Yes, we only considered 114 linear feet as permanent loss with our 4/16/2018 NWP 12/14/18 verification. And generally speaking we would not require compensatory mitigation if cumulative permanent loss of streams remains less than 150 linear feet. That is, with the caveat that there are always project -specific variables such as aquatic function, indirect/secondary impacts, etc. that may affect our District's decisions on compensatory mitigation requirements. Since compliance issues are resolved with respect to the road crossing stream impact of the NWP that I verified, any additional proposed impacts would be evaluated/processed by Chris Hopper as the Corps' Alamance Co. project manager. -Dave Bailey David E. The details are still being worked out, but since this NOV has been resolved they would still have up to an additional 36-ft of permanent stream impact if required without triggering mitigation, correct? Going off of the 114-ft of permanent stream impact in the previous permit. Thanks! In regards to our email dated 8/14/2019, documenting non-compliance with Nationwide Permits (NWP) 12, 14, and 18 verified for use on 4/16/2018, 1 have determined the following: Based on your most recent non-compliance resolution proposal sent via email on 10/26/2020, my site visit to review the completed work on 11/17/2020, final planting pictures sent via email on 1/15/2021, and a confirmation email sent 1/20/2021, the Corps will take no further action in this matter. Note that you must continue to comply with all terms and conditions and special conditions of the NWP 12, 14, and 18 verifications for all phases of the Huffman Point residential development. Please be cautioned that the Corps may consider any future unauthorized work of similar nature in waters of the U.S. a willful and intentional violation of Federal law and may result in immediate referral of the matter to the U.S. Attorney or the U.S. Environmental Protection Agency with recommendation for civil and/or criminal prosecution. He sent me pictures just before the holidays and then I was out at the site on December 28t" to look at the repairs. Quick question: during my site visit with Becky on 11/17/2020 she noted that water was not flowing over the boulder cross vane as designed but rather was running around the boulder to one side. Also, water was apparently accessing a void and running under the constructed riffle rather than running on top of it. The pictures indicate that water is still running around the boulder cross vane, and water appears to be running under the constructed riffle at the top and bottom of that feature. The stream has very little flow so they are currently unable to see how the repairs are working as they pumped the water out of the work areas yesterday. I looked at the weather projections and it is not project to rain until the week of thanksgiving. I asked them to temporarily matt the area and that we will have another look to verify the sites function after Thanksgiving. Just wanted to make sure you are ok with this approach. I would prefer not to do the final seeding and planting yet until we know that it is functioning correctly. Let me know your thoughts when you have a minute. Thanks, Becky L.
