The rule does not change what information is required from facilities. It only changes the method by which information is provided (i.e., electronic rather than paper -based). I i EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their key milestones, are: • Phase 1--Starting on December 21, 2016, regulated entities that are required to submit Discharge � Monitoring Reports (DMRs) will begin submitting these reports electronically, instead of on paper. if you are currently reporting your DMR data electronically using eDMR, then you simply need to continue reporting in the same way as you are now. Krebs, Regional Supervisor North Carolina Department of Environment and Natural Resources Division of Water Quality 610 East Center Avenue, Suite 301 Mooresville, NC 28115 Re: Noncompliance and Discharge Report for the Fire Foam Discharge on July 4, 2014 Kinder Morgan Southeast Terminals LLC Charlotte #2 Terminal (KMST CT#2) NPDES Permit No. NCO004839 Mecklenburg County, North Carolina Dear Mr. Krebs: Kinder Morgan Southeast Terminals LLC, (KMST) is submitting this Noncompliance and Discharge Report (NDR) as required in Section E.6 of our current National Pollutant Discharge Elimination System (NPDES) Permit No. NCO004839, for the discharge of Aqueous Fire Fighting Foam (AFFF) and water at our Charlotte #2 Terminal (KMST CT#2) on July 4, 2014� A Material Safety Data sheet is provided in Attachment A. This report provides the Division of Water Quality (DWQ) with a description of the noncompliance and summarizes remedial actions and steps taken or planned to reduce, eliminate and prevent a reoccurrence. KMST CT#2 is located at 6801 Freedom Drive in Charlotte, Mecklenburg County, North Carolina, A map depicting the location of the site is provided in Figure 1. Cause of the DischaMe On Friday, July 4, 2014 at approximately 10:40 pm, the Automatic Fire Detection and 1100 ALDERMAN Dmw, SUITE 200 ALPHARETTA, GEORGIA 30005 Robert B, Krebs Division of Water Quality Page 3 During the DO measurements, the stream was under base flow conditions with little flowing water in stream. The stretch of stream from KMST's outfall to the railroad culvert represents the headwaters of the tributary and supports minimal oxygen -creating plant life because it is narrow and runs through woods with mature trees and a high percent canopy cover. Corrective Actions KMST CT#2 is required by Charlotte Fire Department to have automatic fire detection and suppression systems. These systems include alcohol resistant AFFF (FPB 234 Storage and Blending of Ethanol -Blended Fuels, Charlotte Fire Department, Fire Prevention Bureau Standard Operating Guidelines). The fire system worked as designed. The electrical wiring for the Motor Operated Valve between the truck rack and the water treatment system was replaced, and the system was tested to confirm proper operation on 07/07/14. Conclusions Initial abatement measures were effective in recovering discharged AFFF. There were no apparent impacts to surface water quality and biota. No long term negative impacts are expected from the discharge. Based on historical surface water monitoring information provided by CH2M HILL, the DO measurements are consistent with historical DO measurements collected in the stream and are believed to be representative of background (i.e., pre-release) conditions. Krebs Division of Water Quality Page (Attachment A), the composition of the foam is 80- 3% water, 4-10% synthetic detergents, 2- 5% (2-Methoxymethylethoxy) propanol, 0.5-2% fluoroalkyl surfactants, and .5-2% polysaccharide. Assuming a composition of 2-5%, the volume of (-Metho ymethylethoxy) propanol that was discharged from the fire system was 11.4 to 285 gallons. However, as discussed below, sorbent booms were immediately deployed and the area was flushed with water and greater than 8,000 gallons of water AR-AFFF were recovered using vacuumtrucks. Thus, the volume of A F discharged into the facility's storm water system and through the outf ll was likely 10% of the volume of AR-AFFF released, or approximately 1 to 3 gallons. There was no visible foam observed in the tributary. Notifications Cliff McCowan with KMST contacted the North Carolina Department of Environment and Natural Resources (NCDENR) 24 hour Emergency Management Line at approximately :00 a on November 23, 2013. Mr. McCowan spoke with Robin Dale and reported the discharge in accordance with Part 11, Section E.6 of current