Operations and Maintenance
A significant hole in the metal structure was observed in one of the aeration basins. In addition,
the internal metal structure (including the metal piping system) throughout both aeration basins
appeared significantly corroded and deteriorated.

Aqua has installed a baffle at this facility which will allow one-half of the aeration basin to be
emptied at a time, and for the basin to be professionally coated after appropriate surface preparation.
This is a major project and has been included in our capital improvement plan to be completed in
the next two years.

Enclosed is a copy of the Compliance Evaluation Inspection Report for the inspection conducted at the subject facility on
September 25, 2419, by Mr. Wes Bell of this Office. Please inform the facility's Operator -in -Responsible Charge (C>RC) of
our findings by forwarding a copy of the enclosed report,
This report is being issued as a Notice of Violation (NOV) due to the failure to properly maintain the internal metal
structure of the wastewater treatment facility (aeration basin, piping, systems, etc.) which is a violation of the subject NPDES
Permit and North Carolina General Statute (G.S.) 1 - 15 as detailed in the Operation & Maintenance/Summary Section
of the attached report.
Pursuant to G.S. 143-215.6A a civil penalty] of not more than twenty-five thousand dollars ($2 ,000.00) per
violation, per day may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or
requirements of any permit issued pursuant to G.S. 14 -215.1 Penalties may also be assessed for any damage to'surface
waters of the State that may result from the violations.
It is requested that a written response be submitted to this Office by November 8 2019, detailing the actions taken to
address this violation, The response shall include an evaluation of the structural integrity of the metal structure (including
aeration basins, chlorine contact chamber, piping system., etc.) by a structural engineer professionally certified in N.C. I

Aqua North Carolina, Inc. (Aqua) offers the following response to the above -referenced Compliance
Evaluation Inspection Notice of Deficiency which was issued for the inspection conducted on July 26,
2016.
Per CEI. Actua should respond to;
Paragraph 2: This report is being issued as a Notice of Deficiency (NOD) due to the failures to
provide both proper operation and maintenance and ORC/Backup ORC visitations, as discussed
further in the Record Keeping/Summary, plow Measurement, and Standby Power Sections of the
attached report.
Paragraph 3: In order for the facility to return to compliance, the perinittee must install an
operational backup power system and new V-notch weir by August 26, 2016. This Office shall
be notified within twenty-four (4) hours following completion of these activities. 1 high
priority shall be placed on the installation of an operational backup power system due to the
potential discharge of untreated and/or partially treated wastewater into the highly recreational
receiving stream (Lake Wylie) that is approximately 150 feet down gradient to this treatment
facility.
Paragraph 4. The response should also include when the new motor was installed for inoperable
blower/motor unit.

Aqua had submitted the proper forms to reflect the change in ORC and backup ORC
which were discovered to have not been updated at the time of the inspection.
Conversations between Regional Supervisor Matt Costner and Mr. Wes Bell have
verified that the designations are now updated. The permit for the Harbor Estates WWTP
s identified in I SA NCAC 0214.014 requires dual or standby power supply on site.

the event of _ a power failure. Aqua has wired the generator into a quick
disconnect/control panel as an additional safety measures The -notch weir will be
replaced on September 8, 2016. Since this work: required Aqua to utilize a fabrication
contractor, Mr. Bell's previous deadline could not be :met. The tinieframe was discussed
with Mr. Bell previous to the filing of Aqua's response. The motor for the blower/motor
unit was replaced on .August 1, 206E

