1. Please submit a low density Supplement EZ form for the project. The form can be found on the
Stormwater Design Manual website [15A NCAC 02H .1042(3)(b)].
RESPONSE: The form is attached.
2. Please include calculations to show that the vegetated conveyances will not be eroded by the peak
flow from the 10-year storm event [15A NCAC 02H .1003(2)(c)(ii)].
RESPONSE: The Channel Analysis attached shows the vegetation is stable and the underlying substrate is
unstable. However, the Permanent Swale/Clean Water Diversion Installation detail on Sheet C7.0
requires matting to be installed which would stabilize the underlying substrate and prevent erosion of
the vegetated conveyance ditches.
3. Please submit an Operation and Maintenance Agreement and Plan for the project. You can utilize the
O&M EZ form, which can be found on the Stormwater Design Manual website [15A NCAC 02H
.1042(2)(j), 15A NCAC 02H .1050(11) & (12)].
RESPONSE: The agreement form is attached.
4. Please show all the swales labeled in a permanently recorded easement [15A NCAC 02H .1042(2)(l),
15A NCAC 02H .1050(9)].
RESPONSE: The swales that are proposed along the roadways are located within the public right of way,
see the roadway typical section on Sheet C2.0, and no easement would be required. Easements are
proposed for existing drainage swales and are shown on Sheets C2.1 through C2.5.

5. Please provide a copy of the pending sales agreement to verify that the applicant has obtained legal
rights to submit a stormwater permit application [15A NCAC 02H .1042(2)(c)].
RESPONSE: The agreement is attached, see Section 5.01 that allows the developer to obtain permits
required for the project.
6. Please provide a deed restriction and protective easement form for the project [15A NCAC 02H
.1042(2)(l)]. A sample form/template can be found on the Post-Construction Stormwater Website.
RESPONSE: The form is attached.
7. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other documents.
