Dear Wastewater Collection System Owner or Operator,
15 A NCAC 02T — Waste Not Discharged to Surface Waters, was implemented by the
North Carolina Environmental Management Commission on September 1, 2006. These Regulations place
significant, operation, maintenance, and reporting requirements on those entities that own or operate a
wastewater collection system with average daily flows of less than 200,000 gallons per day. This letter is
provided as guidance to assist you in complying with the new reporting and O & M requirements, and to
advise you that you are subject to system review, inspections, and possible enforcement, if the system is
not in compliance with the regulation.
In order to comply with the regulation the following specific criteria is required by 15 A
NCAC 02T .0403:
(1) The sewer system is effectively maintained and operated at all,times to prevent discharge to land or
surface waters, and to prevent any contravention of groundwater standards or surface water standards.
(2) A map of the sewer system has been developed and is actively maintained.
(3) An operation and maintenance plan including pump station inspection frequency, preventative
maintenance schedule, spare parts inventory and overflow response has been developed and implemented.
(4) Pump stations that are not connected to a telemetry system (i.e., remote alarm system) are inspected by
the permittee or its representative every day (i.e., 365 days per year). Pump stations that are connected
to a telemetry system are inspected at least once per week.
(5) High -priority sewers are inspected by the permittee or its representative at least once every six -months
and inspections are documented. Northcarolina

(6) A general observation by the permittee, or its designated representative, of the entire sewer system is
conducted at least once per year.
(7) Overflows and bypasses are reported to the appropriate Division regional office in accordance with
15A NCAC 02B .0506(a), and public notice is provided as required by G.S. 143-215.1C.
(8) A Grease Control Program is in place as follows:
(A) For publicly owned collection systems, the Grease Control Program shall include at least biannual
distribution of educational materials for both commercial and residential users and the legal means to
require grease interceptors for new construction and retrofit, if necessary, of grease interceptors at existing
establishments. The plan shall also include legal means for inspections of the grease interceptors,
enforcement for violators and the legal means to control grease entering the system from other public and
private satellite sewer systems.
(B) For privately owned collection systems, the Grease Control Program.shall include at least biannual
distribution of grease education materials to users of the collection system by the permittee or its
representative.
(C) Grease education materials shall be distributed more often than required in Parts (A) and (B)
of this Subparagraph if necessary to prevent grease -related sanitary sewer overflows.
(9) Right-of-ways and easements are maintained in the full easement width for personnel and equipment
accessibility.
(10) Documentation shall be kept for Subparagraphs (a)(1) through (a)(9) of the Rule for a minimum of
three years with exception of the map, which shall be maintained for the life of the system.
(b) Private collection systems on a single property serving an industrial facility where the domestic
wastewater contribution is less than 200,000 gallons per day shall be deemed permitted.
(c) The Director may determine that a collection system should not be deemed to be permitted in
accordance with this Rule and Rule .0113 of the Subchapter. This determination shall be made in
accordance with Rule .0113(e) of the Subchapter.
Please be advised that the Asheville Regional Office will be performing NPDES Wastewater Collection
System inspections sometime in the near fature. If this office has not previously inspected your wastewater
collection system and records of same, you should be prepared to demonstrate compliance with all criteria listed
above. In an effort to promote compliance with the regulation and offer assistance please see enclosed a copy of
the 02T regulation regarding deemed wastewater collection system O & M.
Also, this office has a WWTP Consultant on staff to offer assistance to you in complying with the
requirements of the regulation. If you decline assistance, are inspected, and don't meet the requirements of the
regulation, you will receive a "Notice of Violation" and will be subject to possible enforcement action.

iNTERLOCAL AGREEMENT
SEWER COLLECTION SYSTEM
THIS AGREEMENT is entered into this the 17`h day of June, 2003, by
and between the Town of Forest City ("Forest City"), and the Town of Ellenboro
("Ellenboro');
WITNESSETH:
THAT WHEREAS, the parties hereto are municipalities located within
Rutherford County, North Carolina; and
WHEREAS, Forest City has an established sewage collection system (the
"Forest City System") in and about its city limits which includes a sewage treatment plant
located on Broad River in which it currently treats the sewage collected by its System;
and
WHEREAS, Ellenboro desires to establish and construct a sewage
collection system (the 'Ellenboro System") within and about its city limits and desires to
connect its System to Forest City's System in order that the sewage from Ellenboro's
System may be treated by Forest City's Sewage Treatment Plant; and
WHEREAS, in order to treat the sewage from the Ellenboro system
certain improvements will need to be made to the Forest City System, in addition to the
construction of the Ellenboro System; and
WHEREAS, in order to establish and construct the Ellenboro System and
make the improvements to the Forest City System the parties enter into this interlocal
agreement upon the following terms and conditions.
NOW, THEREFORE, in consideration of the mutual benefits herein
deemed to exist, and pursuant to the provisions of Article 20, Part 1, of Chapter 160A of
the North Carolina General Statutes, the parties agree as follows:
1. Ellenboro will at its cost have professionally prepared designs and
specifications for the construction of the Ellenboro System, and for that portion of the
improvements of the Forest City System necessary to deliver the sewage collected within
the Ellenboro System to the Forest City Sewage Treatment Plant. The designs and
specifications shall include improvements to provide sewer service to EastRutherford
High School. All lift stations shall include back-up power systems for continued
operation of the lift stations in the event of loss of their primary power source, and the
equipment used in the lift stations shall be from the same manufacturer of the equipment
currently being used in the lift stations within Forest City's System. The designs and
specifications shall be approved by Forest City, shall be consistent with designs and
specifications currently used by Forest City for improvements to its System, and be in
compliance with all applicable laws and regulations. Forest City may also participate in

