Within this project, Magellan plans to add above ground approximately 1 of new " pipe from offloading area to tanks. Magellan is seeking permission to discharge hydrostatic test water to the outfall. The new piping is to be leak tested per ASMEB31.4 method. The water for the hydro - test would come from an outside hydrant and be approximately 1000 gallons. As this is new pipe, the testing water would not be in contact with any product. Construction on this project began in late November, 2016 and the testing is proposed in late December or January, 2017. The U.S. Environmental Protection Agency (EPA) recently published the National Pollutant Discharge Elimination System (NPDES) Electronic Reporting Rue. The rule requires NPDES regulated facilities to report information electronically, instead of filing written paper reports. The rule dues not change what information is required from facilities. It only changes the method by which information is provided (i.e., electronic rather than paper -based): EPA is phasing in the requirements of the rule over a -year period, The two phases of the rule, and their key milestones, are: • Phase 1—Starting can December 21, 201b, regulated entities that are rewired to submit Discharge Monitoring Reports (D Rs) will begin submitting these reports electronically. If you are currently reporting your DMR data electronically using eDMR; then you simply need to continue reporting in the same way as you are now. The; key change is that, starting on December 21, 2016, electronic reporting of DMRs will be required, instead of voluntary. • Phase 2 —Starting can December 21, 2020, regulated entities that are required to submit certain other NPDES reports will begin submitting these reports electronically. Reports covered in the second phase include Notices of Intent to discharge in compliance with an NPDES general permit„ Sewer Overflow/Bypass Event Reports, and a number of other NPDES program reports. Incorporating Electronic Reporting Requirements into NPDES Permits The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic reporting requirements into NPDES permits beginning December 21, 2015. Under the new rule, the electronic reporting process supersedes the paper reporting process. According to our files, your NPDES permit became effective after November 2013, and should contain the requirement to electronically report your Discharge Monitoring Reports using NC DWR's eDMR system. Because of this variability, an estimated average design -flow rate would be approximately 5 gallons per minute (gpni), which includes instantaneous batch discharges of approximately 20 gpm, and an estimated annual discharge of 1 million gallons per year. Technologically Feasible Alternatives Analysis: The following alternatives have been evaluated: • Connection to an existing wastewater treatment lant — A request to connect to the Charlotte -Mecklenburg publicly owned treatment works (POTW) was submitted on February; 11, 2014. The Charlotte -Mecklenburg PoTw is not currently accepting connections and the request was denied; therefore this alternative is infeasible and as a result, a Present Value Cost Analysis was not completed. Correspondence with the Charlotte -Mecklenburg POTW stating that they are not accepting connections from groundwater treatment systems is included as Attachment 1. • Land application — The hydraulic loading rate and the total area of land needed for land application were calculated. Based on the calculations approximately 950 square feet of land is needed for irrigation. The properties surrounding the Terminal are all developed as either industrial or residential properties. The amount of undeveloped land needed for irrigation is net available; therefore, land application is infeasible and as a result, a Present Value Cost Analysis was not completed. Lana application calculations are provided in Attachment 2. • Infiltration galleries infiltration galleries were discussed as a potential alternative with the NCIENR and would be an acceptable alternative. I still have the question of how you would connect to the sewer if it is permitted as a direct discharge?(see my comment below) ' Also if you carat tap into the sewer at this location the only other option is pump and haul which we've had to make more restrictive due to the illegal dumping. The SVE system uses blowers to extract sail vapor and some 'liquids from below the ground surface. The liquids (consisting of groundwater and soil vapor moisture condensate) will have dissolved petroleum compounds typically present in gasoline and diesel. The current � system consists of a high vacuum blower to remove vapor and liquid from extraction wells, a knockout drum to separate liquids from vapor, and an aboveground storage tank for temporary storage of the recovered groundwater. RECORDSIREPORTS: Discharge Monitoring Reports (DMRs) were reviewed for the period July 2010 through June 2011, These reports appeared to be properly completed. Facility personnel maintain clear and organized records and reports. Copies of effluent analytical results, discharge logs, and flow measurements are readily available at the site. FACILITY SITE REVIEW: The facility is engaged in gasoline, diesel, and ethanol fuel storage and distribution. Discharges from both oil/water separators flow into containment basins surrounding the aboveground storage tanks. Water is held in the containment basins until it is manually released. All of the major components of Outfall 006 treatment works were in service and appeared to be