As requested, 15% credit is being released for satisfying the second release requirement (completion of all initial physical and biological improvements) pursuant to the Mitigation Banking Instrument (UMBI) entitled, Agreement to Establish the RES Yadkin 01 Umbrella Mitigation Bank, signed by USACE on November 25, 2019, and the Scout Final Mitigation Plan, dated August 2019. In accordance with the plan, 437.7 stream mitigation units (SMU's) are now available for the Scout Mitigation Site. Feel free to contact me with any questions. Also please reference the NC Interagency Review Team (NCIRT) virtual as - built site review held on October 8, 2020. The Scout Mitigation Site is part of the RES Yadkin 01 Umbrella Mitigation Bank, located approximately eight miles west of Clemmons and five miles northwest of Bermuda Run, in Davie County, North Carolina. The 13.22-acre project presents stream restoration and enhancement generating 2,918 warm Stream Mitigation Units (SMU), after non-standard width buffer adjustments, along Hauser Creek and two unnamed tributaries in the Upper Yadkin Watershed of the Upper Pee Dee River Basin (03040101). The purpose of this letter is to confirm the second release of credits for this mitigation site. Pursuant to the Mitigation Banking Instrument (UMBI) entitled, Agreement to Establish the RES Yadkin 01 Umbrella Mitigation Bank, approved December 4, 2019; and the site -specific Scout Final Mitigation Plan dated August 2019, fifteen percent (15%) of the mitigation site's total restoration and enhancement credits shall be available for sale immediately upon completion of all initial physical and biological improvements made pursuant to the Mitigation Plan, dated August 2019 and approved December 4, 2019. By copy of this correspondence, we confirm that you have satisfied the above requirements for the second credit release for all parcels within the bank; and 437.7 SMU's constituting 15% of the mitigation site's total restoration and enhancement credits are now available for sale. Including this credit release, 875.4 SMU's have now been released for the Scout Mitigation Site which totals, 30% of the approved credit, as detailed in the approved final mitigation plan and As -Built Report. During the NCIRT virtual site meeting of October 8, 2020, several comments were made by agency representatives regarding concerns noted with the as -built conditions. These comments were noted in the October 16, 2020 meeting minutes, distributed by RES via email. These include: 1. In order to address concerns regarding changes made to the planting plan (including species planted), RES staff will begin removing all black walnut stems throughout the site, including within vegetation plots. 2. After comments regarding the location of stream gauges being placed mid -way down Reach CH3, RES will locate future gauges closer to the top of reaches for future projects.
