This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Resources (D ). Please inform the facility's Operator -in -Responsible Charge (ORC) of our findings by forwarding a copy of the enclosed report. _. . Broadway was informed during the inspection that the facility has changed Owners from ECO-Energy Distribution to Lincoln Terminal Company, Inc. in February 2016 DWR has no records indicating a permit applicationfor aName/Ownership Change was submitted for approval. Please be advised that NPDES Permits are not automatically transferrable. The new Owner must complete and submit an application for a Name/Ownership Change to DWR for approval to officially change the subject permit to the new Owner. Therefore, a completed application for a Name/Ownership Change (attached to this report) must be submitted to the D (address listed on the application) by January 27 2017. EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their key milestones, are: • Phase 1 —Starting on December 21, 2016, regulated entities that are required to submit Discharge Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently reporting your DMR data electronically using eDMR, then you simply need to continue reporting in the same way as you are now, The key change is that, starting on,December 21, 2016, electronic reporting of DMRs will be required, instead of voluntary. • Phase 2 — Starting on December 21, 29�% regulated entities that are required to submit certain other NPDES reports will begin submitting these reports electronically. Reports covered in the second phase include Notices of Intent to discharge in compliance with an NPDES general permit, Sewer overflow/Bypass Event Reports, and a number of other NPDES program reports. Incorporating Electronic Reporting Requirements into NPDES Permits The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic reporting requirements into NPDES permits beginning December 21, 2015. Under the new rule, the electronic reporting process supersede ' s the paper reporting process, According to our files, your NPDES permit became effective after November 2013, and should contain the requirement to electronically report your Discharge Monitoring Reports using NC DWR's eDMR system. Facilitiesinclude surface bulk_ storage of petroleum hydrocarbon fuels in excess of one million gallons and fuel -truck loading racks. There are no significant changes to this facility since the last permit renewal. The facility consists of the following wastewater treatment units: • Oil/water separator • Carbon adsorption • Polishing pond Monthly�avera e FLOW fMGD) — Last 36 months Mar2012-Feb2 15. [Ave 0,110 MGD; Maximum, Monthly average flow = 0.406 MGD, Minimum, Monthly average flaw = 0:0021 Toxicity This permit requires Acute Toxicity Monitoring testing using Pimephales pro elan to be performed on an annual basis as a 24-hour static [TAE6C]. The facility has passed toxicity monitoring in March 2015, The 2013 and 2014 did not indicate pass/fail on DM 2 and the attached effluent toxicity reporting form AT -I did not indicate pass/fail. However, the forms indicated zero mortality (0%). A — A Reasonable Potential Analysis (RPA) was conducted on Turbidity (34694) because Discharge Monitoring Reports (DRs) reported concentration below method -detection levels (MDLs) for the past four and a half (4 /z) years (Sept20l I-Feb2015) of data. [MTBE, Toluene, Benzene, Ethyl benzene, Single Compound Phenol, Naphthalene, EPA Method 625, and Xylene were below method -detection levels — see attachment] Turbidity did not show reasonable potential to violate state WQS; however, since the predicted' maximum effluent concentration was greater than 5'0% of the allowable concentration quarterly monitoring was maintained. These reports appeared to be properly completed, Facility personnel maintain clear and organized records and reports. Copies of effluent analytical results, discharge logs, and flow measurements are readily available at the site. FACILITY SITE REVIEW: The facility is engaged in gasoline, diesel, and ethanol fuel storage and distribution. Discharges from the oil/water separator flow into a containment tank before being treated by the carbon absorption filters. The discharge from the filters is held in the final containment basin until it is manually released. All of the major components of Ouffall 001 treatment works were in service and appeared to be operating properly at the time of inspection. FLOW MEASUREMENT: Flow measurement is accomplished by calculating the total rainfall over the drainage area excluding the built -upon areas. LABORATORY: The permittee contracts with Research Analytical Laboratories, Inc. (NC Laboratory Certification # 34) to perform all analyses specified in the permit. Research Analytical Laboratories, Inc. was not evaluated under this inspection. EFFLUENTIRECEIVING WATERS: Outfall 001 discharges to Gum Branch, which is a Class S-IV water within the Catawba River Basin. Ouffall 001 was not discharging at the time of the inspection. SELF -MONITORING PROGRAM: DMRs and analytical reports were reviewed for the period April 2012 through December 2012, The DMRs indicate that the facility was in compliance with permit monitoring requirements and discharge limits during this review period. During that laboratory inspection, our office found that this lab conducted an acute tonicity test for Crown Central on 4/6/2001. Review of the chain -of -custody associated with this test revealed that the sample used in this acute tonicity test arrived at The ADVENT Group's lab in excess of 4.0 degrees Celsius. Protocol states that effluent samples should be received and maintained at 4.0 degrees Celsius until used in the. laboratory. This sample was less than 4.0 degrees Celsius when it arrived at Test America, however; when the sample arrived at The ADVENT Group(the bioassay lab) it was out of protocol. 'Therefore, we have invalidated the 4/612001 acute toxicity test. If ail LC50>100% was submitted on Crown Central's monthly monitoring report (DMR) for April, 2001, we remind you that the DMR submitted to the Division's Central Files must be amended. The effluent DMR facility information must be completely filled out (at the top of the sheet), and the form should have "CORRECTEDCOPY" written or typed at the top. The parameter code of your particular toxicity test should be re-entered in an appropriate column with a brief explanation that the test performed by The ADVENT Group was not suitable as performed. Our office will expectanother acute toxicity test to be performed during the next discharge event. One other issue that arose during this laboratory inspection that needs addressing; was the failure of the sample' collector to completely fill out the chain -of -custody. During that aboratory inspection, our office found that this lab conducted an acute toxicity test for Crown Central on 4/6/2001. review of the chain -of -custody associated with this test revealed that the sample used in this acute toxicity test arrived at Phe ADVENT Grc up's lab in excess of 4.0 degrees Celsius. Protocol states that effluent samples should be received and naintained at 4.0 degrees Celsius until used in the laboratory. This sample was less than 4.0 degrees Celsius when it rrrived atTest America, however, when the sample arrived at The ADVENT roup(the bioassay lab) it was out of )rctocol. Therefore, we have invalidatedthe 4/6/2001 acute toxicity test. FLOW MEASUREMENT: Flow measurement is accomplished by calculating the volume of water in the spill control basin prior to discharge. This method is allowed by the permit. LABORATORY: Analysis of effluent samples is performed by Test America. TestAmerica is certified by the Mate of North Carolina to perform analysis on all parameters specified in the permit. Test America was not evaluated under this inspection. EFFLUENT/RECEIVING WATERS: The facility was not discharging at the time of the inspection. The facility discharges to an unnamed tributary to Gum Branch, which is a Class WS-IV water in the Catawba River Basin, via a riprap-lined ditch. SELF -MONITORING PROGRAM: DMRs were reviewed for the period March 2000 through February 2001. The reports indicate that the facility was meeting permit effluent limits during this period. Records indicate that all parameters are being monitored in accordance with permit requirements. OPERATIONS & MAINTENANCE: The facility and site appeared well operated and maintained.