operating properly at the time of inspection. FLOW MEASUREMENT: Flow measurement for Outfall 006 is accomplished using a continuous/totalizing flow meter. The flow meter was calibrated in February 2011 LABORATORY: The permittee contracts with Pace Analytical Services, Inc. All of the majjor components of Outfall 006 treatment works were in service and appeared to be operating properly at the time of the inspection. FLOW MEASUREMENT: Flow measurement for Outfall 006 is accomplished using a continuous/totalizing flow meter. LABORATORY: Analysis of effluent samples from Outfall 006 is performed by Prism Laboratories (NC Laboratory Certification # 402). Prism Laboratories was not evaluated under this inspection. Flow, ( GD): The flow limit expressed in this permit is the 24 hours average flaw, averaged monthly. It is determined as the arithmetic mean of the total daily flows recorded during the calendar month. b. An "instantaneous flow m sur enf' is a measure of flaw taken at the time of sampling, when both the `sample and flow will be representative of the total discharge. c. A "continuous flow measurement" is a measure of discharge flow from the facility which occurs continually without interruption throughout the operating hours of the facility. Flow shall be monitored continually except for the infrequent tunes when there may be no flow or for frequent maintenance activities on the flow device. . "T s of Samoles a. Composite Sample: A composite sample shall consist of: (1) a series of grab samples collected at equal time intervals over a 24 hour period of discharge and combined proportional to the rate of flow measured at the time of individual sample collection, or (2) a series of grab samples of equal volume collected over a 24 hour period with the time intervals between samples determined by a preset number of gallons passing the sampling pointi, flow measurement between sample intervals shall be determined by use of a flow recorder and totalizer, and the present gallon interval between sample collection fixed at no greater than 1 /24 of the expected total daily flowat the treatment system, or (3)' a single, continuous sample collected over a 24 hour period proportional to the rate of flow. In accordance with (1) above, the time interval between influent grab samples shall be no greater than once per hour, and the time interval between effluent grab samples shall be no greater than once per hour except at wastewater treatment systems having a detention time of greater than 24 hours. In such cases, effluent grab samples may be collected at time intervals evenly spaced over the 24 hour period which are equal in number of hours to the detention time of the system in number of days. However, in no case may the time interval between effluent grab samples be greater than six (6) hours nor the number of samples less than four (4) during a 24 hour sampling period. b. Grab Sample: Grab samples are individual samples collected over a period of time not exceeding 15 minutes; the grab sample can be taken manually. Grab' samples must be representative of the discharge or the receiving waters. . Calculation of Means a Arithmetic Mean: The arithmetic mean of any set of values is the summation of the individual values divided by the number of individual values. b. Geometric Mean: The geometric mean of any set of values is the Nth root of the product of the individual values where N is equal to the number of individual values. Furthermore, the permittee is responsible for consequential damages, such as fish kills, even though the responsibility for effective compliance may be temporarily suspended. 4. Oil and Hazardous Substance _Liability Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from any responsibilities, liabilities, or penalties to which the permittee is or may be subject to under NCGS 143-215.75 et seq. or Section 311 of the Federal Act, 33 USG 1321. Re -moved Substances Solids, sludges, filter backwash, or other pollutants removed in the course of treatment or control of wastewaters shall be utilized /disposed of in accordance with NCGS 143-215.1 and in a manner such as to prevent any pollutant from such materials from entering waters of the State or navigable waters of the United States. The permittee shall comply with all existing federal regulations governing the disposal of sewage sludge. Bsm—rdL—Rey jkn-1-iQn- Except for records of monitoring information required by this permit related to the permittee's sewage sludge use and disposal activities, which shall be retained for a period of at least five years for longer as required by 40 CFR 503), the permittee shall retain records of all monitoring information, including all calibration and maintenance records and all original strip chart recordings for continuous monitoring instrumentation, copies of all reports required by this permit, for a period of at least 3 years from the date of the sample, measurement, report ot application. This period may be extended by request of the Director at any time. 7. Recording RCM&a For each measurement or sample taken pursuant to the requirements of this permit, the permittee shall record the following information: a. The date, exact place, and time of sampling or measurements; b. The individual(s) who performed the sampling or measurements; c. The date(s) analyses were performed; d. The individual(s) who performed the analyses; e. The analytical techniques or methods used; and f. The results of such analyses. 