Enclosed is a copy of the Compliance Evaluation Inspection Report for the inspection conducted
at the subject facility on December 8, 2016, by Mr. Chad Broadway of the Mecklenburg County Water
Quality Program (MC +QP). This inspection was conducted as part of a cooperative working agreement
between Mecklenburg County and the Division of Water Resources (D ). Please inform the facility's
Operator -in -Responsible Charge (ORC) of our findings by forwarding a copy of the enclosed report. _.
. Broadway was informed during the inspection that the facility has changed Owners from
ECO-Energy Distribution to Lincoln Terminal Company, Inc. in February 2016 DWR has no records
indicating a permit applicationfor aName/Ownership Change was submitted for approval. Please be
advised that NPDES Permits are not automatically transferrable. The new Owner must complete and
submit an application for a Name/Ownership Change to DWR for approval to officially change the
subject permit to the new Owner. Therefore, a completed application for a Name/Ownership Change
(attached to this report) must be submitted to the D (address listed on the application) by January 27
2017. Please also provide a copy of the completed application to this Office (via standard mail or email)
to Mr. Wes Bell, D oore ville Regional Office, by the listed date.

EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their
key milestones, are:
• Phase 1 —Starting on December 21, 2016, regulated entities that are required to submit Discharge
Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently
reporting your DMR data electronically using eDMR, then you simply need to continue reporting
in the same way as you are now, The key change is that, starting on,December 21, 2016,
electronic reporting of DMRs will be required, instead of voluntary.
• Phase 2 — Starting on December 21, 29�% regulated entities that are required to submit certain
other NPDES reports will begin submitting these reports electronically. Reports covered in the
second phase include Notices of Intent to discharge in compliance with an NPDES general permit,
Sewer overflow/Bypass Event Reports, and a number of other NPDES program reports.
Incorporating Electronic Reporting Requirements into NPDES Permits
The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic
reporting requirements into NPDES permits beginning December 21, 2015. Under the new rule, the
electronic reporting process supersede ' s the paper reporting process, According to our files, your NPDES
permit became effective after November 2013, and should contain the requirement to electronically
report your Discharge Monitoring Reports using NC DWR's eDMR system.
In addition to requiring permittees to report information electronically, the rule also requires permittees
to identify the initial recipient for the NPDES electronic reporting data [see 40 CFR 122.41(1)(9)]. initial

recipient of electronic NPDES information from NPDES-regulatedfacilities (initial recipient) means the
entity (EPA or the state authorized by EPA to implement the NPDES program) that is the designated entity
for receiving electronic NPDES Data [see 40 CFR 127.2(b)]. Permittees are required to electronically
submit the required NPDES information to the appropriate initial recipient, as determined by EPA. ByJuly
18, 2016, EPA must identify and publish on its web site and in the Federal Register a listing of initial
recipients by state and by NPDES data group. Once available, you can use EPA's web site to find out or
determine the initial recipient of your electronic submission.
NC DWR has submitted a request to EPA to be the initial recipient for the following NPDES data groups:
1. Discharge Monitoring Reports;
2. General Permit Reports [Notices of Intent to discharge (NOls); Notices of Termination (NOTs)];
3. Pretreatment Program Reports; and
4. Sewer Overflow/Bypass Event Reports
EPA's web site will also link to the appropriate electronic reporting tool for each type of electronic
submission for each state. Instructions on how to access and use the appropriate electronic reporting
tool will be available as well.

If a permittee is unable tc the eDMR system due to a demonstrated hardship or due to the facility
being physically located in an area where less than 10 percent of the households have broadband
access, then a temporary waiver from the NPDES electronic reporting requirements may be granted
and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1.1, 2, ) or
alternative forms approved by the Director. Duplicate signed copies shall be submitted to the
mailing address above.
Requests for temporary waivers from the NPDES electronic reporting requirements must be
submitted in writing to the Division for written approval at least sixty (60) days prior to the date the
facility would be required under this permit to begin using eDMR. Temporary waivers shall be valid
for twelve (12) months and shall thereupon expire. At such time, DMRs, shall be submitted

Facility Summary
This facility is an industrial (flow <1 MGD) collecting stormwater from a Surface -Water Pollution
Prevention System in proximity to above -ground storage tanks (ASTs). Facilitiesinclude surface bulk_
storage of petroleum hydrocarbon fuels in excess of one million gallons and fuel -truck loading racks. There
are no significant changes to this facility since the last permit renewal. The facility consists of the
following wastewater treatment units:
• Oil/water separator
• Carbon adsorption
• Polishing pond

Toxicity This permit requires Acute Toxicity Monitoring testing using Pimephales pro elan to be
performed on an annual basis as a 24-hour static [TAE6C]. The facility has passed toxicity monitoring in
March 2015, The 2013 and 2014 did not indicate pass/fail on DM 2 and the attached effluent toxicity
reporting form AT -I did not indicate pass/fail. However, the forms indicated zero mortality (0%).
Compliance History -- The facility had a TSS limit violation with 110 mg/L (limit 45 mg/L) in October
2013.

