As requested, credit is being released for approved stream restoration and enhancement activities, as well as, wetland rehabilitation and creation activities that satisfy the initial release requirements pursuant to the Mitigation Banking Instrument (UMBI) entitled, "Agreement to Establish the Red Barn Mitigation Bank in the Yadkin River Basin (HUC 03040101), Surry County, North Carolina", approved December 18, 2019 and the final Red Barn Mitigation Plan dated November 2019. As it is laid out in the Credit Release Schedule, 30% of the mitigation site's total stream restoration and enhancement credits and 30% of the site's wetland rehabilitation and creation credits are to be released/have been released for sale at the current milestone being addressed. Credit amounts are based on the revised totals from the as -built survey and previous amount of credits released for the site. Credit amounts released at this time are to equal 1,199.25 Cool Stream Credits and 0.20 Riparian Riverine Forested Wetland Credits. Feel free to contact me with any questions. DEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS 151 PATTON AVENUE ROOM 208 ASHEVILLE, NORTH CAROLINA 28801-5006 October 28, 2020 Regulatory Division Action ID No. SAW-2017-01927 Re: As-Built/MYO credit release of the Red Barn Mitigation Bank Mr. Kevin Tweedy Ecosystem Planning & Restoration, PLLC 1150 SE Maynard Rd., Ste 140 Cary, NC 27511 Dear Mr. Tweedy: This correspondence is in reference to the revised As -Built Baseline Monitoring Report and request for the As -Built credit release, dated September 18, 2020, for the Red Barn Mitigation Bank. Also please reference the initial As -Built Baseline Monitoring Report submitted June 3, 2020 and the NC Interagency Review Team (NCIRT) As -Built site review field meeting held on June 10, 2020. The Red Barn Mitigation Bank Site is located off Ester Drive/Timeless Trail Road, south of NC 80 and approximately 0.5 miles west of Mount Airy in Surry County, North Carolina. The 25.4-acre site project entails stream restoration and enhancement generating cool stream mitigation units (SMU's), as well as, wetland rehabilitation and creation generating riparian wetland mitigation units (WMU's) along tributaries to Stewarts Creek, in the Upper Yadkin Watershed of the Upper Pee Dee River Basin (03040101). Pursuant to the Mitigation Banking Instrument (UMBI) entitled, "Agreement to Establish the Red Barn Mitigation Bank in the Yadkin River Basin (HUC 03040101), Surry County, North Carolina", approved December 18, 2019; and the site -specific Red Barn Final Mitigation Plan dated November 2019, fifteen percent (15%) of the mitigation site's total stream restoration and enhancement credits, as well as, fifteen percent (15%) of the site's wetland rehabilitation and creation credit shall be available for sale immediately upon completion of all initial physical and biological improvements made pursuant to the Mitigation Plan. The revised As -Built Baseline Report referenced above documents a minor reduction in overall credits available based on the as -built surveys and corrections to credit calculations compared to those approved in the final mitigation plan. The revised overall cool stream and riparian wetland credit available for the site is 8,032 SMU's and 2.02 WMU's. By copy of this correspondence, we confirm that you have satisfied the above requirements for the Year 0/As-Built release for all parcels within the bank; and 1,199.25 SMU's and 0.20 WMU's are now available for sale. To account for the overall reduction in stream and wetland credits available for the site, the As-Built/MYO credit release included a minor decrease to account for extra initial credits released. To date, 2,409.60 SMU's constituting thirty percent (30%) of the site's total stream restoration and enhancement credits, as well as, 0.61 WMU's constituting thirty percent (30%) of the site's wetland rehabilitation and creation credits have been released for sale. During the NCIRT site meeting of June 10, 2020, several comments were made by agency representatives regarding concerns noted with the as -built conditions. Some of these concerns have already been addressed as summarized in the cover page of the revised as- built/MYO submitted on September 18, 2020. The remaining concerns to watch throughout monitoring or actions needed include: 1. Concerns regarding the amount of sediment deposition on UT2 where it enters the project area. Make sure this area is monitored closely and add another permanent photo point in this area. Could potentially use photo station 10 but facing upstream. 2. IRT expressed concern for the channel reach just downstream of the crossing on UT 1 due to dry channel conditions at a time when the rest of the site was wet and flowing. Additional monitoring in this area needed to determine if this is a persistent occurrence. Not to far downstream was SG2, but channel was flowing again in this location at the time of the field visit so this gauge may not be helpful in monitoring the dry reach. 3. Either a release or amendments to the CE need to be finalized in three areas. Any fencing (cattle exclusion) and signage needs to be completed in those areas. Thank you for your time and cooperation.
