Gentlemen,
G�ven the perm�tt�ng t�mel�nes and work by the regulatory agents necessary to obta�n a perm�t
to dredge Topsarl Inlet to 16+2, we recogn�ze that �t w�ll not be possible to dredge th�s season �f
we w�sh to dredge deeper than authorized depths The Town has deaded to mod�fy the perm�t
request at th�s t�me to l�m�t excavation w�th�n the federal channel to the federally author�zed
template of 8+2 as we did last year, util�zmg a non-ocean cert�fied dredge We also will be
request�ng perm�ss�on to dredge the shoal which has formed �n the channel at the east end of
Topsa�l Creek For work outs�de of Colregs Demarcat�on Lme (approx�mately Sta 10+00 on the
perm�t drawmgs), we w�ll contmue w�th pursu�ng the MOA to use the Corps fleet for the 2012
season
Revised drawmgs wrll be sent after our surveys of the channels are completed next week
Current estimates are that the dredg�ng will mvo/ve approx�mately 150,000 cy We bel�eve this
will expedite both the state and federal processes and have the best outcome for the future of
Topsa�l In1et and the Topsa�l Beach

The Town �ntends to cont�nue pursuing a perm�t to dredge to 16+2 as part of the 30 year plan,
but real�ze that proper review requ�res more time rhan �s currently pract�cal If we want to
protect port�ons of the beach h�t by Irene and have the �nler open when the 2012 summer
season beg�ns, th�s �s our best course of act�on
