I551 Ver 3 Surry County Subect Property NC Granite Corporaton — Ararat River Proect AFTER THE FACT Ararat River [030703 12 72 (4 5) C] REQUEST FOR MORE INFORMATION Dear Mr Moles On September 26 2011 the Dvision of Water Qualty (DWQ) received your After the Fact application dated September 23 2011 and Public Notice issued by the USACE on November 4 2011 and receved by the DWQ on November 4 2011 to impact 540 linear feet of perennial stream to facilitate a water source for North Carolma Granite Corporaton at the site The DWQ has determined that your application was mcomplete and/or provided maccurate nformation as discussed below The DWQ wll requre addrtional information m order to process your application to impact protected wetlands and/or streams on the subect property Therefore unless we receve five copies of the additional information requested below we will place this proJect on hold as mcomplete until we receive this additonal mformaton If we do not receive the requested mformation your proect will be formally returned as mcomplete Please provide the followmg information so that we may contmue to review your proect Addtionat Informaton Requested Please address the concerns below of the North Carolma Division of Water Resources as presented m Jm Mead s letter dated December 1 2011 to Monte Matthews wth the USACE The quarry mtake s located 4 rver mles upstream of Mt Airy s wastewater treatment plant (WWTP) and the confluence with Lovtlls Creek The WWTP has a permitted discharge to the Ararat River of 7 mgd Lovlls Creek s a 303 d listed tributary of the Ararat River The Ararat River is 303 d lsted for turbdity in its lower 15 river mile reach to the Yadkm Rver confluence This nformation s presented for consderation of possible cumulatrve impacts 2 The notice states that the quarry presently requres 1 75 mllion gallon per day (mgd) or 2 7 cubic feet per second (cfs) to contnue operation Is thts value a daily Informaton that would help clarfy how the dversion and mtake functon mcludes • The elevation of the lip of the quarry s bank side mtake and the stream discharge associated with that elevaton • The water surface elevation of the rver at the 7Q 10 flow • The rating for the amount of water conveyed through the mtake at dfferent depths above ts lp • Water elevations should be provded for condtions wth the nstream rock vanes installed It may be necessary to mdcate these elevatons at more than one location — for example at the mtake and for the flow by porton of the channel 4 Based on preliminary DWR calculations the stated 2 7 cfs wthdrawal slight(y exceeds the volume of water equiva(ent to 20%7Q10 See below NC USGS Station #02113850 ARARAT RNER AT ARARAT Daly uses the 20% of 7Q10 value as a threshold to determine f further evaluation of the unpacts on mstream flow and aquatc habitat is needed This evaluarion could mclude a srte specific study to determine instream flow by requirements for operation of the intake It should be noted that the maximum mstantaneous wthdrawal amount is used to calculate the percentage of 7Q10 wrthdrawn If the 2 7 mgd withdrawal is an average daily value and the instantaneous maximum withdrawal rate is higher then the 20% 7Q10 threshold would be more sigmficantly exceeded The applcant should provide mformation to help determine if a study to establish a flow by requirement is requred First they should contact the U S Geologcal Survey to obtain a formal estimate of the 7Q10 at the withdrawal location The application should also mclude an on site drought response plan and any water reuse/conservaton efforts that would reduce the wrthdrawal amount when flows m the Ararat Rver approach 7Q 10 drought if reductions m the 7Q 10 flow at ths upstream location at 65 square miles of dramage area would adversely affect assmilatve capacty at the Mt Airy WWTP located farther downstream on the Ararat River 6 The applicant should provide a mamtenance plan to assure that the proposed mstallation and intake will function as proposed over tme NC Granite Corporation Page 3 of 3 December 14 2011