The U.S. Environmental Protection Agency (EPA) recently published the National Pollutant Discharge
Elimination System (NPDES) Electronic Reporting Rule. The rule requires NPDES regulated facilities to
report information electronically, instead of filing written paper reports. The rule does not change what
information is required from facilities. It only changes the method by which information is provided (i.e.,
electronic rather than paper -based).
EPA is phasing in the requirements of the rule over a -year period. The two phases of the rule, and their
key milestones, are:
• Phase 1--Starting on December 21, 2016, regulatedentities that are required to submit Discharge
Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently
reporting your DMR data electronically using eDMR, then you simply need to continue reporting
in the same way as you are now. The key change is that, starting on December 21, 2016,
electronic reporting of DMRs will be required, instead of voluntary.
Phase 2 —Starting on December 21.,.2 20, regulated entities that are required to submit certain
other NPDES reports will begin submitting these reports electronically. Reports covered in the
second phase include Notices of Intent to discharge in compliance with an NPDES general permit,
Seer Overflow/Bypass Event Reports, and a number of other NPDES program reports.
Incorporating Electronic deporting Requirements into NPDES Permits
The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic
reporting requirements into NPDES permits beginning December 21, 2015. Cinder the new rule, the
electronic reporting process supersedes the paper reporting process. According to our files, your NPDES
permit became effective after November 2013, and should contain the requirement to electronically
report your Discharge Monitoring Reports using NC WR's eDMR system.
In addition to requiring permittees to report information electronically, the rule also requires permittees
to identify the initial recipient for the NPDES electronic reporting data [see 40 CR 122.41(I)()]. Initial

determine the initial recipient of your electronic submission,
NC DWR has submitted a request to EPA to be the initial recipient for the following NPDES data grOL

In response to your request to renew the subject NPDS permit, the Division of Water Resources (DWR or
the Division) hereby transmits this draft for your review and comment. Please review this document to
assure your understanding; of the permit limits and monitoring conditions, and to correct errors, if any.
We have made the following updates to your previous permit:
• added updates to facility map and parameter cedes
• once per permit cycle mercury monitoring is included to provide a database for future mercury
management; as required for all minor municipal wastewatertreatment plants per Implementation of
the 2012 Statewide Mercury T DL.
Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMs) and
specify that, if a state does not establish a system to receive such submittals; then Permittes must submit;
DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates that these
regulations will be adopted and is beginning implementation.
The requirement to begin reporting discharge monitoring data electronically using the NC D 's Electronic
Discharge Monitoring Report (eDMR) Internet application has been added to your NPDES, permit. [See

broadband access, then a temporary waiver from. the NPDES electronic reporting requirements may

GENERAL:
:
Mr. Christopher Elmore of the Mecklenburg County Water Quality Program (MCWQP)
last inspected the facility on March 20, 2008. A Compliance Evaluation Inspection Report was
issued on April 8, 2008
PERMIT:
The facility permit became effective July 1, 200. The permit properly describes the
facility and appears adequate for the wastewater being treated. The current permit expires on
June' 0, 2010. The facility consists of 0.0416 MGD extended aeration package wastewater
treatment plant with an equalization basin, flow splitter, dual aeration basins, clarifier, chlorine
contact basinwithtablet chlorination, tablet dechiorination chamber with aeration, sludge
holding tank, and effluent pump station.
The certification classification for NCO063860 requires that the facility have an Operator
in Responsible Charge (ORC) with a Grade 2 Biological Water Pollution Control System (WW-
2) certification. The Division of Water Quality Compliance Database at the time of the
inspection showed Mr. Billy Henson as the ORC; and noted there was nine qualified Back-up
CRCs. However, the September, October, and November 2008 Discharge Monitoring Reports
note that Mr. Carl Donahue is the ORC" at the facility. The permittee has submitted new
ORC designation form and as of April 14, 2009, Mr. Donahue is the Operator i
Responsible Charge at the facility.
C O SIRE PORT :
Discharge Monitoring Reports (DMRs) were reviewed for the period January 2008
through December 2008' and appeared to be properly completed. Records, reports, and logs are
clear and well maintained.
NCILITY SITE REVIEW:
All of the existing components of the facility were in service and appeared to be
operating properly at the time of the inspection. The ORC reports that there have been no system
malfunctions that resulted in overflows or bypasses.
FLOW 1V ES1i1 Ei`VII T:
Flow measurement is accomplished using a V-notch weir as the primary device and a
totalizer/continuous recording flow meter, which is in accordance with NPDES permit
requirements. The flow meter was last calibrated on September 20, 2008, by J. Thurman Horne,
P.E., of horizon Engineering and Consulting, Inc.