A RESOLUTION ,COMNIITTING CAPACITY TO THE TOWN OF ELLENBORO AT
THE FOREST CITY WASTEWATER TREATMENT PLANT
WHEREAS, the neighboring Town of Ellenboro has applied for a grant from the
Unsewered Communities Program at the Rural Center to develop a sanitary sewer,system
to serve the Town of Ellenboro.
WHEREAS, it is proposed that the subject sanitary sewer system be connected to
the Town of Forest City System and the effluent from this new system be treated at the
Forest City Wastewater Treatment Plant.
WHEREAS, Town Council desires to endorse and support the -construction of the
Town of Ellenboro's sewer systempending completion of final negotiations on the terms
and conditions of arrangements for connecting the new sewer" system to the Town of
Forest City Sewer System.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN .OF' FOREST CITY, NORTH CAROLINA:
Section 1:, The Town of Forest City will commit 75,000 GPD of treatment
capacity at the Forest City. Wastewater Treatment Plant to support this new and added
system load from the Town of Ellenboro.
Section 2: The Town Manager of the Town of Forest City is hereby authorized
and directed to cause a copy of this resolution to be forwarded to the Town of Ellenboro
for its use in submitting requested information to the State of North Carolina.
Section 4: This resolution shall become effective upon its adoption and approval

County Schools. In your letter you request, for budgetary reasons, that the Town of Ellenboro be

of a standby generator. Rutherford County Schools 'in their letter state that the 'maximum amount of

We are aware that the mayor of Ellenboro has requested a waiver for the_em re geney ge erato`r
that was in the original sewer design plans for the,Ellenboro Elementary School. We suppo e
mayor's request and would like to provide a description of our procedures of operation in the
event of a power outage at the school.
There is no standing policy regarding power outages in our schools because each event is treated
on an individual basis. However, our general procedures are described here. The electrical
utility is contacted first for an estimated timeframe to correct the problem. If the power can be
restored in less than hour, then the school continues to operate. The emergency generator on -site
provides power for building egress and emergency communications such as telephones,
intercom, and fire alarms. If the power is not restored within this first hour, the electrical utility
is consulted as to the additional length of time to correct the issue. If the estimated time is less
than one additional hour, then again the school continues to function. If the outage continues or
the problem is not likely to be resolved in an hour, then arrangements are made for the students
to be sent home. Therefore, the maximum time that students and facility would occupy the
school without power would be 2 hours. The emergency generator mentioned above does not
provide power to the . lift station. The maximum . time that wastewater flow that would
accumulate would be 2 hours. In addition, if the school lost power for two hours in the -morning,
the cafeteria would be unable to provide lunch. Therefore the wastewater flow would be
decreased from the normal operation. In either case, the Town of Forest City has the ability to
pump and haul the sewage in the case of extended power outage.. A letter has been provided by
Randy Pennington, Public Works Department for Town of Forest City, describing the procedures
for pumping and hauling wastewater from the school if necessary.

We are aware that the mayor of Ellenboro has requested a waiver for the emerggncygenerator
that was in the original sewer design plans for the Ehenbor-o_Elementary o . As th_e operator
of this sewer system, the Town of Forest City supports the mayor's request and would like to
provide a description of ability to manage the situation in the event of a power outage at the
school.
The Public Works Department would be immediately notified by radio alarm if the power were
disrupted to the lift station at Ellenboro Elementary School. In this event, our procedure is to be
on -site to monitor the levels of wastewater in the wetwell. The high level alarm would activate
when approximately 500 gallons of wastewater collected in the wetwell. There is an additional
1,000 gallons of storage capacity above the high level alarm. We have the ability to pump the
sewage out of the wetwell and haul the wastewater offsite. Our pump truck has a 2,500 gallon
capacity, therefore, if the alarm was activated, the initial 500 gallons of waste could be removed
in one trip by the pump truck. A round trip back to the school would take approximately 30
minutes, and by that time, even if the wetwell were full, we would still have the ability to remove
the entire amount of wastewater.
It is our understanding that the maximum power outage allowed before students are dismissed
would be -two hours. The school has approximately 600 students and the cafeteria would not be
able to operate during a power outage. Estimating a nine -hour workday and using the State's
recommended flow (for permitting "purposes) of 10 gpd per student, the estimated flow for 2
hours would be approximately 1,350 gallons. This amount could easily be handled by pumping
and hauling during that period of time if necessary. Therefore, the Town believes that .there is no
immediate need for an emergency generator or a connection for a generator at this • time. In
addition, the Town of Ellenboro has stated that no additional future connections will be allowed
on this sewer line until an emergency generator is present.