8. Have access to and copy, at reasonable times, any records that must be kept under the conditions of this permit, c. Inspect at reasonable times any facilities, equipment (including monitoring and control equipment), practices, or operations regulated or required under this permit; and d. Sample or monitor at reasonable times, for the purposes of assuring permit compliance or as otherwise authorized by the Clean Water Act, any substances or parameters at any location. Tw nt four I -lour R rtin a. The permittee shall report to the central office or the appropriate regional office any noncompliance'which may endanger health or the environment. Any information shall be provided orally within 24 hours from the time the permittee became aware of the circumstances. A written submission shall also be provided within 5 days of the time the permittee becomes aware of the circumstances. The written submission shall contain a description of the noncompliance, and its cause; the period of'noncompliance, including exact dates and times, and if the noncompliance has not been corrected, the anticipated time it is expected to continue, and steps taken or planned to reduce, eliminate,' ;and prevent reoccurrence of the noncompliance. b. The following shall be included as information which must be reported within 24 hours under this paragraph: (1) Any unanticipated bypass which exceeds any effluent limitation in the permit. (2) Any upset which exceeds any effluent limitation in the permit. (3) Violation of a maximum daily discharge limitation for any of the pollutants listed by the Director in the permit to be reported within 24 hours. c. The Director may waive the written report on a case -by -case basis for reports under paragraph b. above of this condition if the oral 'report has been received within 24 hours. 2. E. 6. of this permit. 8, Other Inf nation Where the permittee becomes'aware that it failed to submit any relevant facts in a permit application, or submitted incorrect information in a permit application or in any report to the Director, it shall promptly submit such facts or information. 9. Noncompliance Notification e permittee shall report by telephone to either the central office or the appropriate regional office of the Division as soon as possible, but in no case more than 24 hours or on the next working day fallowing the occurrence or first knowledge of the occurrence of any of the following a. Any'occurrence at the water pollution control facility which results in the discharge of significant amounts of wastes which are abnormal in quantity or characteristic,; such as the dumping of the contents of a sludge digester, the known passage of a slug of hazardous substance through the facility, or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. Although turbidity monitoring was eliminated, total suspended, solids (TSS) monitoring with a limit remains in the permit. It was the Division's contention that should monitoring data indicate TSS problems, the state has the option of enforcing the instrearn standard for turbidity. However, the SPA is still concerned with the removal of the turbidity monitoring requirement from several oil terminal discharge permits. The following paragraphs address that concern. During the research phase required for permit development, it was noted that the 14 permits in the Paw Creek area had vastly different requirements for solids measurements.' Permits contained any combination of total suspended solids (TSS), turbidity, and settleable solidsmonitoringand/or limits. In an effort to provide consistency, TSS, turbidity, d settleable solids results from six oil terminals in the Paw Creek area were examined from ,duly 194 through September 1995. Results showed. that TSS and turbidity exhibited similar trends. Both pollutants appeared to increase and decrease at the same time. I addition, for the period examined, there were no turbidity violations, although there were'a few TSS violations. These data resulted in the Division questioning whether monitoring y was necessary for both solids parameters. Was there an added benefit to requiring turbidity monitoring in addition to TSSmonitoring? The Division concluded that turbidity was correlated with TSS results, and thus, only TSS monitoring with a limit was required. In addition, North Carolina has a water quality standard for turbidity. Therefore, although turbidity monitoring is not required in the discharge permits, the State still has the authority to enforce the instre. turbidity standard. P.O. Scrivner February 22, 1999 Page 2 Based on concerns regardinganti-backsliding, the EPA requested the Division re- examine the basis for the elimination of turbidity monitoring for 12 of the 14 Paw Creek oil terminals that were required to monitor for turbidity prior to the most recent permit renewal. This second examination of the data showed that there were turbidity standard violations since the last analysis at several of the oil terminals. The Division will investigate the causes of these violations to determine what steps may be necessary to controlsolids levels at these sites. Therefore, the Division acknowledges that its second evaluation resulted in a different outcome from the initial investigation and agrees that turbidity monitoring should be added to the discharge permits for several of'the oil terminals. This letter serves as the official notice that quarterly turbidity monitoring will be required at the facility effective March 1 1999. If ; monitoring data show a reasonable potential to violate water duality standards, then limits will be imposed upon renewal.