SEWER OVERFLOW
Please be advised that pursuant to Part 11, Section E of your TNPDES permit and North
Carolina Administrative Code ('INCA ) 15A 2B .0506 (a)(2), any failure of collection system,
SEWER OVERFLOW (cont.):
pumpining station or treatment facility resulting in a bypass without treatment of all or any
Portion of the wastewater shall be reported to the appropriate regional office (Mooresville
Regional Office 704/663-1699) as soon as possible but no later than 24 hours from the time the
peat tree becomes aware of the bypass. For spills/bypasses that occur in Mecklenburg County,
it is requested that :V1C 'QP be notified at 704/336-5500. Spills occurring on weekends or
holidays can be reported by calling the North Carolina. Division of Emergency Management at
800i662-
7956. 800/858-03 8, or 191733-330 . A. written report shall also be provided within .five (5)
days of the time of the incident. The report shall contain a description of the bypass, and its
cause; the period of the bypass, including exact dates and tinges, and if the bypass has .not been
corrected, the anticipated time it is expected to continue; and steps taken (or planned) to reduce,
eliminate, and prevent recurrence of the similar events. Any spill that reaches surface waters
(i.e. any shill that reaches any water already present in a conveyance, stream, ditch, etc.) or any
spill greater than 1,000 gallons on the ground that does not reach surface waters must be
reported.
An adequate spill response for those spills reaching surface waters should include an
evaluation downstream of the point at which the spill entered surface waters to determine if a
fish kill occurred. The evaluation should also include the collection of upstream dissolved
oxygen and pH measurements for background information and dissolved oxygen and pH
measurements at multiple points downstream of the entry point to document any negative
impact. Failure to report the bypass of collection system, pumping station or treatment facility
subjects violators to penalties of up to $25,000.00 per day per violation.

parameter laboratory analyses (NC Laboratory Certification #535) and contracts with Water
Tech Labs, Inc. (NC Laboratory Certification #50) located in Granite Galls, NC. Water Tech
Labs, Inc. was not evaluated in this inspection. A_review of documentation/instrumentation

associated with field parameter laboratory analyses was completed during the inspection. No
deficiencies were found.
EFFLUENT CEI IN WATERS:
The discharge to the effluent lift station was clear at the time of the inspection. The
facility discharges to Lake Wylie, which is a Class DVS'-V and B water in the Catawba liver
Basin..

GENERAL:
Mr. Christopher Elmore of the Mecklenburg County Water Quality Program (MCWt P)
last inspected the facility on May 6, 2005. A Compliance Evaluation Inspection Report was
issued on May 31, 2005.
PERMIT:
The NPDES Permit became effective July 1, 2005. The permit properly describes the
facility and appears adequate for the wastewater being treated. The permit expires on June 30,
2010.
The WWTP consists of a 0.0416 MGD extended aeration package wastewater treatment
plant with an equalization basin, flow splitter, dual aeration basins, clarifier, chlorine contact
basin with tablet chlorination tablet dechlorination chamber with aeration; sludge holding tank,
and effluent pump station.
The Operator in Responsible Charge (GR.C) is Mr. Bill Henson. He maintains a North
Carolina Operators Certification Grade IV, certification #7106, which is acceptable for the class
of the facility.
RECORDS/REPORTS:
Discharge Monitoring Reports (DRs) were reviewed for the period March 2005
through February 2006 and appeared to be properly completed. Records, reports, and logs are
well documented and maintained.

