The U.S. Environmental Protection Agency (EPA) recently published the National Pollutant Discharge
Elimination System (NPDES) Electronic Reporting Rule. The rule requires NPDES regulated facilities to
report information electronically, instead of filing written paper reports. The rule does not change what
information is required from facilities. It only changes the method by which information is provided (i.e.,
electronic rather than paper -based).
EPA is phasing in the requirements of the rule over a 5-year period, The two phases of the rule, and their
key milestones, are:
• Phase 1—Starting on December 21, 2016, regulated entities that are required to submit Discharge
Monitoring Reports (DRs) will begin submitting these reports electronically. if you are currently
reporting your DMR data electronically using eDMR, then you simply need to continue reporting
in the same way as you are now. The key change is that, starting on December 21, 2016,
electronic reporting of DMRs will be required, instead of voluntary.
• Phase 2 —Starting on December 21, 2020, regulated entities that are required to submit certain
other NPDES reports will begin submitting these reports electronically. Reports covered in the
second phase include Notices of Intent to discharge in compliance with an NPDES general permit,
Sewer Overflow/Bypass Event Reports, and a number of other NPDES programreports.
Incorporating Electronic Reporting Requirements into NPDES Permits
The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic:
reporting requirements into NPDES permits beginning December 21, 2015. Under the new rule, the
electronic reporting process supersedes the paper reporting process. According to our files, your NPDES
permit became effective after November 2013, and should contain the requirement to electronically
report your Discharge Monitoring Reports using NC DWR`s eDMR system.
In addition to requiring permittees to report information electronically, the rule also requires permittees
to identify the initial recipient for the NPDES electronic reporting data [see 40 CFR 122.41(l)(9)). initial

recipient of electronic NPDES information from NPD S-regulated facilities (initiol recipient) means the
entity (EPA or the state authorized by EPA to implement the NPDES program) that is the designated entity
for receiving electronic NPDES Data (see 40 CFR 127.2(b)]. Permittees are required to electronically
submit the required NPDES information to the appropriate initial recipient, as determined by EPA. By July
18, 2016, EPA must identify and publish on its web site and in the Federal Register a listing of initial
recipients by state and by NPDES data; group. Once: available, you can use EPA's web site to find out or
determine the initial recipient of your electronic submission.
NC'DWR has submitted a request to EPA to be the initial recipient for the following NPDES data groups:
1. Discharge Monitoring Reports;
2. General Permit Reports [Notices of Intent to discharge (NOls); Notices of Termination (MOTs)],
. Pretreatment Program Reports, and
4. Sewer Overflow/Bypass Event Reports

FLOW MEASUREMENT:
Flow measurement for the stormwater discharge from the aboveground storage tank containment
basin is done by measuring the total amount of rainfall received prior to a discharge event and
multiplying by the total drainage area within the containment basin to obtain a discharge volume.
This is a permitted method for calculating flow.

GENERAL:
The facility was last inspected by Ms. Olivia Edwards of the Mecklenburg County Water
Quality Program (MCWQP) on July 26, 2007.
PERMIT:
The current permit became effective on December 1, 2005, and expires on December 30,
2010. The permit authorizes the discharge of stormwater and treated wastewater from Outfall
001. The permit properly describes the facility and appears adequate for the waste strearn being
treated.
The NPDES treatment works for Outfall 001 consist of a settling basin, two oil/water
separators, one 8,000-gallon polishing tank, a particulate filter, and three carbon filters to treat
water from the loading rack area.
The certification classification for NCO004723 requires that the facility have an operator
in responsible charge (ORC) with a Grade I Physical Chemical Water Pollution Control System
(PC-1) certification, The facility is staffed with personnel (ORC —Robert Gaston, PC-1/985403)
that possess the appropriate operator certification.
However, the Back-up ORC (Frank Gerraughty, PC-2/987825) listed for the Kinder
Morgan Charlotte Terminal #3 is invalid (as noted in the DWQ compliance database) because
he has not paid his certification renewal fee (Effective date — January 1, 2008). Please either
designate a valid Back-up ORC or take the necessary steps to validate Mr. Gerraughty's
certification.
RECORDS/REPORTS:
Discharge Monitoring Reports (DMRs) were reviewed for the period June 2007 through
May 2008. The Terminal Manager maintains clear and organized records and reports. Laboratory
analytical reports and operational logs were readily available at the site.
FACILITY SITE REVIEW:
The facility is engaged in diesel fuel and kerosene storage and distribution. The facility
has installed a new system for ethanol. The facility has plans to convert one tank to ethanol
where it will be received, but not shipped out. Discharges from Outfall 001 include stormwater
collected in the aboveground storage tank containment basin mid drainage from the truck loading
rack area.
Typically, storrnwater from the aboveground storage tank containment basin merges with
the treatment system effluent prior to Outfall 001, without going through the treatment works.
The stormwater from the containment basin can be manually diverted through the treatment
works if a sheen or pollutants are detected.

