The permit modification request is the result of revisions to the design of the Hilltop Needmore Road extension associated with this project, which were required by NCDOT in a letter dated September i9, zoii. A copy of the NCDOT letter has been provided as an Appendix. The subject property is approximately i48 acres in size and is (ocated on the east and west side of Hwy 55, south of the intersection of Old Adams Road and Hwy 55 in Fuquay-Varina, Wake County, I North Carolina at Latitude: 35.6262765°N and Longitude: 78.8i32i58°W. The site contains unnamed tributaries to Basal Creek and is located in the Neuse River Basin. The Water Quality Classification for these features is: B; NSW, the Cataloging Unit for this site is: 03o2o2oi, and the Stream Index number is:27-43-15-3• ' Project History The Alston Pond Subdivision was previously issued a NWP 29 (AID #200800680), as well as a 4oi WQC and Buffer Authorization (DWQ Project#08-0067,Ver.3) for i47 lf of permanent perennial stream impacts, 27 lf of temporary intermittent stream impacts, o.oi9 acres of permanent wetland impacts, o.oi4 acres of temporary wetland impacts and 33,o5i sq ft of permanent riparian buffer impacts associated with the construction of the Alston Pond Subdivision and Hilltop Needmore Road extension. The previous design of the Hilltop Needmore Road extension utilized retaining to stabilize fill to minimize wetland and stream impacts. Per the letter from NCDOT dated September i9, zoii, NCDOT will not allow the use of retaining walls and require the use of fill siopes at a maximum slope of 2:i for roads dedicated to NCDOT. This resulted in the road crossing being re-designed with fill slopes. The use of fill slopes to stabilize road fill resulted in additional wetland, stream and buffer impacts. The culvert was installed as approved under the previous permits, prior to NCDOTs requiring revisions to the design for removal of the retaining walls and incorporation of fill slopes. Due to the extreme cost of removing the existing culvert and installing a new culvert,design alternatives were explored for maintaining Flow and aquatic life passage through the culvert. The revised impacts are as follows: Wetland/Stream Impacts The currently proposed permanent impacts consist of 297 linear feet of perennial/important stream channel for the road crossing(Impact#3), 0.035 acres of permanent wetland impacts for construction of a channel to direct stream flow to the culvert and fill slopes to stabilize road fill (Impact#1A). Buffer Impacts The revisions to the design of the Hilltop Needmore Road crossing will result in 20,125 sq ft of permanent impacts to Zone 1 (Impact#2) and 9>327 sq ft of permanent impacts to Zone 2 (Impact#2). A copy of the revised PCN has been provided as an Appendix. Avoidanceand Minimization The revised design of the road crossing will utilize a 2:1 slope for fill slopes to minimize impacts, which is the maximum slope allowed by NCDOT. Mitigation Wetland/Stream Mitigation Mitigation was not previously required by the Corps and DWQ as the wetland impacts were less than 0.10 acres and permanent stream im pacts were less than 150 lf. As a result of the redesign of the road crossing, the permanent stream impacts are greater than 150 lf and will require mitigation. The applicant proposes to mitigate for the 297 lf of permanent impacts through the purchase of stream mitigation credits from EBX-EM, LLC at a 2:1 ratio. This will result in the purchase of 594 �f of stream mitigation for this project. A copy of the Letter of Availability from EBX-EM, LLC has been provided as an Appendix. Cumulative permanent wetland impacts continue to be less than o.10 acres. Therefore, wetland mitigation is not proposed. Buffer Mitigation Previously, buffer mitigation was not required for this project as both road crossings associated with this project impacted less than 1/3 acre of buffers at each crossing. However, the redesign of the Hilltop Needmore Road extension crossing will now impact greater than 1/3 acre of buffers and will require mitigation for this crossing. The applicant proposes to mitigate for buffer impacts through the purchase of 74>365�5 sq ft of riparian buffer mitigation from the Wildlands Neuse River Riparian Buffer & Nutrient Umbrella Mitigation Bank. A copy of the Letter of Reservation from Wildlands has been attached as an Appendix. Therefore, the Permit Modification Request will result in approval of 297 lf of permanent stream impacts, 27 lf of temporary stream impacts, 0.054 ac of permanent wetland impacts, 0.014 acres of temporary wetland impacts, 24,63o sq ft of permanent Zone 1 impacts and 23>490 sq ft of permanent Zone 2 impacts. D. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Prior to site plan development,the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and `waters' could be minimized. A stream channel bi-sects the property, and in order to access high ground, impacts were unavoidable. Impacts from the Hilltop Needmore Road extension crossing were minimized by crossing the channel at a nearly perpendicular angle and utilizing 2:1 back slopes (Sheet A). A headwall was utilized to avoid additional wetland impacts from the northern road (Sheet B). Backslopes to stabilize lot fill were designed at a 2:1 slope to minimize wetland impacts as well. The greenway trail was designed to utilized elevated pedestrian bridges at wetland and stream crossings to further minimize wetland impacts.
