float switches to the control box is
will be replaced within the next two weeks.
SLUDGE HANDLING/DISPOSAL.-
Sludge is pumped and hauled from the aeration and settling basins by L &- L Environmental approximately
every three months. Evaluation of L & L Environmental was not conducted during this inspection.

GENERAL:
Mecklenburg County Water Quality program (MCWQP) personnel last inspected the Mariners
Match Subdivision WWTP on November 30, 2007. The inspection report was issued on
December 19, 2007.

EFFLUENT/RECEIVING WATERS:
This facility discharges via an effluent pump station to Lake Wylie (Catawba River), which is
classified as WS-V and B waters in the Catawba River Basin. All components of the system
appeared to be functioning properly at the time of the inspection, The CRC reports no
malfunctions, spills, or bypasses during the period of review. No effluent was discharged during
the inspection but it is unlikely that impacts to the receiving water would be discernable because
the discharge point is in the main channel of the Catawba River (Lake Wylie).

Clarified waste observed in the effluent pump was somewhat cloud; in appearance. Tr
indicated that permitted levels of TSS accounted for the appearance (i.e. effluent still in
compliance)
FLOW MEASUREMENT:
Effluent flow is measured using a flaw timer and known(measured) pump capacity. Tl
reported effluent flaw remains well below the permitted discharge limit, however annuo
verification/calibration of pump capacity with additional calibrations following any rel
equipment changes/modifications should continue. The last verification/calibration wa
performed on .Tune 13, 2007.
SELF -MONITORING PROGRAM:
The facility's Discharge Monitoring Reports (DMRs) were reviewed for the, time period'
:November 2007 through October 2008. The I MICs indicate that the facility was in core
with permit monitoring requirements and'discharge limits during the review period, exc

which exceeded the permitted daily maximum limit of 400 CFU/100 mL. T

of $281.20, ($200.00 civil penalty + $81.20 enforcement costs) against the Mariners Watch
Homeowners Association.
This assessment is based upon the following facts: A review has been conducted of the
self -Monitoring data reported for August 2007. This review has shown the subject facility to be
in violation of the discharge limitations found in NPDES Permit No.`NCO068705 The
violations are summarized in Attachment A to this letter.
Based upon the above facts, I conclude as a matter of law that the Mariners Watch
Homeowners Association violated the terms, conditions, or requirements of NPDS Permit No.
NCO068705 and North Carolina General Statute (s.S.) 143-215. 1 (a)(6) in the manner and extent
shown in Attachment A A civil penalty may be assessed in accordance with the maximums
established by G.S. 1 -215. A(a)(2).
Based upon the above findings of fact and conclusions of law, and in accordance with
authority provided by the Secretary of the Department ment of Environment and Natural Resources

This letter transmits a Notice of Violation and assessment of civil penalty in the amount
of $181.20 ( 100.00 civil penalty + $81.20 enforcement costs) against the Mariners Watch
Homeowners Association.
This assessment is based upon the fallowing facts: A review has been conducted of the
self -monitoring data reported for July 2007. This review has shown the subject facility to be in
violation of the discharge limitations foundin NPDES Permit No. NC0068705. The violation is
summarized in Attachment A to this letter.
Based upon the above facts, I conclude as a matter of law that the Mariners Watch
Homeowners Association violated the terms, conditions, or requirements ofNPD S Permit No.
NC'0068705 and. North Carolina General Statute (G.S.) 143-215.1(a)(6) in the manner and extent
shown in Attachment A. A civil penalty may be assessed in accordance with the maximums
established by G.S. 143-215.6A(a)(2).
Based upon the above findings of fact and conclusions of law, and in accordance with
authority provided by the Secretary of the Department of Environment and Natural Resources