EFFLUENT/RECEIVING WATERS:
Effluent from the subject facility discharges to an unnamed tributary to Paw Creek, whit
is a Class C water in the Catawba River Basin. The facility was not discharging at the time of tf
inspection.
FLOW MEASUREMENT:
Flow measurement for the stormwater discharge from the aboveground storage tank
containment basin is done by measuring the total amount of rainfall received prior to a discharg(
discharge volume.
SELF -MONITORING PROGRAM:
DMRs and laboratory analytical reports were reviewed for the period June 2007 through
May 2008. Records indicate that the facility was in compliance with effluent limits and
monitoring frequency requirements during this period.
LABORATORY:
The permittee contracts with R & A Laboratories (NC Laboratory Certification #34) to
perform all chemical analyses specified in the permit. R & A Laboratories was not evaluated
during this inspection.
OPERATIONS & MAINTENANCE:
The facility and site appeared well operated and maintained. Stormwater in the
aboveground storage tank containment basin is visually inspected for the presence of a petroleum
sheen prior to discharge. The inspection is documented in a logbook noting the date, time,
inspector, and the results of the visual observations.
SLUGDE HANDLING/DISPOSAL
The carbon filtration units are replaced annually or as needed based on effluent analytical
results. The oil/water separator is pumped annually or as needed.

the flow meter should be located after all treatment processes are complete; however, it did not
appear that the current location of the flow meter would have an impact on the accuracy of the

Flow measurement for the stormwater discharge from the aboveground storage tank
containment basin is done by measuring the total'amount of rainfall received prior to a discharge
event and multiplying by the total drainage area within the containment basin to obtain a
discharge volume.
The flow values from the in -line flow meter and the containment basin discharge are
combined to determine the total discharge for Outfall 001.

Discharge Monitoring Reports (DMRs) were reviewed for the period April 2005 through
December 2005. The Terminal Manager maintains clear, organized records and reports.
Laboratory analytical reports and operational logs were readily available at the site.
FACILITY SITE REVIEW:
The facility is engaged in diesel fuel and kerosene storage and distribution. Discharges
from Outtall 001 include storm water collected in the above ground storage tank contaimnem
basin, and drainage from the truck loading rack area.
Typically, to water from the above ground storage tank containment basin merges
with the treatment system effluent prior to Out all 001, without going through the treatment
works. The stormwater from the containment basin can be manually diverted through the
treatment works if a sheen or pollutants are detected.
EFFLUENT/RECEIVING WATERS:
Effluent from the subject facility discharges to an unnamed tributary to Paw Creek, which
is a Class C water in the Catawba River Basin.
The facility was not discharging at the time of the inspection.
FLOW MEASUREMENT:
Flow measurement for the discharge from the treatment works is accomplished using a
DPI electronic digital in -line flow meter, which is located prior to the carbon filters. Technically,

