As requested, 15% of restoration/enhancement and 100% of preservation credit is being released for satisfying the initial release requirements pursuant to the Mitigation Banking Instrument (UMBI) entitled, Agreement to Establish the Upper Rocky Umbrella Mitigation Bank, signed June 30, 2020; and the site -specific Upper Rocky Final Mitigation Plan dated April 2020. In accordance with the plan, 1,350.75 stream mitigation units (SMU's) and 1.786 WMU's are now available for the Upper Rocky Mitigation Site. Feel free to contact me with any questions. DEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS 151 PATTON AVENUE ROOM 208 ASHEVILLE, NORTH CAROLINA 28801-5006 November 27, 2020 Regulatory Division Action ID No. SAW-2015-01816 Re: Initial credit release of the WLS Upper Rocky Umbrella Mitigation Banking Instrument (UMBI) — Upper Rocky Mitigation Site Mr. Adam McIntyre Water and Land Solutions 7721 Six Forks Road Releigh, North Carolina 27615 Dear Mr. McIntyre: This correspondence is in reference to your November 20, 2020 request for the initial credit release for the Upper Rocky Mitigation Site. The Upper Rocky Mitigation Site is located south of William Hough High School, between NC 115 and Bailey Road, in Huntersville, Mecklenburg County, North Carolina. The 43.74-acre project presents 9,685 linear feet (LF) of stream restoration and enhancement generating 9,005 warm Stream Mitigation Units (SMU). It also includes 14.51 acres of wetland re-establishment, enhancement and preservation generating 9.07 Wetland Mitigation Units (WNW), along unnamed tributaries in the Rocky Watershed of the Upper Pee Dee River Basin (03040105). The purpose of this letter is to confirm the initial release of credits for this mitigation site. Pursuant to the Mitigation Banking Instrument (UMBI) entitled, Agreement to Establish the Upper Rocky Umbrella Mitigation Bank, approved June 30, 2020; and the site -specific Upper Rocky Final Mitigation Plan dated April 2020, fifteen percent (15%) of the mitigation site's total restoration and enhancement credits and 100% of the sites preservation credits shall be available for sale immediately upon completion of all the following: a. Execution of the MBI by the Sponsor, the Corps, and other agencies eligible for membership in the IRT who chose to execute the agreement. b. Approval of the Final Mitigation Plan. c. The mitigation site must be secured. d. Delivery of the executed financial assurance documents as described in Section IX of the UMBI and Section 12 of the Upper Rocky Final Mitigation Plan, dated April 2020 and approved August 20, 2020. e. Recordation of the Corps -approved site protection mechanism described in Section X of the UMBI, and both Section 2.3 and Appendix D of the Upper Rocky Final Mitigation Plan, dated April 2020 and approved August 20, 2020, including a title opinion covering the property. f. Issuance of the 404-permit authorization for site construction. By copy of this correspondence, we confirm that you have satisfied the above requirements for initial release for all parcels within the bank; therefore 1,350.75 SMU's and 1.786 WMU's constituting 15% of the mitigation site's total restoration and enhancement credits, as well as, 100% (0.5 WMU's) of site wetland preservation credits are now available for sale.