Pursuant to G.S. 143-215.6A(c), in determining the amount of the penalty I have taken
into account the Findings of Fact and Conclusions of Law and the factors set forth at G.S. 1431
282. 1 (b), which are:
(4) The cost of rectifying the damage;
(5) The amount of money saved by noncompliance;
(6) Whether the violations were committed willfully or intentionally;
(7) The prior record of the violator in complying or failing to comply with programs
over which the Envirom-nental Management Commission has regulatory authority;
and
(8) The cost to the State of the enforcement procedures.
Within thirty days of receipt of this notice, you must do one of the following:

Please be aware that a request for remission is limitedto consideration of the five
factors listed below as they may relate to the reasonableness of the amount of the

contained in the civil penalty assessment document, Because a remission request
forecloses the option of an administrative hearing, such a request must be
accompanied by a waiver of your right to an administrative hearing d a

d submit it to the Division of Water Quality at the address listed below. In
determining whether a remission request will be approved, the following factors
shall be considered.
(1) whether one or more of the civil penalty assessment factors in G.S. 143B-
282. 1 (b) were `wrongfully applied to the detriment of the petitioner;
(2) whether the violator promptly abated continuing environmental damage
resulting from the violation;
(3) whether the violation was inadvertent or a result of an accident;
( whether the violator had been assessed civil penalties for any previous
violations; or
( whether payment of the civil penalty will prevent payment for the
remaining necessary remedial actions.
Please note that all information presented in support of your request for remission
must be submitted in writing. The Director of the .Division of Water Quality will
review your evidence and inform you of his decision in the matter of your
remission, request. The response will provide details regarding case status,
directions for payment, and provision for ftirther appeal of the penalty to the
Enviromnental Management Cofission's Cormnittee on Civil Penalty
Remissions (Committee). Please be advised that the Committee cannot consider
information that was not part of the original remission request considered by the
Director. Therefore, it is very important that you prepare a complete and thorough
statement in support of your request for remission.

The daily maximum fecal coliform concentration in the effluent from the Mariners Watch
TP was 600 CFUf1 00 mL can July 17„ 2007, which exceeded the permit limit of 400
CFU1100 mL. No harm to the natural resources of the estate or to public health has been
documented by the violation:

GENERAL:
Mecklenburg County Water Quality Program (MCWQP) personnel last inspected the
Mariners Watch Subdivision WWTP on November 16,'2006. The inspection report was issued
on January , 2007.
PERMIT:
The current permit became effective on .August 1, 2005, and will expire on June 30, 201 O?
The permit appears adequate for the facility and the waste stream being treated. The facility is a
controlled batch, package -type wastewater treatment system that operates via a combined
diffused aeration <and settling basin with a chlorine contact disinfection chamber, sodium sulfite
dechlorination system, and an effluent pump station.
The certification classification for NCO068705 requires that the facility have an Operator
in Responsible Charge (CRC); with a Grade 2 Biological Water Pollution Control System (WW-
2) certification. The facility is staffed (CRC and back-up) with personnel that possess the
appropriate operator certification.
RECORDS/REPORTS:
MCWQP reviewed Discharge Monitoring Reports (I MRs) for the period November
2006 through October 2007. Records indicated that the facility satisfied monitoring requirements
during the period of review. Records appeared to be neat, organized, and thorough.
FACILITY SITEREVIEW:
The facility is located in the Mariners Watch Subdivision adjacent to a residence at 16317
Mariners match Court. The facility currently services five single-family residences. One of the
residences was vacant during the inspection. Established plantings, a fence, and a locked gate
appear to provide adequate screening and security for the facility. Audible/visible alarms
appeared to function properly at the time of the inspection.
EFFLUENT/RECEIVING WATERS:
This facility discharges via an effluent pump station, to Lake Wylie (Catawba River),
which is classified as WS-V and B waters in the Catawba River Basin. All componentsof the
system appeared to be functioning properly at the time of the inspection. The ORC reports not
malfunctions, spills, or bypasses during the period of review. No effluent was discharged during
the inspection but it is unlikely that impacts to the receiving water would be discernable; because
the discharge point is in the main channel of the Catawba River (Lake Wylie).
Clarified waste observed in the chlorine contact chamber (prior to discharge via the
effluent pump) was somewhat cloudy in appearance. The ORC indicated that permitted levels
of TSS accounted for the appearance (i.e. effluent still in compliance).

