to present a conceptual (if not finalized) mrtigatton plan with the environmental documentat�on Approprtate m�t�gation plans will be requ�red prior to issuance of a 401 Water Qualtty Cert�ficat�on 2 2H 0506(h)} m�tigation will be requ�red for �mpacts of greater than 1 acre to wetlands In the event that mrt�gation is requ�red the mit�gation plan shall be designed to replace appropr�ate (ost funct�ons and values The NC Ecosystem Enhancement Program may be ava�lable for use as wetland mrtigation 4 In accordance with the Environmental Management Commission s Rules { 1 SA NCAC 2H 0506(h)} mrtigation will be required for impacts of greater than 150 linear feet to any smgle stream In the event that mrtigahon is required the mrt�gation plan shall be designed to replace appropnate lost functions and values The NC Ecosystem Enhancement Program may be ava�lable for use as stream mrt�gatton 5 NCDWQ is very concerned wrth sediment and erosion �mpacts that could result from th�s pro�ect NCDOT shall address these concerns by descr�bing the potent�al �mpacts that may occur to the aquat�c env�ronments and any mrtigat�ng factors that would reduce the �mpacts 6 If a br�dge is being replaced wtth a hydraul�c conveyance other than another bridge NCDWQ bel�eves the use of a Nationwide Permrt may be requ�red Please contact the US Army Corp of Engineers to determme the requ�red permit(s) If the old bridge is removed no d�scharge of bndge matenal into surface waters �s allowed unless otherwise authorized by the US ACOE Stnct adherence to the Corps of Engmeers guidelmes for bridge demolrtion will be a condrt�on of the 401 Water Qual�ty Cert�ficat�on 8 Whenever poss�ble NCDWQ prefers spann�ng structures Spanning structures usually do not require work within the stream or grubbmg of the streambanks and do not require stream channel realignment The horizontal and vertical clearances provided by br�dges shall allow for human and wildlife passage beneath the structure F�sh passage and nav�gat�on by canoeists and boaters shall not be blocked Br�dge supports (bents) shall not be placed m the stream when poss�ble 9 Bndge deck dra�ns shall not discharge directly mto the stream Stormwater shall be d�rected across the bridge and pre treated through site approprtate means (grassed swales pre formed scour holes vegetated buffers etc ) before entermg the stream Please refer to the most current version of NCDWQ s Stormwater Best Management Practices 10 If concrete is used durmg construction a dry work area shall be mamtained to prevent direct contact between curmg concrete and stream water Water that madvertently contacts uncured concrete shall not be discharged to surface waters due to the potenhal for elevated pH and poss�ble aquat�c life and fish k�lls 11 If temporary access roads or detours are constructed the site shall be graded to �ts preconstruction contours and elevations Disturbed areas shall be seeded or mulched to stabilize the soil and appropriate nat�ve woody species should be planted When us�ng temporary structures the area shall be cleared but not grubbed Clearmg the area with chain saws mowers bush hogs or other mechanized equtpment and leaving the stumps and root mat mtact allows the area to re vegetate naturally and mmim�zes so�l disturbance 12 Placement of culverts and other structures in waters streams and wetlands shall be below the elevat�on of the streambed by one foot for all culverts with a diameter greater than 48 mches and 20 percent of the culvert dtameter for culverts having a diameter less than 48 �nches to allow low flow passage of water and aquat�c ltfe Design and placement of culverts and other structures includ�ng temporary eros�on control measures shall not be conducted m a manner that may result in d�s equil�brium of wetlands or streambeds or banks ad�acent to or upstream and down stream of the above structures The appl�cant is requ�red to provide ev�dence that the equil�br�um is betng mainta►ned if requested m writmg by NCDWQ If this condit�on is unable to be met due to bedrock or other limrtmg features encountered dur�ng construction please contact NCDWQ for guidance on how to proceed and to determ�ne whether or not a permrt mod�ficat�on w►11 be required 13 If multtple pipes or barrels are requ�red they shall be designed to mim�c natural stream cross sect�on as closely as poss�ble including p�pes or barrels at flood plam elevation floodpla�n benches and/or s�lls may be requ�red where appropr�ate Widenmg the stream channel shall be avo�ded Stream channel widenmg at the measures sufficient to protect water resources must be implemented and mamta�ned �n accordance with the most recent vers�on of North Caroltna Sediment and Eros�on Control Plann�ng and Design Manual and the most recent vers�on of NCS000250 16 All work m or adJacent to stream waters