Dear Sirs:
This is to notify you that a verbal Stop Work Directive was issued to your contractor, Shannon
Miller of Lake Norman Dredging and Marine Construction, on November 20, 2001. The dredge
work for Mountain Point HOA and the other Co -Applicants must stop and can not be continued.
The following violations of the approved Dredge application resulted in the issuance of the Stop
Work Directive:
1. The dredge approval was for the removal of 1852 cubic yards of excavated material. We
estimate approximately 6,000 + cubic ;yards of spoil material may have been. removed.
2. The excavation area was identified in the application to be 275 ft long x 25 ft wide x 4 ft deep,
and 225 ft long x 25 ft wide x 4 ft deep in an "L"- shaped configuration to accomniodate, the
common access area and the private individual lots. The area that was actually dredged did
not conform to the dimensions included in the application which was reviewed by the
resource management agencies and Duke Power.
3. The approved disposal site identified in the application consisted of 2 areas, one 50 ft x 275 ft
and the second 10 ft x 150 ft The actual spoil area dimensions were 125 ft x 420 ft and 80 ft
x 120 ft. Neither area was the approved size and one was not in the location identified in the
application.

The following is a list of the remedial actions t are required to properly permit the actual
work that was conducted
l . Submit, within 60 days, a new excavation application for the work that was conducted,
including copies of notification letters to all agencies + and "after -the -fact permits" from the
agencies that require them, and a sediment & erosion control plan permit from the North
Carolina Department of Environmental and Natural Resources and Mecklenburg County
Department of Environmental Protection.
. Submit a new filing fee of $500,00. The $1,000 deposit will not be required since further
excavation will not be considered.
3. All equipment must be removed from the project boundary within one week upon receipt of
this letter.
Duke Power will not consider any Lake Use Permitting activities in the future including, but not
limited to excavation, until all current issues regarding this unapproved work are resolved
satisfactorily.
Failure to comply with any of the remedial actions listed above may result in further legal action
being brought against you by Duke Power.
I have enclosed a new excavation application that should be completer) and returned to Duke Power

l represent Lake Norman Dredging and they have asked me to write you regarding your
letter to them of December 17, 2001 and your letter of the same date to Mr. Doug Morgan d
others.
My clients are very concerned about your accusations. Most of them are incorrect and
where matters went beyond the permit, you had prier knowledge and gave your consent.
While the project work was going on, Shannon Miller requested several times that you
meet him at the site. You did not do so. After the project was completed and you indicated

with the hydrilla problem. It had to be spread so it could be seeded and still be useable property.
It was seeded and strawed. The spreading may have been a little outside of the designated area.,
but main., that was due to other materials that were already there and the fact of the wetness o
the spoil and the hydrilla problem and the need to have a smooth, well graded and well drained
area. All of this was talked about at the preconstruction meeting with you. You understood and
gave your consent. These were subjects also that Shannon Miller wanted to meet with you ,about
during the project, but you never were willing to meet with him. Shannon Miller also called Joe
Hall with Duke to request a meeting and he refused.
You also indicated that the actual dredge area was greater than the permit. Almost all of
the dredging was within the permitted area. The only area outside of that was the small amount
of dredging between the channels in order to move the dredge and the barge and deal with the
shifting lake level. Again, all of that was discussed with you at the preconsruction meeting and
would have been subjects of further dicuions if you had met with my client during the
project. It should also be noted that other dredging had been: performed in this cove prior to Lake
Norman Dredging ever coming to this cove. Dredging had been performed under some piers and
a channel had been previously dredged.. None of that was by my client.
You also indicated that "approximately 6,000+ cubic yards of spoil material may have
been removed". You are completely mT-o-ng on that! The amount of spoil removed from the
designated dredge area was within the permitted amount. The only amount above that was the
area dredged to move the dredge and barge which was about 600 cubic yards. Show us your
proof that 6,000+ cubic yards was removed. If it was from a cursory inspection of the spoil area,
you will recall that I told you that spoil material and other material already existing was graded.
Wherefore a simple tape measurement of that area cannot be the basis for such a statement as
yours.
What is most disturbing about all of this is that Duke Power has apparently changed its
practices. For years and years, Duke Power lake management people have met with the dredgers
before, during and after dredging projects. Any problems are taken care of during the project.
Duke Power`h always recognized the logistics and problems d unforeseen circumstances o
dredging. Dredging is not an exact science and the lake management people at Duke have
always recognized that. Duke has not required strict adherence to the permits and has allowed
reasonable aecomodations. It is clear that you have not followed. the Duke Power standard
practice with this project:
Lake Norman Dredging is willing to meet with you and anyone else from Duke as well as
the homeowners and the homeowners" association and all of the agencies to whom you sent your
letter and to whom we are sending a copy of this letter. Lake Norman Dredging will meet with