FLOW MEASUREMENT:
Effluent flow is measured using a flow timer and known (measured) pump capacity. The

A fast track application for Authorization to Construct dechlormation facilities was
received on December 19, 2005, by the Division`. Authorization is hereby granted for the
construction of ` modifications to the existing Mariners Watch 'H A, with discharge of treated'
wastewater into Lake Wylie in the Catawba River Basin.
This authorization results in no increase in design or permitted capacity and is awarded
for the construction of the following specific modifications:
Installation of a tablet dechlorination system pursuant to the fast track: application
received can December 19, 2005, and in conformity with the Minimum Design
Criteria for Dehlorination Facilities.
This Authorization to Construct is issued in accordance with Pert 111, Paragraph A of
NPDES Permit No. NCO068705 issued June 30, 2005, and shall be subject to revocation unless
the wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified in Permit No. NCO068705.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by this Division, such as the construction of a itional or replacement wastewater
treatment or disposal facilities.
The Mooresville Regional Office, telephone number (704) 6 3-16 9, shall be notified at

inspection can be made. Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.
Pursuant to 15A NCAC 2H .0 140, upon completion of construction and prior to operation of
these permitted facilities, the completed Engineering Certification form attached to this permit shall be
submitted to the address provided on the form,
Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at least
equivalent to or greater than the classification assigned to the wastewater treatment facilities by
the Certification Commission,
The Permittee must also employ a certified back-up operator of the appropriate type and
grade to comply with the conditions of T15A:8G.0202, The ORC of the facility must visit each
Class I facility at least weekly and each Class 11, 111 and IV facility at least daily, excluding
weekends and holidays, must properly manage the facility, must document daily operation and
maintenance of the facility, and must comply with all other conditions of T15A:8G.0202.
A copy of the approved plans and specifications shall be maintained on file by the
Permittee for the life of the facility.
During the construction of the proposed additions/modifications, the permittee shall
continue to properly maintain and operate the existing wastewater treatment facilities at all times,
and in such a manner, as necessary to comply with the effluent limits specified in the NPDES
Permit.
You are reminded that it is mandatory for the project to be constructed in accordance
with the North Carolina Sedimentation Pollution Control Act, and, when applicable, the North
Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractor's
responsibilities shall be in complying with these Acts.
Failure to abide by the requirements contained in this Authorization to Construct may
subject the Permittee to an enforcement action by the Division of Water Quality in accordance
with North Carolina General Statute 143-2 t5,6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from
complying with any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction.

( RC was in the hospital. flack -up operator called and said the plant level was too high. He
thought the pump for the clarifier was not working. I called Liquid Waste Inc. and had the
plant pumped out for repairs. The plant was pumped out before the back-up operator
could take the weekly samples.

Raised float switch in the aeration for a larger sludge volume and decreased the dissolved
oxygen 'content,
7,8,9 & 10. Failure to monitor weekly BOO Ammonia Nitrogen, Total Suspended Residue

ORC had planned on sampling Tuesday of that week. Aquatrol called late Wednesday afternoon
and said they would make needed repairs to the rift station Tuesday moming.Liquid Waste Inc:
pumped the plant out before the weekly samples could be collected.
In the future ,weekly samples will be collected on Monday or Tuesday when possible.

