The submittal of this permit application serves as the NC Division of Water Resources (NCDWR)
submission following the 30-day Pre-Filing period. No changes to proposed impacts included in the
December 23, 2020 submittal have been made. On behalf of Mr. Jeffrey Taggart (applicant and owner),
please find attached a complete application and supplemental information requesting written concurrence
from the US Army Corps of Engineers (USACE) that the activities associated with the proposed
development of the Taggart Property (Project) may proceed under Nationwide Permit (NWP) 18 and
General Certification (GC) 4139.
Project Summary and Purpose
The proposed project includes the construction of a single-family home and driveway. The +/-18.36-acre
project is located south of the terminus of Rhone Lane in Moncure, Chatham County, NC. Chatham County
lists the parcel PIN as #9679-00-11-0000 (AKPAR 11430). The approximate center of the property is
located at Latitude: 35.6495°N; Longitude: 79.0963°W.
Project Detail
The overall project consists of the construction of a single-family residence and onsite well and septic
systems. Access to the Project will be provided by a gravel drive extending from the terminus of Rhone
Lane. Access to the Site can only be provided by connecting to the terminus of Rhone Lane due to
constraints of adjacent parcels not owned by the landowner. Heavy equipment typically used for utility
installation projects (e.g. back hoes, bull-dozers, etc.) will be utilized.
No federally threatened or endangered species are listed to occur within 1 mile of the Project according to
the NC Natural Heritage Program (NHP) Database (see attached report dated November 12, 2019).
The Site itself is not listed as a historic property or within a historic district. Three historic properties are
located within 1.0 mile of the Site based on a query of the North Carolina State Historic Preservation Office
(NCSHPO) database.

Project History
The Site is undeveloped, forested land. Hardwoods and pines are present throughout the Site. General land use
in the vicinity includes undeveloped, forested land, rural residential, agricultural, and pastureland. Mr. David
Gainey (Sage Ecological) performed a wetland and stream delineation and a PJD meeting was held with
Mr. Andrew Williams (USACE) on July 24, 2020. Mr. Williams agreed with the wetland and stream
delineation; however, a signed preliminary jurisdictional determination from USACE has not been received.
A Chatham County buffer meeting was held with Ms. Kim Hamlin (Sage Ecological) and Mr. Drew Blake
(Chatham County) and a determination letter was obtained on February 4, 2020.
Avoidance and Minimization
The proposed driveway was designed to avoid wetland impacts and to minimize impacts to streams and
riparian buffers. Construction fencing will be used to define the construction corridor and prevent any
accidental additional impacts. Silt fencing will be installed to provide additional protection from runoff.
Project Impacts
Permanent stream impacts total 57 LF for culvert installation for a driveway crossing. Temporary stream
impact of 7 LF are proposed for dewatering to construct the driveway crossing. The Project is within the
Jordan Lake Watershed. Permanent perpendicular riparian buffer impacts total 3,593 sf in Zone 1 and 2,519
sf in Zone 2 for the driveway crossing. Permanent parallel riparian buffer impacts total 1,374 sf in Zone 1
and 2,227 sf in Zone 2 for the driveway. No wetland impacts are proposed.
Mitigation
Permanent stream impacts are less than 150 LF, therefore, no mitigation is proposed. Per the Jordan Lake
Water Supply Watershed Buffer Rule Table of Uses, riparian buffer impacts resulting from driveway
construction for single-family homes are deemed “Allowable” regardless if they are parallel or perpendicular.
No other impacts are proposed that would require mitigation.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
A query of the NCNHP database indicates that there are records for rare species, important natural
communities, natural areas, and/or conservation/managed areas within the proposed project
boundary. These results are presented in the attached ‘Documented Occurrences’ tables and map.
The attached ‘Potential Occurrences’ table summarizes rare species and natural communities that
have been documented within a one-mile radius of the property boundary. The proximity of these
records suggests that these natural heritage elements may potentially be present in the project area
if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one-mile
radius of the project area, if any, are also included in this report.
If a Federally-listed species is documented within the project area or indicated within a one-mile
radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service
(USFWS) for guidance. Contact information for USFWS offices in North Carolina is found here:
https://www.fws.gov/offices/Directory/ListOffices.cfm?statecode=37.
Please note that natural heritage element data are maintained for the purposes of conservation
planning, project review, and scientific research, and are not intended for use as the primary criteria
for regulatory decisions. Information provided by the NCNHP database may not be published
without prior written notification to the NCNHP, and the NCNHP must be credited as an information
source in these publications. Maps of NCNHP data may not be redistributed without permission.
Also please note that the NC Natural Heritage Program may follow this letter with additional
correspondence if a Dedicated Nature Preserve, Registered Heritage Area, Clean Water
Management Trust Fund easement, or an occurrence of a Federally-listed species is documented
near the project area.