the flow meter should be located after all treatment processes are complete; however, it did not
appear that the current location of the flow meter would have an impact on the accuracy of the
flow measurement.
Flow measurement for the stormwater discharge from the above ground storage tank
containment basin is being conducted by measuring the total amount of rainfall received prior to
a discharge event and multiplying by the total drainage area within the containment basin to
obtain a discharge volume.
The flow values from the in -line flow meter and the containment basin discharge are
combined to determine the total discharge for Outfall 001.
SELF -MONITORING PROGRAM:
DMRs and laboratory analytical reports were reviewed for the period April 2005 through
December 2005. The reports indicate that the facility was meeting permit effluent limits during
this period. Records indicate that all parameters are being monitored at the proper frequency and
location.
LABORATORY:
Pace Analytical Services (North Carolina Certification # 12) is under contract to perform
effluent analysis for the facility. Pace Analytical was not evaluated as part of this inspection,
OPERATIONS & MAINTENANCE:
The facility and site appeared well operated and maintained.
Storm water in the above ground storage tank containment basin is visually inspected for
the presence of a petroleum sheen prior to discharge. The visual inspection of the containment is
documented in a logbook with the date, time, inspector, and results of the visual inspection.
SLUGDE HANDLING/DISPOSAL
The carbon filtration its are replaced annually or as needed based on effluent analytical
results. The oil/water separator is pumped approximately four times per year or as needed.

This letter is submitted in accordance with your discussions with Mr. Robert Sullivan, Kinde
Morgan Southeast Terminals ( "1") during your telephone conversations with him of
September 28 h an October 2"`
KMST has contracted with Prism Laboratory of Charlotte NC to collect and analyse samples 1,07
each of the parameters` listed in the NPDFS permits for its three Charlotte; NC terminals. On Jul
25`h, 2006, technicians from Prism Laboratory collected samples from outfall 001 at th(
Charlotte Terminal ##3, Permit No.0004723. Unfortunately Prism later failed to perform th<
Total Suspended Solids (TS) and Turbidity tests on these samples, even though they w°er<
indicated on, the Chain of Custody. Local KMST management became aware of the mi sec
analysis on August 5t" and promptly requested that Prism Labs return immediately to collect an(
analyze TS and, Turbidity samples from Charlotte Terminal ##3. These results, though collectet
in August, confirmed KMST's belief that the .TSS and turbidity were compliant with permi
limits.
Since operational conditions at the terminal were normal and the results from the second test;
indicated that there had been no impact to public health or the euvironruent, the facility made ,
clerical error and inadvertently indicated that the July DMR report was "Compliant." Attached i
an amended July DM1.

This letter transmits your draft NPDES individual discharge permit for the above referenced facility. The Division of
Water Quality (the Division) has revised permitting strategies and Standard Operating Procedures (SOP) for this
and all bulk storage petroleum facilities and terminals in North Carolina.
Please review this draft carefully to ensure thorough understanding of the information, conditions, and
requirements contained therein. Pursuant to your December 10, 2004 permit renewal application, a Reasonable
Potential Analysis utilizing data from previous sampling events and the new NPDES 2005 Permitting, Strategy the
following changes have been made to this permit:
1. The limit for Oil and Grease has been removed from your permit.
2. Deletion of MTBE monitoring requirement.
3. Benzene, toluene, ethylbonzene and xylene (BTEX) are common toxicants found in fuel petroleum.
Previous scans for volatile and semi -volatile compounds included BTEX (methods EPA 6241625). A
review of these scans revealed BTEX frequently in stormwater, while other 6241625 parameters
were uncommon or never detected. Therefore, future permits shall require BTEX monitoring for
lighter fuels and naphthalene for diesel fuel
With this notification, the Division will solicit public comment on this draft permit by publishing a notice in
newspapers having general circulation in the Mecklenburg County area, per USEPA requirements. Please provide
your comments regarding this draft, if any, to DENR / DWQ / NPDES Unit no later than October 21, 2005.

