This correspondence is in reference to the Forrest Creek Mrtigation Bank located
approximately seven miles northeast of Hillsborough and six miles northeast of Durham m
northeastern Orange County North Carolma The purpose of this letter is to confirm the year 4
credit release as requested by submrttal of the monitoring report dated September 30 2011
As shown in your amended Mitigation Banking Instrument the credrt release schedule
allows for a 10% release of credits from the total of 7 072 restoration and enhancement credits
Th�s allocates a release of 707 restoration and enhancement credits for the fourth year of
monrtoring By copy of this correspondence we confirm that you have satisfied the above
requirements and that an additiona1707 credits are now available for sale The basis of this
determination results from an on site inspection on November 3rd 2011 as well as subinittal of
the monitoring report showing the site has met all success criteria Please note that 3 additional
years of monitoring within the repair area (beyond the origmal 5 years) is currently required for
complete closeout and final credit release Therefore no additional mitigation credits will be
released unhl the year 8 monrtormg report is submitted wrth no subsequent repairs needed �
