The sub�ect field mvestigation report was c�rculated to your agency on 12/02/2011 Upon receipt of the
application package the US Army Corp of Engineers (USACE) expressed their concerns/obJections regardmg
the increased total depth of the proposed pro�ect (total depth of channel dredging is be�ng mcreased from 8 0
NLW to 16 0+2 NLV� As a result the USACE has requested a meetmg v�nth the applicant and respective
agencies to discuss a possible resolution The date of the meetmg has not yet been finalized however, the
Division of Coastal Management is worlcing closely wrth the USACE to schedule a date pnor to 1/O1/2012 In
the event a revision to the application package is required your agency will be re notified
In addrtion to the USACE s concerns regardmg the proposed dredge depths rt was noted during agency
review there was a discrepancy with the Pro�ect History/Background Section m the Field Investigation Report
(FIR) Specifically the details and lustory of work associated wrth CAMA Ma�or/Dredge and Fill Permit #22
09 (wluch is currently active) The information presented herem should resolve any questions regardmg the
detail/scope of work authorized under CAMA Pernut #22 09 and how it relates to the applicant s current
proposal
The Pro�ect History/Background Section in the FIR (prepared and circulated on 12/2/11) states that
CAMA Permrt #22 09 authonzed a one time beach push to repa�r the dune system after an erosion event
however tlus uiformation is incorrect What should have been stated is that CAMA Ma�or Permrt #22 09
wluch was ongmally issued on 2/27/2009 authonzed beach nourishment to be carned out one time along the
entire reach of Topsa.il Beach utilizmg spoil matenal generated from Borrow Area X", wluch is located along
the eastern side of the ebb shoal delta Shortly after pro�ect completion, the applicant modified CAMA Ma�or
Permrt #22 09 on 12/1/2010 for another round of beach nounshment Under tlus modificahon Borrow Area
X was elimmated as a source srte and portions of the AIWW Topsaal Creek and Banks Channel were added

In addrtion to these source azeas the USACE s Disposal Sites 189 and 203 were also included m the
permit modification Excavation witlun the AIWW was permitted to a depth of 14 a depth of 10 m Topsail
Creek and to a depth of 9 m Banks Channel all relative to Mean Low Water (MLV� Again tlus modification
allowed beach nounshment activrties to be carned out one time along the ent�re beach strand
Now fast forward a little more than a year from the last modification and Topsail Beach is agam
seekuig swtable donor srtes for beach nounshment Under the current proposal they are requesting to utilize
approxunately 700 000 yds3 of compatible sand withui New Topsail Inlet as their sole source for beach fill
Interestmgly their proposal does not mclude any previously authonzed dredged areas with the exception bemg
a 1 OOO lmear foot cut between Banks Channel and Topsail Creek In other words the�r current proposal does
not overlap any other pro�ect authonzed under CAMA Ma�or #22 09 As a whole the Town has received beach
fill from most of the area surroundmg the ebb shoal delta the area withui Topsail Creek DA srte 189 and 203 a
portion of Banks Channel and a portion of the AIWW With tlus request the Town of Topsail Beach has
essentially pursued authonzation to dredge the entire New Topsa.il Inlet system utilizmg the matenal for beach
fill
In closmg this pro�ect should be viewed and considered another modification/component of CAMA
Ma�or Permrt #22 09 sunply because the Town s request is focused prunanly on beach nounshment wrth
navigation being a secondary issue Unless the USACE s mtent is to turn over a federally maintamed navigation
inlet to the local mumcipality rt is suspected that the proposed depth v►nll have to mirror that histoncally
mamtamed by the USACE
