2 The Permittee shall report any v�olations of this certificatton to the Divis�on of Water Quality w�thm 24 hours of
d�scovery
3 The Permittee shall ensure that the final design draw�ngs adhere to the certiFication and to the draw�ngs
submitted for approval
4 The permittee and its authorized agents shall conduct �ts achvities m a manner consistent with State water
quality standards (mclud�ng any requ�rements resultmg from compl�ance with §303(d) of the Clean Water Act)
and any other appropr�ate requirements of State and Federal law If DWQ determmes that such standards or
laws are not being met (tncludmg the fa�lure to sustam a designated or achieved use) or that State or federal law
�s bemg v►olated or that further conditions are necessary to assure compliance DWQ may reevaluate and
modify this cemfcahon
5 Erosion and sediment control practices must be m full compl�ance with all spec�ficat�ons governing the proper
design installat�on and operation and mamtenance of such Best Management Pract�ces in order to protect
surface waters standards
a The erosion and sediment control measures for the pro�ect must be designed mstalled operated and
mamtamed m accordance with the most recent vers�on of the North Carolina Sedrment and Eros�on
Conlrol Planning and Des�gn Manual
b The design mstal(ation operat�on and maintenance of the sed�ment and eros�on control measures
must be such that they equal or exceed the requirements spec�fied in the most recent vers�on of the
North Carolina Sedrment and Erosron Control Manual The devices shall be mamtamed on all
construction s�tes borrow sites and waste pile (spoil) pro�ects mcludmg contractor owned or leased
borrow pits associated w�th the pro�ect
c For borrow prt s�tes the eros�on and sed�ment control measures must be designed installed operated
and mamtamed m accordance with the most recent version of the North Carolena Surface Mtning
Manual
d The reclamation measures and unplementation must comp(y with the reclamation m accordance with
the requirements of the Sedimentat�on Pollution Control Act
6 If concrete is used durmg construction a dry work area shall be ma�ntamed to prevent direct contact between
curuig concrete and stream water Water that inadvertently contacts uncured concrete shall not be d�scharged to
surface waters due to the potential for elevated pH and possible aquatic life and fish kills
7 The use of r�p rap above the Normal High Water Mark shall be mm�m►zed Any rip rap placed for stream
stabil�zat�on shall be placed m stream channels �n such a manner that ►t does not impede aquatic l�fe passage
8 Durmg the construction of the pro�ect no stagmg of equipment of any kind �s permitted in waters of the U S or
protected ripar�an buffers
9 The dunension pattern and profile of the stream above and below the crosstng shall not be mod�fied
Disturbed floodplams and streams shall be restored to natural geomorphtc condttions
10 I-Ieavy equ�pment shall be operated from the banks rather than m the stream channel m order to mm�mize
sedimentat�on and reduce tlie mtroduct�on of other pollutants mto the stream
11 All mechan�zed equipment operated near surface waters must be regularly mspected and mamtamed to prevent
contammation of stream waters from fuels lubr�cants hydraulic fluids or other tox►c materials
12 No rock sand or other materials shall be dredged from the stream channel except where author�zed by th�s
certification
13 D�schargmg hydroseed m�xtures and washmg out hydroseeders and other equipment m or ad�acent to surface
waters is prohibtted

14 The outside buffer wetland or water boundary located wrth�n the construchon corrtdor approved by th►s
certificat�on shall be clearly marked by h�ghly v�sible fencmg prior to any land disturbmg activit►es Impacts to
areas withm the fenctng are proh�b�ted unless otherwise authorized by this cert�ficatton
15 All stormwater runoff shall be d�rected as sheetflow through stream buffers at nonerosive velocit�es unless
otherwise approved by this certificahon
16 Ali riparian buffers impacted by the placement of temporary fill or clearmg activrties shall be restored to the
preconstruction contours and revegetated Mamtamed buffers shall be permanently revegetated with non woody
spectes by the end of the growmg season followmg complet�on of construcrion For the purpose of th�s
conditton mamtamed buffer areas are defined as areas w�th�n the transportat�on corridor that will be sub�ect to
regular NCDOT mamtenance act�vit�es mcludmg mowmg The area with non mamtamed buffers shall be
permanently revegetated with nattve woody species before the next grow�ng season followmg completion of
construction
17 Pursuant to 15A NCAC 2B 0233(6) sediment and erosion control devices shall not be placed m Zone 1 of any
Neuse Buffer without prior approval by NCDWQ At th�s t�me NCDWQ has approved no sediment and
erosion control devices m Zone 1 outs�de of the approved pro�ect unpacts anywhere on this pro�ect Moreover
sediment and eros�on control dev�ces shall be allowed m Zone 2 of the buffers provided that Zone 1 is not
comprom�sed and that discharge is released as diffuse flow
18 New roadside ditches must be m compl�ance w�th the mtrogen control and dtffuse flow requ�rements outlmed m

19 Nat�ve ripar�an vegetatton (ex list trees and shrubs native to your geographic region) must be reestabl�shed
wrth�n the construct�on l�mtts of the pro�ect by the end of the growing season followmg completion of
construction
20 There shall be no excavation from or waste disposal �nto Jurisdictional wetlands or waters associated w�th th�s
cert�ficat�on without appropr�ate modification Should waste or borrow s�tes or access roads to waste or borrow
s�tes be located m wetlands or streams compensatory mitigation will be required smce that �s a d�rect impact
from road construct►on activit►es
21 Strict adherence to the most recent version of NCDOT s Best Management Pract�ces For Bridge Demolition
and Removal approved by the US Army Corps of Engineers is a condition of the 401 Water Qual�ty
Certification
22 Bridge p�les and bents shall be constructed usmg dr►ven piles (hammer or vibratory) or dr�lled shaft construct�on
methods More spec�fically �etting or other methods of pile drivmg are prohibited without prior wr�tten
approval from NCDWQ
23 All pile drivmg or drilltng activities shall be enclosed m turbid�ty curtains unless otherw�se approved by
NCDWQ m this certification
24 Bridge deck drams shall not d�scharge d�rectly mto the stream Stormwater shall be directed across the bridge
and pre treated through s�te appropriate means (grassed swales pre formed scour holes vegetated buffers etc )
before entermg the stream Please refer to the most current version of Stormwater Best Management Prnct�ces
25 R�prap shall not be placed in the act�ve thalweg channel or placed in the streambed in a manner that precludes
aquatic l�fe passage Btoengmeermg boulders or structures should be properly destgned s�zed and mstalled
26 Upon completion of the pro�ect (includmg any impacts at assoc�ated borrow or waste s�te) the NCDOT
Div�sion Engmeer shall complete and return the enclosed Certification of Completion Form to notify DWQ
when all work included ui the 401 Cert�fication has been completed

27 A copy of this Water Quatity Certificat�on shall be maintamed on s�te at the construction site at all t�mes In
addition the Water Qual�ty Certification and al( subsequent mod�fications if any shall be mamtained with the