GENERAL:
The subject facility was last inspected by MCWQP on September 30, 2003.
Compliance Evaluation Inspection Report was issued on October 10, 2003x
PERMIT:
The current permit became effective on January 1, 2002 and will expire on June 30, 2005.
request for permit renewal is required to be sub 'tied 180 days prior to the permit expiration
date. The permit appears adequate for the facility and the waste stream being treated, except that
one minor or inaccuracy noted on the Supplement to Permit Cover Sheet. The Supplement
identifies the facility as a 0.00225 MGD treatment system, whereas table A. (LEffluent
Limitations d Monitoring Requirements -- Final, , specifies the Monthly Average effluent flow
limit to be 0.0025 MGD. This information should be amended in the permit renewal.
The facility is a controlled batch, package -type wastewater treatment system that operates
via a combined diffused aeration and settling basin with`a chlorine contact disinfection chamber
d an effluent pump station.
The Operator in Responsible Charge (ORC) is Mr. James D. Allison. Mr. Allison
maintains a North Carolina Operator's Certification Grade TV which is acceptable for this Class
1 facility.'Mr, Allison's Certification Number ber is RC1461.
RECORDS/REPORTS.-
MCWQP reviewed Discharge onito " g Reports (DM for the period September
2003 through September 2004. Records indicated that the facility satisfied monitoring
requirements during the period of review with some exceptions, as noted under the Self
Monitoring Program section heading of this report.
All records andogs are maintained in the custody of the OR. No records are stored` on
site, but were available upon request. Records appeared to be neat, organized and thorough,
FACILITY SITE
The facility is located in the Mariners Watch Subdivision adjacent to a residence at 16317
Mariners Watch Ct. The facility currently services five single-family residences. Established
plantings, a fence and locked gate appear to provide adequate screening and security for the
facility.
EFFLUENT/RECEIVING WATERS:
This facility discharges via an effluent pump station to Lake Wylie (Catawba River), which
is classified as WS- d B waters in the Catawba River Basin; All components of the system
appeared to be functioning properly at the time of the inspection. The ORC reports no
malftinctions, spills or bypasses during the period of review. No effluent was discharged during

EFFLUENTIRECEIVING WATERS (Cont.):
the inspection but it is unlikely that impacts to the receiving water would be discernable, in that
the discharge point is in the in channel of the Catawba River (Lake Wylie).
FLOW MEASUREMENT:
Effluent flow is measured using a flow timer and known (measured) ptunp capacity. The
capacity of the pump (flow) was last verified in January 2004. The reported effluent flow remains
well below the permitted discharge it; however, annual verification / calibration of pump
capacity with additional calibrations following any relevant equipment changes / modifications
should continue.
SELF -MONITORING PROGRAM. -
Discharge Monitoring Reports (DMRs) were reviewed for the period from September
2003 to September 2004. DMRs indicate that the facility was in compliance with monitoring
requirements and permit effluent limitations during this period, with the following exceptions:
1. One (1) Total Suspended Residue value in excess of the daily maximum permit
of limit was noted on December 30, 2003. This constitutes one (1) violation,
DWQ cited this violation on March 9,2004, as NOV-2004-LV-0133.
2. One (1) failure to monitor weekly BOD(5), as required by the subject permit, was noted
the week of January 4-10, 2004. This constitutes one (1) violation.
3. One (1) fitilure to monitor weekly Ammonia Nitrogen, as required by the subject
permit, was noted the week off a -10, 2004. This constitutes one (1) violation.
4. One (1) failure to monitor weekly Total Suspended Residue, as required by the subject
permit, was noted the week of January 4-10, 2004. This constitutes one (1) violation.
5. One (1) failure to monitor weekly Fecal Coliform, as required by the subject permit,
was noted the week of January 4-10, 2004. This constitutes one (1) violation.
6. One (1) Total Suspended Residue value in excess of the monthly average per
effluent limit was noted in February 2004. This constitutes one (1) violation. DWQ
cited this violation on June 29, 2004, as NOV-2004-LV-0303.
7. One (1) failure to monitor weekly BOD(5), as required by the subject permit, was noted
the week of May 2-8, 2004. This constitutes one (1) violation.