EFFLUENT/RECEIVING WATERS:
The discharge to the effluent lift station was clear at the time of the it

only accessible to Heater Utilities, Horizon Engineering and Consulting, Inc., and Liquid Waste.
SLUDGE DISPOSAL:
Liquid Waste, Inc. hauls waste solids off site. The sludge is discharged to the CMU
system through an approved permit. Liquid Waste, Inc. was not evaluated under this inspection.
SEWER OVERFLOW:
Please be advised that pursuant to Part 11, Section E of your NPDES permit and North
Carolina Administrative Code (NCAQ 15A 213 .0506 (a)(2), any failure of a collection systern,
pumping station or treatment facility resulting in a bypass without treatment of all or any portion
of the wastewater shall be reported to the appropriate regional office (Mooresville Regional
Office 704/663-1699) as soon as possible but no later than 24 hours from the time the permittee
becomes aware of the bypass. For spills/bypasses that occur in Mecklenburg County, it is
requested that MCWQP be notified at 704/336-5500. Spills occurring on weekends or holidays
can be reported by calling the North Carolina Division of Emergency Management at 800/662-
7956, 800/858-0368, or 919/733-3300. A written report shall also be provided within five (5)
days of the time of the incident. The report shall contain a description of the bypass, and its
cause; the period of the bypass, including exact dates and times, and if the bypass has not been
corrected, the anticipated time it is expected to continue; and steps taken (or planned) to reduce,
eliminate, and prevent recurrence of the similar events. Any spill that reaches surface waters
(i.e. any spill that reaches any water already present in a conveyance, stream, ditch, etc.) or any
spill greater than 1,000 gallons on the ground that does not reach surface waters must be
reported.

An adequate spill response for those spills reaching surface waters should include an
evaluation downstream of the point at which the spill entered surface waters to determine if a
fish kill occurred. The evaluation should also include the collection of upstream dissolved
oxygen and pH measurements for background information and dissolved oxygen and pH
measurements at multiple points downstream of the entry point to document any negative
impact. Failure to report the bypass of collection system, pumping station or treatment facility
subjects violators to penalties of upto $25,000.00 per day per violation.

last inspected the facility can May 4, 2001. 'A Compliance de valuation Inspection Report was
issued. on May 23, 2001.
PERMIT:
The current permit properly describes the facility and appears adequate for the
wastewater being treated.
The facility consists of a 0.0416 M D extendedaeration package wastewater treatment
plant with an equalization basin, dual aeration basins, clarifier, chlorine contact basin with tablet
chlorination, tablet dechlorination chamber with aeration, effluent weir and effluent pump
station.
The Operator in Responsible Charge (ORC) maintains a North Carolina Operators
Certification Grade I, which is acceptable for the class of the facility.
RECORDS/REPORTS:
Discharge Monitoring Reports ( MRs) were reviewed for the period January ` 001
through December 001 and appeared to be properly completed except as indicated under the
Self -Monitoring Program heading. Records, reports, and logs are clear and well maintained;
FACILITY SITE REVIEW:
All of the major components of the facility were in service and appeared to be operating
properly at the time' of the inspection. The ORC reports that there have been no system
malfunctions that resulted in overflows or bypasses in the last twelve months.
FLOW MEASUREMENT:
Flow measurement is accomplished using a V-notch weir as the primary device and a

to the February 26. 1998 Order for Prehearing Statements in the aboye-captioned matter,
Petitioner Mid South Water Systems, Inc. ("Mid South") submits this Prehearing Statement in
the above -captioned matter.
1. Nature of FngggdLng. it South filed a Petition for a Contested Case Hearing
regarding the assessment of an administrative penalty ("Administn' tive Penalty") by Respondent
State of No Carolina, Department of Environment and Natural Resources, Division of Water
Quality ("DENR") for alleged violations ofN,C.G.S. 143-215.1(a)(6), and relattxl administrative
regulations, regarding the wastewater treatment system serving I-larbor Estates Subdivision,
Mecklenburg County, North Carolina ("Harbor Estater. System").