For Renewal — This permit reflects discharge at Outfall 001; DWR updated the following:
• added updates to facility map, outfall locations and parameter codes
• added Monthly Average Limit of 30.0 mg/L for Total Suspended Solids (T S)
• for Oil & Grease [00556] the parameter code remains the same for submitting DMR/eDMR, but EPA
method 1664 (ST-HEM) is used with results in mg/L
• replaced Phenol (single compound) [34694] with Total Recoverable; Phenolics [32730]
• added Electronic Reporting - Discharge Monitoring Reports page Section A. (4.),
Stream — Discharge from WWTP for Outfall 001 is into an unnamed tributary to Gum Branch [Stream
Segment I 1-120-5]. The segment is not listed in the 2014 North Carolina Integrated report or 303(d) list.

RECORDSIREPORTS:
Discharge Monitoring Reports (DMRs) were reviewed for the period April 2012 through December
2012. These reports appeared to be properly completed, Facility personnel maintain clear and
organized records and reports. Copies of effluent analytical results, discharge logs, and flow
measurements are readily available at the site.
FACILITY SITE REVIEW:
The facility is engaged in gasoline, diesel, and ethanol fuel storage and distribution. Discharges from
the oil/water separator flow into a containment tank before being treated by the carbon absorption
filters. The discharge from the filters is held in the final containment basin until it is manually
released. All of the major components of Ouffall 001 treatment works were in service and appeared
to be operating properly at the time of inspection.
FLOW MEASUREMENT:
Flow measurement is accomplished by calculating the total rainfall over the drainage area excluding
the built -upon areas.
LABORATORY:
The permittee contracts with Research Analytical Laboratories, Inc. (NC Laboratory Certification # 34)
to perform all analyses specified in the permit. Research Analytical Laboratories, Inc. was not
evaluated under this inspection.
EFFLUENTIRECEIVING WATERS:
Outfall 001 discharges to Gum Branch, which is a Class S-IV water within the Catawba River Basin.
Ouffall 001 was not discharging at the time of the inspection.

SELF -MONITORING PROGRAM:
DMRs and analytical reports were reviewed for the period April 2012 through December 2012, The
DMRs indicate that the facility was in compliance with permit monitoring requirements and discharge
limits during this review period.
OPERATIONS & MAINTENANCE:
The facility and site appeared to be: well operated and maintained. The discharge valve for Outfall'
01 remains locked and must be manually opened for discharge to occur.

The Division of Water Quality is aware that Refuel America, Inc. recently purchased the subject facility
and had the NPDES permit issued in its name. Information provided by Refuel America, Inc.°s
representatives, as found in our files, stated the company planned to test the equipment at the site to
ensure all was in working circler, and that no fuel would be shipped into the site until this was completed.
While the DES permit requires routine monitoring to be conducted on regulated discharges and
monthly reports be submitted documenting the results of monitoring, these requirements have been
suspended until the facility exhibits potential to actually dischargetreated wastewater (in this case
treated stormwater from a petroleum bulk storage facility).
Because some time has passed since the permit was issued in Refuel America, Inc.°s name, and because
only one discharge monitoring report has been submitted to the Division from the facility (results of
hydrostatic tank testing discharge from January 2007), at this time the Division requests that you provide
it with a status report with regard to the current state of operations at the :facility. If the facility is not
currently operational (is not receiving/distributing product to or from its tanks), please provide us with
an estimate as to when this will occur and when you will begin to submit discharge monitoring reports.
This report does not need to be detailed; it simply needs to be a brief and accurate description of
operations as they apply to your requirements as a NPDES per ittee.

water and treated loading rack washwater are then discharged through outfall 001. All petroleum
collected from the oil/water separator is returned to the premiurn gasoline storage tank (Tank #1),
The discharge valve for outfall 001 is kept closed and locked, except during discharge
events.
FLOW MEASUREMENT:
Flow measurement is accomplished by calculating the volume of water in the spill control
basin prior to discharge. This method is allowed by the permit.
LABORATORY:
Analysis of effluent samples is performed by Test America. Test America is certified by
the State of North Carolina to perform analysis on all parameters specified in the permit. Test
America was not evaluated under this inspection.

EFFLUENT/RECEIVINGWATERS:
The facility was not discharging at the time of the inspection. The facility discharges to
an unnamed tributary to Gum Branch, which is a Class WS_ V water in the Catawba River Basin,
via a riprap-lined ditch:
SELF -MONITORING PROGRAM:
DMRs were reviewed for the period December 2000 through November 2001. There was
a reported discharge during April 2001 only, the report for April 2001 indicates that the facility
was meeting permit effluent limits.
Records indicate that all parameters are being monitored in accordance with permit

requirements.
OPERATIONS MAINTENANCE:
The facility and site appeared well operated and maintained. Storm water in the diked
basins is visually inspected for the presence of petroleum sheen prier to discharge.