The'`Bi-State Catawba River Task Farce held a regularly scheduled meeting on
Wednesday, August 22 2001 at 9:30 a.m. The meeting was held at Duke Power's Lake
Norman facilities Task Force Chair Dick Christie opened the meeting by welcoming those in
attendance and by announcing that long time Task Force member and former Education
Committee Chair John Baird had passed away.
The first item of business was a presentation of the Integrated River Management
Committee's (IRIC) report. This Committee is chaired by Edna Chirico and was created, as a
result of one of the recommendations of the Task Force's Strategic Plan.
Mire McLaurin started the presentation by providing background can the Committee's
activities. Over the course of four meetings the IRMC :had identified issues, looked at other
organizational designs and developed an organizational design and funding strategy of its own.
Edna Chirico provided more information about the IRMC organizational design that
included a Policy and Technical Committee and answered questions about the design. The
IRMC is set of meet once more to take a final look at it proposal before it is presented at the
Task Force's annual conference in September.
Next Carla DuPuy reported on the activities of the Conference Committee, The
speakers for the Conference which will be held at Stowe Botanical Gardens are now set. The
current agenda includes Humpy Wheeler with the Charlotte Motor Speedway and Paul Bowen
with Coca Cola who will talk about their experiences lining on and using the water from the
river, Senator Fain Clodfelter from North Carolina and Senator Greg Gregory from South
Carolina who will discuss legislative initiatives in each state and Edna Chirico, Sally Knowles
with SC DHEC, Boyd Devane with NC DNR and Lisa Renstram with Voices and Choices
who will form a panel to talk about integrated river management. Tyr. Tim Mead will
moderate that panel. The conference is set for September 121,
Following that presentation, Steve Johnson reported that the Finance Committee had
raised over $1,000 in contributions for the Task Force:
The final item of business was Mike Vead's announcement that the next meeting of the
Task Force would be on November 4''. Darlene Rucken reported that the meeting would be
devoted to looking at stormwater issues.
During lunch, the River Roundup was held and the meeting adjourned at approximately
1:30 p.m. as there was no other business.

Final Report September 10, 2001
As growth and development continue in the Catawba River basin, it is imperative
that a comprehensive and coordinated focus be taken to protect the Catawba River
basin for its many constituents, while maintaining and enhancing sustainable
ecosystems:
There are. many constituents and initiatives that address certain aspects of the
river basin. These efforts include issues of economic impact, protection of water
quality, drinking water supplies, 'fish and wildlife. ;The constituents are basin i e
and include those who obtain drinking water from the basin and whose .sewage is
treated and discharged into the basin; those who enjoy recreation in the basin ;such
as swimming, fishing and wildlife observation; those who enjoy their homes and
access to parks along the basin; and those who have commercial businesses within
the basin.
The states of forth and South Carolina appreciate the positive economic impacts
of the growth in the Catawba River basin, but, at the sage time, are concerned
about growth's negative impacts on the Catawba River basin. To address these
interrelated issues there are many initiatives at the state, federal and local level*
which would benefit from interstate basinw de coordination and oversight.
The Bi-State Catawba River Task Force, as ;part of its 2000 Strategic Plan,
established an ad hoc committee to analyze the potential for a more formal and
integrated approach to river management. After several months of analysis and
discussion, the committee is making the following proposal:
Mission Statement
To ensure the highest quality health of the Catawba River basin, a Bi-State
Catawba River Commission will be enabled through appropriate state action. The
role of the commission will be to coordinate, collaborate and provide oversight on
areas affecting the quality, quantity and aesthetic value of the Catawba River basin.
The commission should have representation from a broad range of constituents.

• Develop and implement a memorandum of agreement between North and South
Carolina to ensure cooperation, coordination and integrated management in
addressing issues related to the basing
• Establish basinwide goals with the guidance of local ,jurisdictions and other
interested parties and develop a report card based on quantifiable attainment
of the basinwide goals. The report card will be issued bi-annually and used to
establish priorities for action.
• Establish review and comment on major state and local issues affecting the
Catawba River basin in both states.
• Identify, research and develop recommendations on issues affecting the
Catawba River basin, taking thoserecommendations to the appropriate agency
for action.
• Educate and inform public of prioritized issues affecting the Catawba River
Basin.
Funding_- commitment from each state
The States of North Carolina and South Carolina have ultimate responsibility
for environmental protection and regional issues, therefore funding should
initially come proportionately from each state. Other sources of funding to be
considered should include private funding, grants and the option for local
government participation.
Structure
Establish the i-State Catawba River Commission That f inal structure should
include an Executive Director and supporting staff, a Policy Committee and
Technical Committee, with comprehensive representation on both committees.
A Policy Committee should be the policy -making agent of the i-State Catawba
River Commission, A Technical Committee should advise the Policy Committee in
matters requiring scientific expertise. All matters referred to the i-State
Catawba River Commission are subject to review by the Technical Committee, The
Technical Committee would be expected to alert the Policy Committee to future
issues.

Duke rower, a Division of Duke Enemy Corporation, requests an additional 90-day extension of the filing
date for the Catawba-Wateree Project No. 2232 Shoreline Management Plan revision from the previously'
approved extension of May 1, 2001 to July 30, 2001.iThe extension is necessary to allow i uke's Lake
Management Staffand contractors adequate time to complete the quality analysis and ground verification
of the shoreline classifications and realignment of the shoreline based on the digital aerial photography, and
modify the draft plan to incorporate the updated data in the final plan. The increased accuracy of the
mapping is essential to filing complete Shoreline Management Tian.
