The Division of Water Resources (DWR or the Division) hereby issues the attached NPDES permit and
Authorization to Construct (ATC) for the subject facility. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007, or as
subsequently amended.
DWR has approved your application for 100% domestic discharge from a three (3)-bedroom, single-
family residence. Please note that this permit requires you to abide by.
1. Permit Limits and Monitoring Conditions [Section A. (1.)],
2. Treatment System Maintenance and Record Keeping [Section A. (2.)], and
3. Authorization to Construct (ATC) Treatment Facilities [Section A. (3)].
General Permit vs. Individual Permit. You have been instructed to apply for an individual NPDES
permit for this 100% domestic, single-family residence because your proposed membrane bio-reactor /
nano -filtration treatment system may not be currently permitted under the active General Permit
NCG550000. The Division hopes to resolve issues preventing renewal of this general permit in the
near future.
Please note that you must operate and maintain all components of the approved treatment system such
that its effluent may meet federal and state Surface Water -Quality Standards. Compliance includes
Following manufacturer's guidelines, conducting and documenting system inspections and chemical
analyses, establishing sources for OEM spare parts, making necessary repairs, properly disposing of
residual solids, and documenting said maintenance for the duration of the permit (all records to remain
onsite available for DWR review).

If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within
thirty (30) days after receiving this letter. Your request must take the form of a written petition
conforming to Chapter 150B of the North Carolina General Statutes, and you must file it with the office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless
such a demand is made, this permit shall be final and binding.
This permit is not transferable except after notifying the Division of Water Resources. The Division
may require permit modification, or revocation and re -issuance.' Please note that this permit does not
affect your legal obligation to obtain other permits required by the Division of Water Resources, the
Division of Land Resources, the Coastal Area Management Act, or other federal or local governments.

generated from a three (3)-bedroom single-family residence, consisting of
• buffer tank, influent gravity flow (533 gal)
• equalization tank (290 gal) with air lift / level -control sensor and float
switch on/off alarms (audible and visual)
• filter -membrane tank (182 gal), membrane 0.04 micron (µm) openings with
return activated sludge (RAS) line,
• air supply pump [two (2) each for redundancy] with fine -bubble diffuser
• pressure pump [two (2) each for redundancy]
• reverse osmosis (RO) nano -filtrating unit (effluent disinfection accomplished via
separation by nano -filtration [therefore chlorination / UV not required]
• discharge with effluent -sample point; effluent piping to erosion -control [riprap]
at designated outfall
in support of Mystic River Village, Lot V6, Rocky Water Drive, Topton 28781, and
2. after submitting a signed and stamped North Carolina -certified Engineer's Certification (see
attached form) testifying that said facilities were constructed in accord with this permit and
Authorization to Construct [See Section A. (1)], then
3. begin discharging from said treatment works via Outfall 001, as located on the attached map, into
the Nantahala River [Stream Segment 2-57-(22.5)], a waterbody currently classified B; Trout
within subbasin 04-04-02 of the Little Tennessee River Basin,

Part I
A. (I.) EFFLUENT LIMITATIONS AND MONITORING CONDITIONS
Beginning on the effective date of the permit and lasting until permit expiration, the Permittee is
authorized to discharge from Outfall 001. Such discharges shall be limited and monitored by the
Permittee as specified below:
Footnotes:
1. Flow discharge from 5-bedroom single-family residence (not to exceed 120 gpd /bedroom).
2. Frequency -after compiling an effluent database (minimum 4 sample sets), the Permittee may petition the
Division to review the monitoring frequency, as data warrant.
3. Effluent is defined as wastewater leaving the treatment system. Effluent samples shall be collected immediately
downstream of the treatment system prior to entering the natural environment or waters of the State.
4. All wastewater analyses must be performed using North Carolina -certified test methods.
5. Total Residual Chlorine (TRC) monitoring and reporting is required only if chlorine is added to the treatment
system. The Division will consider analytical result reported above 50µg/L to be compliant with this permit,
however the Permittee shall record all values from NC -certified test methods (including field -certified), even if
these values are below 50µg/L.
i. Solids - the Permittee shall provide for off -site disposal of solids generated by the treatment system in
accordance with all applicable State and local permits and ordinances.
Conditions:
1. The Permittee shall discharge no floating solids or foam.
2. Treatment System Records /Maintenance LOGS shall be maintained onsite, available for
DWR inspection.
3. This treatment and discharge system requires regular maintenance visits and disposal of solids [see
Section A. (2.)].