shall be conducted in a dry work area unless otherwise approved by NCDWQ Approved BMP measures from the most current vers�on of NCDOT Construct�on and Mamtenance Actrvittes manual such as sandbags rock berms cofferdams and other diversion structures should be used to prevent excavat�on in flowmg water 17 Sediment and erosion control measures shall not be placed m wetlands and streams 18 Borrow/waste areas shall avoid wetlands to the maximum extent practical Impacts to wetlands m borrow/waste areas could precip�tate compensatory mrttgat�on 19 Wh�le the use ofNational Wetland Inventory (NW[) maps NC Coastal Region Evaluat�on of Wetland S�gn�ficance (NC CREWS) maps and soil survey maps are useful tools thetr �nherent maccuracies require that qualified personnel perform onsite wetland delineat�ons prior to permtt approval 20 Heavy equipment shall be operated from the bank rather than m stream channels in order to min�mize sedimentation and reduce the I�kelihood of mtroducing other pollutants into streams Th�s equipment shall be mspected da�ly and mamta�ned to prevent contamtnat�on of surface waters from leaking fuels lubr�cants hydraulic fluids or other toxic mater�als 21 In most cases NCDWQ prefers the replacement of the ex�stmg structure at the same locat�on wrth road closure If road closure is not feasible a temporary detour should be des�gned and located to avoid wetland �mpacts mmimize the need for clearmg and to avo�d destab�lizmg stream banks If the structure will be on a new alignment the old structure shall be removed and the approach frlls removed from the 100 year floodplam Approach fills should be removed and restored to the natural ground elevat�on The area shall be stabilized wrth grass and planted wrth natrve tree species Tall fescue shall not be used in r�par�an areas 22 Riprap shall not be placed m the act�ve thalweg channel or placed m the streambed at the intersection with Kim Mdler Road (SR 1304) Faith Baptist Church is the only observed religious facility in the pro�ect study area The church is located along US 64 approximately 1 200 feet west of its intersection with Kim Mdler Road The pro�ect is bisected by the Eastern Contmental Divide The western portion of the proJect area is in the Savannah River Basin specifically the Toxaway River Sub basin Indian Creek is the largest stream in this section of the pro�ect area It is designated as Class B Trout Waters The central and eastern portions of the pro�ect area are located in the French Broad River Basin specifically the Upper French Broad River Sub basin Morton Creek is the largest creek in this central and eastern portion of the pro�ect area Morton Creek is designated as Class C Trout Waters The study area has a highly rural landscape that presents relatively large contiguous tracts of forested lands The forests consist of primarily oak and hickory hardwood communities in the upland areas and mesic mixed hardwood with hemlock communities in the coves and along streams Areas that are not forested are generally found in the vicinity of the scattered residences which are primardy surrounded by maintained lawns and/or pastures The study area was surveyed dunng June 2011 for federally protected species known from Transylvania County based on the U S Fish and Wildlife Service species list and supplemented with information from the N C Natural Hentage Program Due to a known population of small whorled pogonia located near the pro�ect area all potential habitat for Department of Transportation will hold a citizens informational workshop in September regarding proposed improvements to U.S. 64 from Indian Creek to the easternmost U.S. 64 intersection with Flat Creek Valley Road in Transylvania County. The workshop will take place on Monday, Sept. 23, from 4:30 to 7:30 p.m. at the T.C. Henderson Elementary School gymnasium, located at 11839 Rosman Highway (U.S. 64) in Lake Toxaway. Attendees can drop by any time during the workshop hours to learn more about the project and speak with NDCOT officials. Comments received during the workshop will be considered as project plans are refined. There will not be a formal presentation. The proposed improvements to this 2.1-mile section of U.S. 64 include straightening curves, adding climbing lanes and widening the road in order to improve safety. The project will require additional right-of-way and the relocation of homes and businesses. Right-of-way acquisition is scheduled to begin in February 2014 and construction is planned to start in February 2015. During construction, access will be provided for properties with driveways along the project; although portions of U.S. 64 may be closed to through traffic at stages of the project. Potential detour routes include Flat Creek Valley Road and the combination of Reid Road with Kim Miller Road.
