(Aqua) offers the following response to the above -referenced Compliance Evaluation Inspection Notice of Deficiency which was issued for the inspection conducted on July 26, 2016. Per CEI. Actua should respond to; Paragraph 2: This report is being issued as a Notice of Deficiency (NOD) due to the failures to provide both proper operation and maintenance and ORC/Backup ORC visitations, as discussed further in the Record Keeping/Summary, plow Measurement, and Standby Power Sections of the attached report. Paragraph 3: In order for the facility to return to compliance, the perinittee must install an operational backup power system and new V-notch weir by August 26, 2016. The rule requires NPDES regulated facilities to report information electronically, instead of filing written paper reports. The rule does not change what information is required from facilities. It only changes the method by which information is provided (i.e., electronic rather than paper -based). EPA is phasing in the requirements of the rule over a -year period. The two phases of the rule, and their key milestones, are: • Phase 1--Starting on December 21, 2016, regulatedentities that are required to submit Discharge Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently reporting your DMR data electronically using eDMR, then you simply need to continue reporting in the same way as you are now. The key change is that, starting on December 21, 2016, electronic reporting of DMRs will be required, instead of voluntary. Phase 2 —Starting on December 21.,.2 20, regulated entities that are required to submit certain other NPDES reports will begin submitting these reports electronically. Reports covered in the second phase include Notices of Intent to discharge in compliance with an NPDES general permit, Seer Overflow/Bypass Event Reports, and a number of other NPDES program reports. Incorporating Electronic deporting Requirements into NPDES Permits The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic reporting requirements into NPDES permits beginning December 21, 2015. Cinder the new rule, the electronic reporting process supersedes the paper reporting process. According to our files, your NPDES permit became effective after November 2013, and should contain the requirement to electronically report your Discharge Monitoring Reports using NC WR's eDMR system. Spills occurring on weekends or holidays can be reported by calling the North Carolina Division of Emergency Management at 800/662- 7956, 800/858-0368, or 919/733-3300. A written report shall also be provided within five (5) days of the time of the incident. The report shall contain a description of the bypass, and its cause; the period of the bypass, including exact dates and times, and if the bypass has not been corrected, the anticipated time it is expected to continue; and steps taken (or planned) to reduce, eliminate, and prevent recurrence of the similar events. Any spill that reaches surface waters (i.e. any spill that reaches any water already present in a conveyance, stream, ditch, etc.) or any spill greater than 1,000 gallons on the ground that does not reach surface waters must be reported. An adequate spill response for those spills reaching surface waters should include an evaluation downstream of the point at which the spill entered surface waters to determine if a fish kill occurred. The evaluation should also include the collection of upstream dissolved oxygen and pH measurements for background information and dissolved oxygen and pH measurements at multiple points downstream of the entry point to document any negative impact. At the time o th the all , the permit was issued, Mid South (which did ot build plant) believed that the plant (a Cbromaglass system) was inadequate and expressed its concerns to DEHNR (the Predecessor agency to DENR). Ile inherent design f0ures of Chromaglass systems are apparent throughout No Carolina. Despite Mid South's expressed reservations about the adequacies, of the plant, X)EHNR approved the system plans and issued the NPDF-S Permit. All of the significant violations of the Permit that have occurred since 1991 relate back to the original, substandard plant that was approved by DEHNR, with actual or ilmplicd knowledge of the treatment plant's design and operating deficiencios. When it became apparent that the system, as designed and installed, could not properly operate with the Performance standards contained in the Permit, Mid South requested variances, through the process of s, Special Order by Consent ("SOC") of certain of the Permit requirements. The terms and conditions of the SOC requested by Mid South were strongly opposed by the regulators and could not be negotiated. The terms requested were not significantly different froin those normally granted by the Division to other Permitees, with much larger Eiow limitations, therefore havinga much greater impact on the receiving stream. From 1991-1996, Mid South tried a variety of different operators and different operating techniques to try to get the plant to operate with the pennit limits, including preparation of reports; Only one operator was successfully able to do i . That operator resigned and the plan regressed to its historic and original) oPeratmg Problem- January and February of 1997 fey ed a. number of heavy rainstd which s s the pl" t heyvnd its capacity. Mid South is penalized for a daily and a monthly violation of the same standard, during the same month. Months after the operating probleins, were resolved, at great cost to Mid South, by the installation of a new treatment plant, ]Dr- R responds with almost $lo,000 of civil penalties for problems that have now been fixed. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 2. The facilities must be properly maintained and operated at all times. 3. This perit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality (Division) accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 4. A copy of the Record Drawings shall be maintained on file by the Permittee for a minimum of five years from the date of the completion of construction. 5. Failure to abide by the conditions and limitations contained in this general sewer permit or the North Carolina Gravity Sewer Design Criteria may subject the Permittee to an enforcement action by the Division, in accordance with North Carolina General Statute 143-215,6A to 143-215.6C. 6. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater collection facilities. 7. Noncompliance Notification: The Permittee shall report by telephone to the Mooresville Regional Office, telephone number (704) 663-1699, as soon as possible, but in no case more than 24 hours or on the next working day, following the occurrence or first knowledge of the occurrence of either of the following: a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater transport, such as mechanical or electrical failures of pumps, line blockage or breakage, etc.; or b. Any failure of a sewer line resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. 1 Persons reporting such occurrences by telephone shall also file a written report in letter form within five ( days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur.