LABORATORY:
Prism Laboratory analyzes Fecal Coliform samples for this facility. Test America analyzes
effluent samples for all tither permitted parameters. No laboratory evaluations were conducted
during this inspection.
OPERATIONS & MAINTENANCE:
The facility appeared to be orderly. The CRC:` reported that numerous maintemice
activities had occurred during the period of review. Several pumps had been replaced during the
review period and the plant had been pumped out on these occasions. "' resulted in one of the
monitoring gaps, as noted under the Self Monitoring Program section heading of this report.
Clarified waste observed in the chlorine contact chamber (prior to discharge via the
effluent pump) appeared to be somewhat cloudy; almost milky in appearance. The ORC
indicated that this was not a unique observation and that permitted levels of TSS could -account
for the appearance (i.e. effluent still in compliance). Audible and visible alarms demonstrated`
during the 'inspection appeared to be functioning properly.
The O C also reported some ongoing operation / maintenance issues related to flow
volume and unidentified chemical disposal to the treatment plant, The ORC" reported several
observations of high water during routine site visits, and offered speculation that residents may
have occasionally dumped cleaning agents or bleach down that drain in quantities sufficient to
affect the treatment system. In response to the perceived problems, Mr. Pahl Davis, President of
the Mariner's Watch HOA (pe `ttee) drafted and issued a public education document to the
residents that identified the problems, suspected sources, and outlined general guidelines for
resolution, including: plumbing inspectin / verification, source reduction, and disposal for
cleaning agents and bleach, etc.

The subject facility was last inspected by MCW P on February 12 2003.> A. Compliance
Evaluation Inspection Deport was issued as a Notice of Violation (NOV) on February 27, 2003.
PERMIT:
The current permit became effective on January 1, 2002 and will remain effective until
June 30, 2005. The facility is;a 0.00225 MGD controlled batch,, package -type wastewater
treatment system that operates via a d` sd aeration and settling basin with a chlorine contact
disinfection chamber and an effluent lifiF station.
The Operator in Responsible Charge (ORC) is Mr. James 1 . Allison. Mr. Allison
maintains forth Carolina Operator's Certification Grade IV, which is acceptable for this Class
II facility. Mr. Allison's Certification Number is RC1461.
RECORDS/REPORTS:
MCWQP reviewed Discharge Monitoring Reports (DMRs) for the period October 2002
through .August 2003. 'Records indicated that the facility satisfied monitoring requirements during
the period ofreview, and no permit violations were reported.
All records and logs are maintained in the custody of the ORS. to records are stared on
site. Records appeared to be neat, well organized and were readily available upon request.
FACILITY SITE
The facility is located in the Mariners Watch Subdivision adjacent to a residence at 16317
Mariners Watch Ct. The facility currently services four single-family residences but one additional
residence is under construction.

This facility discharges via an effluent tiff station to Labe Wylie (Catawba' River)which is
classified as WS-V1 and B waters in the Catawba River Basm. All components of the system
appeared to be functioning properly at the time of the inspection. The ORC reports no
raalfintetions, spills or bypasses since the last inspection.
IJI N C GWATERS:
Outfali 001 discharges underwater into the main channel of Lake Wylie. which is classified
as WS-V and B watersin the Catawba River Basin. No effluent was discharged during the
inspection but it is unlikely that impacts to the receiving water would be discernable.

?LOW MEASUREMENT:
Discharge Monitoring Reports ()MRs) were reviewed for the period from October 2002
to August 2003. DMRs indicate that the facility was in compliance with nionitoning requirements
and permit effluent limitations during this period. No violations of the subject permit were
reported.
LABORATORY:

Some particulate matter, resembling grease balls was observed in the chlorine contact
chamber; however, treated effluent in the lift station appeared to be clear and low in odor.
Otherwise the facility appeared to be neat, orderly and well maintained. The overall operation and
maintenance strategy appears to be acceptable for the size and type of facility, with one exception.
No provision for supplementary power has been made. Neither the operator nor the HOA
maintains a portable generator for use at this facility during loss of power situations.
Established plantings, a fence and locked gate appear to provide adequate screening and
security for the facility. Audible and visible alarms were demonstrated during the inspection and
appeared to be functioning properly.