, the permit was issued, Mid South (which did ot build plant)
believed that the plant (a Cbromaglass system) was inadequate and expressed its concerns to
DEHNR (the Predecessor agency to DENR). Ile inherent design f0ures of Chromaglass
systems are apparent throughout No Carolina. Despite Mid South's expressed reservations
about the adequacies, of the plant, X)EHNR approved the system plans and issued the NPDF-S
Permit. All of the significant violations of the Permit that have occurred since 1991 relate back
to the original, substandard plant that was approved by DEHNR, with actual or ilmplicd
knowledge of the treatment plant's design and operating deficiencios.
When it became apparent that the system, as designed and installed, could not properly
operate with the Performance standards contained in the Permit, Mid South requested variances,
through the process of s, Special Order by Consent ("SOC") of certain of the Permit
requirements. The terms and conditions of the SOC requested by Mid South were strongly
opposed by the regulators and could not be negotiated. The terms requested were not
significantly different froin those normally granted by the Division to other Permitees, with

much larger Eiow limitations, therefore havinga much greater impact on the receiving stream.
From 1991-1996, Mid South tried a variety of different operators and different operating
techniques to try to get the plant to operate with the pennit limits, including preparation of
reports; Only one operator was successfully able to do i . That operator resigned and the plan
regressed to its historic and original) oPeratmg Problem- January and February of 1997

the Administrative Penalty. Reid South maintained and operated the wastewater treatment
equipment, at the Harbor Fstates System, to the best of its ability. Some of the violations
asserted (e.g. t rbity relate to aesthetics, not public health of safety. Some of the penalties
unposed are duplicative — Le. Mid South is penalized for a daily and a monthly violation of the
same standard, during the same month. Months after the operating probleins, were resolved, at
great cost to Mid South, by the installation of a new treatment plant, ]Dr- R responds with
almost $lo,000 of civil penalties for problems that have now been fixed. The amount of the
penalties, and the timing of diem, are grossly disproportionate to the types of violations asserted
and to any actual harm to the environment-, Such penalties are, therefore, excessive and are
arbitrary and capricious:

1. This matter involves the assessment of civil ties dated. January 20, 1998,
against Mid South Water Systeins, Inc., in Mecklenburg County, forth Carolina by the Director
of the Division of "Water Quality, A. Preston Howard, Jr., ".F.,Director, Division of Water
Quality. Controlling ll' tutes, rules, etc. are those cited in the Director's civil penalty assessment
in addition to G.S. 150B and Title 26, Chapter 3'ofthe North Carolina Administrative Code.
The issues to be resolved are whether' the Respondent, in assessing the civil penalty
assessment.
a. acted erroneously by ordering petitioner to pay a fine or civilpenalty;

c. failed to act as required by law or the rules.
:. The Respondent contends that Petitioner violated North Carolina General Statutes

GRAVITY SEWER COLLECTION SYSTEMS PERMIT
This permit shall be effective from the date of issuance until rescinded, shall void Permit No.
WQ0012976 dated October 11, 1996 and shall be subject to the following specified conditions and
limitations:
1. This permit is effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
2. The facilities must be properly maintained and operated at all times.
3. This perit is not transferable. In the event there is a desire for the facilities to change ownership,
or there is a name change of the Permittee, a formal permit request must be submitted to the
Division of Water Quality (Division) accompanied by an application fee, documentation from the
parties involved, and other supporting materials as may be appropriate. The approval of this request
will be considered on its merits and may or may not be approved.
4. A copy of the Record Drawings shall be maintained on file by the Permittee for a minimum of five
years from the date of the completion of construction.
5. Failure to abide by the conditions and limitations contained in this general sewer permit or the
North Carolina Gravity Sewer Design Criteria may subject the Permittee to an enforcement action
by the Division, in accordance with North Carolina General Statute 143-215,6A to 143-215.6C.
6. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required
by this Division, such as the construction of additional or replacement wastewater collection
facilities.
7. Noncompliance Notification:
The Permittee shall report by telephone to the Mooresville Regional Office, telephone number (704)
663-1699, as soon as possible, but in no case more than 24 hours or on the next working day,
following the occurrence or first knowledge of the occurrence of either of the following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable
of adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or
b. Any failure of a sewer line resulting in a by-pass directly to receiving waters without treatment
of all or any portion of the influent to such station or facility.

Persons reporting such occurrences by telephone shall also file a written report in letter form within
five ( days following first knowledge of the occurrence. This report must outline the actions
taken or proposed to be taken to ensure that the problem does not recur.