On July 31, 2001 our office conducted a laboratory inspection at The ADVENT Group's laboratory. During that
laboratory inspection, our office found that this lab conducted an acute tonicity test for Crown Central on 4/6/2001.
Review of the chain -of -custody associated with this test revealed that the sample used in this acute tonicity test arrived at
The ADVENT Group's lab in excess of 4.0 degrees Celsius. Protocol states that effluent samples should be received and
maintained at 4.0 degrees Celsius until used in the. laboratory. This sample was less than 4.0 degrees Celsius when it
arrived at Test America, however; when the sample arrived at The ADVENT Group(the bioassay lab) it was out of
protocol. 'Therefore, we have invalidated the 4/612001 acute toxicity test.
If ail LC50>100% was submitted on Crown Central's monthly monitoring report (DMR) for April, 2001, we
remind you that the DMR submitted to the Division's Central Files must be amended. The effluent DMR facility
information must be completely filled out (at the top of the sheet), and the form should have "CORRECTEDCOPY"
written or typed at the top. The parameter code of your particular toxicity test should be re-entered in an appropriate
column with a brief explanation that the test performed by The ADVENT Group was not suitable as performed. Our office
will expectanother acute toxicity test to be performed during the next discharge event.
One other issue that arose during this laboratory inspection that needs addressing; was the failure of the sample'
collector to completely fill out the chain -of -custody. Please be reminded that your facility should be using the chain -of -

In accordance with Rule 15A NCAC 8G .0406(b), individuals presently working at physical
chemical water pollution control systems holding a valid Grade 1, 11, M, or IV wastewater
treatment plant operator certification, may apply for a conditional operators physical /
chentical certificate without examination. He or she may do so if, he or she has one year
experience and has successfully completed a training school sponsored or co -sponsored by the
Commission for Grade I or Grade 2 Physical / Chemical Water Pollution Control System
Operators. This conditional certirication allows the bearer to act as the ORC or Backup
ORC of that System only. This conditional certification must be renewed annually per
section .0700 of the rules, The Rules for this certification as well as others is found on the
DWQ/Technical Assistance and Certification Unit web page (http://h20.enr.state.nc.us/tacu/).
Plans are now being made to conduct the first physical chemical school in January 15-18,
2002 at the McKimmon Center in Raleigh. This school is co -sponsored by AWWAIWEA
and the NC Water Pollution Control System Operators Certification Conunission. As soon as

Can July 31, 2001 our office conducted a laboratory inspection at The ADVENT Group's laboratory. During that
aboratory inspection, our office found that this lab conducted an acute toxicity test for Crown Central on 4/6/2001.
review of the chain -of -custody associated with this test revealed that the sample used in this acute toxicity test arrived at
Phe ADVENT Grc up's lab in excess of 4.0 degrees Celsius. Protocol states that effluent samples should be received and
naintained at 4.0 degrees Celsius until used in the laboratory. This sample was less than 4.0 degrees Celsius when it
rrrived atTest America, however, when the sample arrived at The ADVENT roup(the bioassay lab) it was out of
)rctocol. Therefore, we have invalidatedthe 4/6/2001 acute toxicity test.
If an L,C50> 100 is was submitted on grown Central's monthly monitoring report (DMR) for April, 2001, we
•emind you that the DMR submitted to the Division's Central Files must be amended. The effluent DMR facility
nformation must be completely filled out (at the top of the sheet), and the form should have "CORRECTED COPY"
written or typed at the top: The parameter code of your particular toxicity test should be re-entered in an appropriate
:olumn with a brief explanation that the test performed by The ADVENT Group was not suitable as performed. Our `office
will expect another acute toxicity test to be performed during the next discharge event.
One other issue that arose during this laboratory inspection that needs addressing was the failure of the sample
collector to completely fill out the chain -of -custody, Please be reminded that your facility should be using the chain -of -
custody from The ADVENT Group rather than Test America. ADVENT's chain -of custody has been approved by our
Unit. In addition, the chain -of -custody should be completely filled out. This includes sample collection date, sample
collection time and the signature of the collector'. These were all missing for the 4/6/21001 toxicity test.

The discharge halve for outfall 001 is kept closed and locked, except during discharge
events.
FLOW MEASUREMENT:
Flow measurement is accomplished by calculating the volume of water in the spill control
basin prior to discharge. This method is allowed by the permit.
LABORATORY:
Analysis of effluent samples is performed by Test America. TestAmerica is certified by
the Mate of North Carolina to perform analysis on all parameters specified in the permit. Test
America was not evaluated under this inspection.

EFFLUENT/RECEIVING WATERS:
The facility was not discharging at the time of the inspection. The facility discharges to
an unnamed tributary to Gum Branch, which is a Class WS-IV water in the Catawba River Basin,
via a riprap-lined ditch.
SELF -MONITORING PROGRAM:
DMRs were reviewed for the period March 2000 through February 2001. The reports
indicate that the facility was meeting permit effluent limits during this period.
Records indicate that all parameters are being monitored in accordance with permit
requirements.
OPERATIONS & MAINTENANCE:
The facility and site appeared well operated and maintained. Storm water in the diked
basins is visually inspected for the presence of petroleum sheen prior to discharge.