Derrick A. Harris of the Mecklenburg County Department of Environmental
Protection (MCDEP) last inspected the facility on December 5, 20CltJ. A Compliance Evaluation
Inspection/Notice of Deficiency report was issued on December 18, s2000.
PERMIT:
The current permit expired on August 31, 2001. A draft permit is scheduled to become
effective January 1, 2001 The pernutee has requested that the collection method for quarterly
Total Phosphorus and Total Nitrogen be changed from composite to grab.
The facility is a 0.0 2 MGD Sequential Batch Reactor wastewater treatment plant
consisting of aeration, clarification, and chlorination chambers., with an effluent pump station.
The Operator in Responsible Charge (ORC) maintains a North Carolina.. Operators
Certification Grade IV, which is acceptable for the class of the facility.
RECORDS/REPORTS:
Discharge Monitoring Reports (D:MRs) were reviewed for the period October 2000
through September 2001 and appeased to be properly completed. Records, reports, and logs are
clear and well maintained. October 2000 DMR indicates that effluent samples were collected in
accordance with the permit on the 261h, but Total Residual Chlorine (TRC) was not documented.
The ORC is going to submit an amended DMR to address this omission.
FACILITY SITE VIEW,
All of the existing components of the facility were in service and appeared to be
operating properly at the time of the inspection. The ORC reports that there have been no system
malfunctions that resulted in overflows or bypasses in the previous twelve months.
The facility discharges to Labe Wylie (Catawba River), which is a "Class WS-V and B"
water in the Catawba River Basin,
FLOW MEASUREMENT:
Flow measurement is accomplished using a flow timer, which is an acceptable method to meet
the weekly instantaneous flow measurement requirement. Although the permit only rewires'
weekly instantaneous flaw measurement, the ORC records flow on a continuous basis to assist
him in trouble shooting problems with the collection system. Because Flow limits are a monthly
average, there is no violation as long as the average is at or below the monthly average limit.
LABORATORY:
Analysis of effluent samples is performed by Test America, with the exception of Fecal
Coliform which is analyzed by Prism Laboratory, The laboratories were not evaluated under this
inspection,

SLUDGE DISPOSAL:
Sludge is iremoved from the aeration and clarification chambers and taken off site by
punip and haul methods even three months. Sludge is hauled by Liquid Waste, Inc. and is
disposed in the Charlotte -Mecklenburg Utilities System under an approved permit. Liquid
Waste, Inc`; was not evaluated under this inspection.
SEWER OVERFLOW:
Please be advised that pursuant to Part 11, Section E of your NPDES permit, it, d North
Carolina Administrative Code ( CAC) 15A 2 .0546 (a)(2), any failure of a collection system,
pumping station or treatment facility resulting in a bypass without treatment of all or any portion
of the wastewater shall be reported to the appropriate regional office (Mooresville Regional
Office 704-663-1699) as soon as possible but no later than 24hours from the time the permittee
became aware of the bypass. 'Spills occurring on weekends or holidays can be reported to the
Division's Emer,ency Response personnel at 0 /662-"7956, 00/ -036 or 919-733-3300. A
written report shall also be provided' within five (5) days of the time of the incident. The report
shall contain a description of the bypass, and its cause; the period of the bypass, including enact
dates and times, and if the bypass has not been corrected, the anticipated time it is expected to
continue; and steps taken (or planned) to reduce,` eliminate, and prevent recurrence of the similar
events, Any spin that reaches surface waters (i.e. any spill that reaches any water already present
in a conveyance, `stream, ditch, etc...) or any spill greater than 1,000 gallons on the ground that
does not reach surface waters must be reported,
An adequate spill response for those spills reaching surface waters should include an
evaluation downstream of the point at which the spill entered surface waters to determine if a
fish hill occurred. The evaluation should also include the collection of upstream dissolved
oxygen and pH measurements for background information and dissolved oxygen and pal
measurements at multiple points downstream of the entry point to document any negative
impact. failure to report the bypass of collection system, pumping station or treatment facility
subjects violators to penalties of up to $25,000.00 per day per violation..