NPDES Permit. The report number is N 11.2313t58, Mr, McCowan also made a courtesy call to Steven Ball, the Duty Officer of the United States Environmental Protection Agency, Region I. Mr. Boling stated that he has fine with the report and asked to be copied on the written report. Initial Abatement Measures Abatement activities were performed by Ed Wallace Construction (Ed Wallace), FCC Environmental, STAT, Inc and CH2M HILL on November 23 2013 These activities consisted of the following: • Deploying sorent booms at storm water inlets along the storm water containment system and at the weir located near the property boundary and NPDES Outfall 001; and * Removing AR-AFFF from affected surface areas and then flushing the areas with water. The AR-AFFF/water :mixture was then recovered by vacuum tanker. This operation continued until the water was unable to produce foam. Approximately 8,663 gallons of AR-AFFF/water mixture were recovered and sent to FCC in Charlotte for treatment and disposal (see Attachment B). Photographs of initial abatement activities are included in Appendix C. Surface Water Monitorin The surface water quality was monitored by CH2M HILL on November 23, 2013. Monitoring was established along the unnamed tributary (stream) of Long Creek (Figure 1). There were no indications of Ali-AFFF or dead or distressed aquatic life. Because AR-AFFF Foam is 100 percent Robert B. Krebs Division of Water Quality Page 3 soluble in water and on the technical information provided in the MSD , dissolved oxygen (DO) was measured at three sampling locations identified in Figure 1. Photographs are included as Attachment C. Instantaneous DO measurements were collected using an C xyGuard DO meter from the stream at three locations (immediately down gradient of KMST's otfall, immediately upgradent of the culvert associated with the railroad spur located between Motiv 's and KMST"s property, and downstream of Plantation Pipe Line's right of way (R/W). The monitoring locations are shown on Figure 1. A DO concentration of 6.0 milligrams per liter (mg/L), above the North Carolina Surface Water Quality Standard (NCSWQS) for Class C waters of 5.0 mg/L, was observed immediately down gradient of the facility's NPDES oufall. DO concentrations measured in the strum near culvert and at Plantation's /W were 2.3 and e9 mg/L respectively. During the DO measurements, the stream was Lander base flow conditions with little flowing water in stream. The stretch of stream from KM T's outfall to the railroad culvert supports minimal oxygen -creating plant life because it is marrow and runs through woods with mature trees and a high percent canopy cover. Corrective Actions KMST CT#2 is required by Charlotte Fire Department to have automatic fire detection and suppression systems. These systems include alcohol resistant AR-AFF (FPB 234 Storage and Blending of Ethanol -Blended Fuels, Charlotte Fire Department, Fire Prevention Bureau Standard Operating Guidelines). The fire system worked as designed. The storm water valve was repaired following the AR-AFFF release that occurred in 2010. The storm water valve functioned properly and closed immediately following the activation of the ESDm Robert B. Krebs Division of Water Quality Page 4 Conclusions Initial abatement measures were effective in recovering discharged AR-AFFF. There were no apparent impacts to surface water quality and biota. Stormater from the bulk storage containment area is visually inspected and released fallowing significant precipitation events, The effluent from Outfall 001 consists of water leaving the treatment works and inspected stormwater that bypasses the treatment works.The water is combined before reaching Outfall 001, Treated stormwater directed to Outfall 01 and untreated stormwater from the containment areas enter a 4 000-gallon equalization tank that is equipped with a hydrocarbon sensor. Mr. Krebs": Kinder Morgan Southeast Terminals LLC, (KMST) is submitting this Noncompliance and Discharge Report (NDR) as required in Section D.6 of our current National Pollutant Discharge Elimination System (NPDES) Permit No. NCO004839, for the discharge of Aqueous Fire Fighting Foam (AFFF) and water at our Charlotte #2 Terminal (KMST CT#2). A Material Safety Data sheet is provided in Attachment "A. "This report provides the Division of Water Quality (DWQ) with a description of the noncompliance and summarizes remedial actions and steps taken or