On September 26 2011 the D�vision of Water Qual�ty (DWQ) received your After the Fact application
dated September 23 2011 and Public Notice issued by the USACE on November 4 2011 and rece�ved
by the DWQ on November 4 2011 to impact 540 linear feet of perennial stream to facilitate a water
source for North Carolma Granite Corporat�on at the site The DWQ has determined that your application
was mcomplete and/or provided maccurate �nformation as discussed below The DWQ w�ll requ�re
addrtional information m order to process your application to impact protected wetlands and/or streams on
the sub�ect property Therefore unless we rece�ve five copies of the additional information requested
below we will place this proJect on hold as mcomplete until we receive this addit�onal mformat�on If we
do not receive the requested mformation your pro�ect will be formally returned as mcomplete Please
provide the followmg information so that we may contmue to review your pro�ect

Please address the concerns below of the North Carolma Division of Water Resources as presented m
J�m Mead s letter dated December 1 2011 to Monte Matthews w�th the USACE
The quarry mtake �s located 4 r�ver m�les upstream of Mt Airy s wastewater
treatment plant (WWTP) and the confluence with Lovtlls Creek The WWTP
has a permitted discharge to the Ararat River of 7 mgd Lov�lls Creek �s a 303 d
listed tributary of the Ararat River The Ararat River is 303 d l�sted for turb�dity
in its lower 15 river mile reach to the Yadkm R�ver confluence This
�nformation �s presented for cons�deration of possible cumulatrve impacts
2 The notice states that the quarry presently requ�res 1 75 m�llion gallon per day
(mgd) or 2 7 cubic feet per second (cfs) to cont�nue operation Is thts value a

It is unclear from the drawmgs how the in stream structures w�ll partition flow m
the Ararat R�ver between the downstream flow by and the divers�on mto the
quarry s reservoir Informat�on that would help clar�fy how the d�version and
mtake funct�on mcludes
• The elevation of the lip of the quarry s bank side mtake and the stream
discharge associated with that elevat�on
• The water surface elevation of the r�ver at the 7Q 10 flow
• The rating for the amount of water conveyed through the mtake at
d�fferent depths above �ts l�p
• Water elevations should be prov�ded for cond�tions w�th the �nstream
rock vanes installed It may be necessary to md�cate these elevat�ons at
more than one location — for example at the mtake and for the flow by
port�on of the channel
4 Based on preliminary DWR calculations the stated 2 7 cfs w�thdrawal slight(y

DWR uses the 20% of 7Q10 value as a threshold to determine �f further
evaluation of the unpacts on mstream flow and aquat�c habitat is needed This
evaluarion could mclude a srte specific study to determine instream flow by
requirements for operation of the intake It should be noted that the maximum
mstantaneous w�thdrawal amount is used to calculate the percentage of 7Q10
wrthdrawn If the 2 7 mgd withdrawal is an average daily value and the
instantaneous maximum withdrawal rate is higher then the 20% 7Q10 threshold
would be more sigmficantly exceeded
The appl�cant should provide mformation to help determine if a study to establish
a flow by requirement is requ�red First they should contact the U S Geolog�cal
Survey to obtain a formal estimate of the 7Q10 at the withdrawal location The
application should also mclude an on site drought response plan and any water
reuse/conservat�on efforts that would reduce the wrthdrawal amount when flows
m the Ararat R�ver approach 7Q 10 drought levels
5 DWR s evaluation of instream flow concerns pertams to phys�cal aquatic habttat
Water quality impacts are not part of this evaluation The appropriate DWQ staff
should be consulted to determ�ne if reductions m the 7Q 10 flow at th�s upstream
location at 65 square miles of dramage area would adversely affect ass�milat�ve
capac�ty at the Mt Airy WWTP located farther downstream on the Ararat River

mstallation and intake will function as proposed over t�me