The subject permit expires on August 31, 2001. North Carolina Administrative Code (15A NCAC 2H.0105(e)) requires
that an application for permit renewal be filed at least 180 days prior to expiration of the current permit. If you have already
mailed your renewal application, you may disregard this notice.
To satisfy this requirement, your renewal package must be sent to the Division postmarked no later than March 4, 2001
Failure to request renewal of the permit by this date may result in a civil assessment of at least $500.00. Larger penalties may be
assessed depending upon the delinquency of the request.
If any wastewater discharge will occur after August 31, 2001 (or if continuation of the permit is desired), the current
permit must be renewed. Discharge of wastewater without a valid permit would violate North Carolina General Statute 143-215.1
and could result in assessment of civil penalties of up to $25,000 per day.

Dear Mr.Davis:
This is in response to your letter dated January 8, 2001 and Mr. James Allison's letter
dated. January 4, 2001, both of which were 'submitted in response to a Compliance Evaluation
inspection Report dated. December 18, 2000. Both of the referenced letters discuss violations o
the monitoring requirements for Total Nitrogen (TN) and Total Phosphorus (TP). The permit
requires a 24-hourcompositesample; a single grab sample is being collected.
It is our understanding that all grab samples are already currently collected from the
effluent lift station. Mr. Allison's proposal to collect the quarterly samples from the
effluent lift station, using a 24-hourcomposite method, while resolving the violation, may not be
the best solution'. For clarification, we would like to be advised of the discharge cycle
characteristics of the lift station (i.e., activation method (float or timed), frequency, duration,
and
volume of discharge). Basically, since the other effluent parameters are monitored by a grab
method, and based on the discharge characteristics of the facility, the requirement to collect
1TP samples by a -hourcomposite method may not be justified.
Since the permit is scheduled to expire on August 31, 2001, a renewal application must,
by regulation, be submitted by no later than March 1, 2001. Concurrent with the submittal, it is
recommended that a request, along with justification, be made to modify the fTP sample type
to grab, Pending a decision, you should take action to comply with current permit requirements.
Additionally, the renewal application should clarify the treatment plants hydraulic capacity;
various documentation lists the capacity as either 0.00225 MGD or 0.002 MGD.

For your information, the existing wastewater treatment facility, which is a controlled
batch activated sludge package plant, should, by regulation, be classified a Grade 2 Biological
Water Pollution Control Treatment System, A letter dated December 5, 2000 erroneously
classified the facility as Grade 1. The Technical Assistance and Certification Unit has been
contacted concerning this error, which should result in a subsequent letter indicating the correct
classification. The permit's monitoring frequency requirements are consistent with that for a
Grade 11 facility. The facility"s Operator -in -Responsible Charge (ORC) should possess at least
Grade 11 certification of appropriate type and the Back-up ORC(s) should possess at least Grade I
certification of appropriate type. Mr. Allison's certification is more than adequate.

The'Self=Monitoring Program was rated as unsatisfactory due to the fact that quarterly le for

In response to your letter dated December 18, 2000 the quarterly self -monitoring samples for
Total Phosphorus and 'Total Nitrogen were taken as grab samples because this facility, on the average,
only discharges 2 batches per day (300 -- 500 Gal.. Effluent water leaves the facility and goes into a lift
station and is then: pumped to the receiving waters.
Starting January 1, 2001 all quarterly samples will be taken from the lift 'station using a 24-hour
composite sampler.