April 28, 2004. A Compliance Evaluation Inspection report was issued on May 7, 2004.
PERMIT:
The current permit became effective on September 1, 2001 expires on June 30, 2005.
A permit renewal application is Ding processed. The permitauthorizes the discharge of
stormwater and treated wastewaterfrom. Outbill 001. The permit properly describes the facility
and appears adequate for the waste stream being treated.
The NPDES treatment works for Outfiffl 001 consist of a settling basin, two of
separators, one 8,000 gallon polishing ' one particulate, three carbon filters and one
polishing . filter to treat t loading rack area.
RECORDS/REPORTS:
Discharge Monitoring Reports (I were reviewed for the period April 2004 through
March 2005. The Terminal Manager maintains clear, organized` records d reports. Laboratory
analytical reports and operational lags were readily available at the site.
FACHM SITE
The facility is engaged in diesel fuel and kerosene storage and distribution. Discharges
from Outfill 001 include stormwater collected in the above ground'sto a tank containment
basin, and age from the truck loading rack arm
Typically, stonnwater from above ground storage tank comainment basin merges with
the treatment system effluent prior to OutfiA 001, without going throughthe treatnient works.
The storinwater from the containment basin can be manually diverted through the treatment
works if sheen or pollutants are detected.

FGENERAL:
Mecklenburg County Water Quality Program (MCWQP) last inTected the facility on May
7, 2003. A Compliance Evaluation Inspection report was issued on June 5, 2003.
PE
The current permit became effective on September 1, 001, and expires on June 30, 2005.
The permit authorizes the discharge of storruwater and treated wastewater from Outfall 00 1
The permit properly describes the facility and appears adequate for the waste stream being
treated.
The NPDES treatment works for Outfall 001 consist of a settling basin, two oil/water
separators, one 8,000 gallon polishing tank, one particulate filter, three carbon filters and-dite
polishing filter to treat water from the loading rack arm
RECORDS/REPORTS:
Discharge Monitoring Reports (DMRs) were reviewed for the period March 2003 through
February 2004. The Terminal Manager maintains clear, organized records and reports.
Laboratory analytical reports and operational logs were readily available at the site.
FACILITY SITE REVIEW:
The facility is engaged in diesel fuel and kerosene storage and distribution. Discharges
from Outfall 001 include storinwater collected in the above ground storage tank containment
basin, and drainage from the truck loading rack area -
Typically, stormwater from the above ground storage tank containment in merges with
the treatment system effluent prior to Outfill, 00 1, without going through the treatment works.
The storniwater from the containment basin can be manually diverted through the treatment
works if a sheen or pollutants are detected.
FLOW MEASUREMENT:
Flow measurement for the discharge from the treatment works is accomplished using a
DPI electronic digital in -line flow meter, which is located prior to the carbon filters.
Flow measurement for the stormwater discharge from the above ground storage tank
containmend: basin. is being conducted by measuring the total amount of rainM received prior to
a discharge event and multiplying by the total drainage area within the containment basin to obtain
a discharge volume.
The flow values from the in -line flow meter and the containment in discharge are
combined to determine the total flow discharge for Outfiffl 001.

LABORATORY:
Face Analytical Services (North Carolina Certification # 12)' is under contract to perform
effluent analysis for the facility. Pace Analytical was not evaluated as part ofthis inspection.
EFFLUENT/RECEIVING WA
Effluent from the subject facility discharges to an unnamed tributary to Paw Creek, which
is a Class C water in the Catawba River Basin.
The facility was not discharging at the time of the inspection.
SELF -MONITORING G PROGRAM:
DMRs and laboratory analytical reports were reviewed for the period March 2003 through
February 004. The reports indicate that the facility was meeting permit effluent limits during this
period. Records indicate that all parameters are being ;monitored at the proper frequency and
location.
OPERATIONS & MAINTENANCE:
The facility and site appeared well: operated and maintained.
Stormwater in the above ground storage tank containment basin is visually inspected for
the presence of petroleum sheens prior to discharge. The visual do of the containment is
documented in a logbook with the date, time, inspector, and results of the visual inspection. The
carbon filtration units are replaced `annually or as needed, on effluent analytical results. The
oil/water separator is pumped approximately four times per year or'as needed.