A. (2.) TREATMENT -SYSTEM MAINTENANCE AND RECORD KEEPING
Permittee's Instructions —Required Maintenance Activities
a. The Permittee shall provide for proper system function to prevent seepage of sewerage to the
ground surface. The Permittee shall adhere to an Operations and Maintenance Plan conforming
to system manufacturer recommendations and State Regulations 15A NCAC 02T .0507.
b. The Permittee shall determine regularly if bio-solids generated during waste treatment must be
removed from the system for off -site disposal. Bio-solids shall be disposed at a location and in
a manner compliant with all applicable local and state permits and regulations.
c. The Permittee shall retain a copy onsite of Division -approved treatment system Plans and
Specifications; also a copy of all sampling logs, maintenance logs, and laboratory analytical
records, for a minimum of three (3) years, available for DWR review and inspection.
A. (3.) AUTHORIZATION TO CONSTRUCT TREATMENT FACILITIES
Engineering Alternatives to Discharge -Analysis of Existing Site Conditions
for Lot V6 -- The Division understands from permit application review that:
• Local soils have been judged unsuitable for conventional subsurface septic tank /leach field by
the Swain County Health Department. Application for Improvement Permit was denied under
15A NCAC 02T, Section .0500 [see SCHD letter dated February 21, 2013].
• Municipal Treatment System — the nearest municipal sewer connection is approximately 8.85
miles (46,731 feet) away. Costs to connect, estimated at $28 per linear foot, equate to an
estimated $1,458,568 for city sewer discharge option.
• Drip or Subsurface Irrigation - The Division understands that Lot V6 was permitted for
drip/subsurface, but only if combined with the adjacent Lot VIA (see attached drawing, Sheet 2
of 3). Considering that Lot V IA is not prepared to build, the Applicant would have to bear the
full financial burden of improvements for both sites [estimated cost $75,000 to $80,000].
• The receivingstream, the Nantahala River [Stream Segment 2-57-(22.5)], Class B; Trout,
exhibits a minimum flow approximating 20.2 MGD [7Q10], according to the USGS.
Based on the above, the Division concurs that surface discharge is the most viable discharge option for
Lot V6. Therefore, the Division hereby authorizes the Permittee to construct a new 100%-domestic

wastewater treatment system (in accord with local building codes) to be designed with discharge rate
not -to -exceed 1,000 GPD [currently estimated flow at 360 gpd (3-bedrooms @120 gpd] consisting of.
• buffer tank, influent gravity now (533 gal, HDPE plastic, Dehoust & Co.
Model PE2000DF) with influent screen (Bear Onsite, model MU 910)
• equalization tank (290 gal, HDPE plastic, Dehoust & Co. Model
PE1100DF) with 1 '/2 inch, schedule 40 PVC air lift,
o 1/2inch air supply line, air lift / level -control sensor
o float switch on/off alarms (audible and visual)
• filter -membrane tank (182 gal), with A3 membrane Dehoust & Co. Model

o membrane filter surface area 52 ft2; 0.04 micron (µm) openings
o filter flow capacity 1,000 gpd for 100% domestic waste
o return activated sludge (RAS) line
o fine -bubble diffuser (EDI - T Series)
• air supply pump [two (2) each for redundancy]; Blue Diamond, Model ET200
• pressure pump [two (2) each for redundancy]; rotary vane, Series 3, Model
319H035F_11BA4; permeate transfer from filter -membrane tank to RO nano -
filtration
• nano -filtration unit -reverse osmosis (RO)_[Axeon, model NF340211;
o effluent disinfection accomplished via separation by nano -filtrating with
second -phase polishing by ROO therefore chlorine / ultraviolet (UV)
disinfection not required
o filter back-wash/bio-solids (20 to 30 gal / month) to be disposed offsite in
accord with all State and local permits and ordinances
• discharge piping (4-inch diam.) with effluent -sample port and erosion -controlled
[riprap] outfall
Treated effluent shall be routed to Outfa11001 discharging to Nantahala River [Stream Segment
2-57-(22.5)], a VV %e ody currently classified B; Trout within subbasin 04-04-02 of the Little
Tennessee River Basin.
Treatment system cleanouts are required and should be installed between the septic tank [if applicable]
and treatment -system transition points and elbows, as well as any transition points in the 4-inch gravity
discharge line. This system, normally requiring a 15-foot setback from the foundation, will be installed
adjacent [set -back hereby waved in deference to the proposed self-contained treatment -system design
and restrictive lot size]. The 50-foot setback from the property lines is likewise waved due to lot size
restrictions. This system shall be sited at least 100 feet from water supply wells, either onsite or offsite.
The Permittee shall provide for awater-tight seal on all treatment/storage units, or minimum two feet
elevated protection from 100-year flood [15A NCAC 02T .0505(m)]. Waivers involving the compliance
boundary shall conform to 15A NCAC 02L .0107. Setback waivers shall be written, notarized, signed by
all parties involved and recorded with the county Register of Deeds.
In the event that treatment facilities fail to perform satisfactorily or create nuisance conditions, the
Permittee shall take immediate corrective action such as maybe required by the Division, including

constructing additional or replacement wastewater treatment(s) or disposal facilities. Failure to abide by
the requirements of this ATC and permit may subject the Permittee to an enforcement action by the
Division of Water Resources in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.
Approved plans and specifications reflect as build" conditions and may not be altered without prior
written notification and approval by the Division. The Permittee shall provide notice to the Asheville
Regional Office (ARO) at least five (5) working days in advance of operation of the installed facilities so
that an onsite inspection may be scheduled, as needed. For further information contact the ARO Surface
Water Protection Section (SWPS) Regional Office Supervisor, Chuck Cranford (828-2964500). Contact
shall be made during normal office hours from 8:00 AM until 5:00 PM, Monday through Friday
excluding State Holidays.