planned to reduce, eliminate and prevent a reoccurrence. KMST CT#2 is located at 6801 Freedom Drive in Charlotte, Mecklenburg County, North Carolina. A map depicting the location of the site is provided in Figure 1. Cause of the Discharge On Saturday October 2, 2010 at 6:33 AM the Automatic Fire Detection and Suppression System (Fire System) at the loading rack alarmed and discharged a 3% AFF foam/ water deluge. This occurred when a detector picked up an invisible flame from a truck's exhaust. The AFFF was physically removed from affected surface areas and then flushed with water. The loading rack containment system was also flushed with fresh water. AFFF water mixture was then recovered at the weir by vacuum tanker. This operation continued until the water was unable to produce foam. Approximately 18,000 gallons of AFFF/ water mixture were recovered and sent to FCC in Charlotte for treatment and disposal (see Attachment C). In Zones, 2, 3 and 4 AFFF on the water surface of the stream was physically moved on the bank and allowed to degrade by exposure to the weather. This process was accomplished by crews using blowers. This activity was repeated several times as changes in stream flow caused new pockets of AFFF foam to be produced on the water surface. This operation continued until Wednesday, October 6, 2010 when there were no discernable, pockets of AFFF observed. Surface Water Monitorin The surface water quality was monitored by CH2M HILL from October 2, 2010 to October 8, 2010, Monitoring was established along the unnamed tributary (stream) of Long Creek (Figure 1). Because AFFF Foam is 100 percent soluble in water and on the technical information provided in the IVISDS, dissolved oxygen (DO) was measured at six sampling locations identified in Figure 1. The results of the DO monitoring can be found on Table 1 and a discussion is provided below. From October 2, 2010 to October 8, 2010, instantaneous DO measurements were collected from the stream at monitoring locations SW-1, SW-2, and SW-3 (Figure 2) with an OxyGuard DO meter. Monitoring locations SW-5 and SW-6 were added on October 4, 2010 and October 5, 2010, respectively. DO concentrations above the North Carolina Surface Water Quality Standard (NCSWQS) for Class C waters of 4.0 mg/L were observed at locations SW-1, SW-3, SW- 5, and SW-6 throughout this period (Table 1). DO concentrations at monitoring location SW-2 were initially observed above 4.0 mg/L); however, these concentrations decreased below 4.0 mg/L from October 6, 2010 to October 8, 2010 (1.8 mg/L, 0.4 mg/L, and 0.5 mg/L, respectively). DO concentrations nearby on October 7, KMST CT#2 is required by Charlotte Fire Department to have automatic fire detection and suppression systems. These systems include alcohol resistant AFFF (FPB 234 Storage and Blending of Ethanol -Blended Fuels, Charlotte Fire Department, Fire Prevention Bureau Standard Operating Guidelines). The fire system worked as designed and as a result the 3% foam solution entered the terminal's storm water system. The oil water separator is not designed to contain AFFF. Kinder Morgan is investigating the network of storm water piping, drains and associated valving to better contain any future 3% AFFF water solution discharges and thus to mitigate future off - site discharges. obert B. Krebs Division of Water Quality Page 4 Conclusions Initial abatement measures were effective in recovering discharged AFFF and limiting impacts to surface water quality. The impacts to surface water quality and biota appear to have been minimal based on DO oxygen readings in the stream and the limited amount of biota collected and observed. No long term negative impacts are expected from the discharge. Kinder Morgan is investigating the network of storm water piping, drains and associated valuing to better contain any future release of 3% AFFF water solution. To address the subject deficiency, please note that the facility has instituted the following actions: Facility personnel have created a laminated spreadsheet that lists the samples required under the facility's NPDES permit, containing the corresponding analytical methods and codes. The spreadsheet will be referenced each time a request is submitted to the facility's contract laboratory to pull and analyze the required samples. The spreadsheet will also be used to verify that the laboratory technician is collecting the correct samples when he or she arrives on site.