We are aware that the original sewer design plans for the `Ellenbor_o_E'lementary_Schoolw
included anemergency.generator at the lift station. However, based on other needs in the
project, a joint decision with the Town of Forest City (who operates this system) was
made to not install this emergency generator. The school has an emergency generator
that is dedicated to operating the lights in the school given a power outage. It is not
designed to provide power -to the lift'station. '
We are requesting a�waiver on providing this generator for the lift station. We will not
allow any future connections to this sewer line until an emergency generator is present at
the lift station. Supporting information has been provided from the Rutherford County
School system describing the actions taken in the event of a power outage and how the
amount of wastewater discharged from the school would be minimal. Additionally, a
letter has been provided by the Town of Forest City describing their procedures for
pumping and hauling wastewater from the school in the event of an extended power
outage. --

On. May 25, 2005.1 inspected the completed. portion of the Ellenborosewer system as authorized.
by Permit Number WQ0022 77 At that time. three pump stations, and, associated. gravity sewers,
and force mains. had been completed. 1 was accompanied. in my inspection by Dave Odom and
Todd. Frashier both with Odom. Hollifield Associates and. Randy Pennington. with the Town of
Forest City.
i was very pleased with the Quality of construction. During the construction phase Randy had,
made any number of suggestions leading to improved pump stations -
A transformer at one of the lift stations was. in a location making it'vulnerable to vehicle damage..
Steel posts have since been. placed to protect the transformer.
The Ellenboreo Elementary School Lift Station was constructed without installing a standby power
unit even though such is required by Permit Number WQ0022647. Money is becoming an issue for
.this project. Additionally, the thinking is that the school will be closed. in. the event of prolonged
power outage. I told. Dave that the permit would have to be modified to remove the requirement for
standby power. I requested a letter from the Town of Ellenbore requesting removal of the standby

power requirement. Said. letter to be accompanied by a letter from the School. stating that they
understand that when ever power is lost they will head in the direction of shutting down the school.
I will require installation of a quick -hook-up at the pump station. The modified permit will not allow
hooking anything else to the collection system leading to the Ellenboro School Pump Station until
standby power has been installed and will require the closing of the school during power outages.
Randy Pennington is very comfortable regarding his ability to operate the pumps station with out
overflowing during power outages. In addition to Forest city having a portable generator, the Town.
has a pump truck which to Randy is the more useful of the two.

Mr. Black:
As per our conversation, we have reviewed our copy of the letter from NCDENR of
"NOTICE OF VIOLATION" for the sewage overflow that occurred on May 6, 2005. We
understand that our response is a critical component of their assessment of the situation
and are committed to providing any information necessary. NCDENR has asked for
explanations as to the cause of the spill and the authorization of start up without
certification.
The cause of the spill was the failure of a PVC wye in a flushing connection. This line is part
of a project still under construction and had been pressure tested in mid -July, 2004, and was
found to be in compliance. However, it is believed that a shift occurred during operation and
the weight of the check valve on the PVC wye caused the configuration to be unstable
resulting in a split in the PVC. This PVC wye has been replaced with a coupling and will be
replaced permanently with a ductile iron wye.
This pump station and sewer line in question are part of a larger project, and it was our
intention as the consulting engineers to certify the total project at one time upon
completion. The certification date itself was of importance because the Town agreed to
wave tap fees for residences connecting to the system within one year of the certification
date. This policy was established to encourage residents to connect and to improve the
operation of the system. Therefore,'we felt that certifying the entire project would allow
maximum time for connections and be a benefit to the system. We realize at this point,
however, that as the consulting engineers we should have certified each portion of the
line as is was put into operation and established the one-year connection timeframe from
the final certification date.
This portion of line was put in operation prior to completion of the overall project in
order to service the newly constructed Ellenboro Elementary School at the beginning of
the school year (August 2005). We, Odom Hollifield and Associates, authorized the
introduction of sewage to this pump station without partial certification being submitted.

This partial certification was completed and mailed on May 16, 2005. The Town of
Forest City has been conducting inspections of this pump station since the beginning of
its operation. Upon completion of the project, the Town of Forest City will maintain and
operate this sewer system for the Town of Ellenboro.
Please contact my office should additional information be needed. We are eager to
resolve this issue and will dedicate the attention required.

I am responding to your letter dated May 11, 2005 in regards to the sewer system
overflow' on May `6, 2005 in Ellenboro, North Carolina. As the owner of the sewer
system, we recognize our responsibility to act conscientiously and in accordance with
regulations. However, before this recent sewer project, we were an unsewered
community and are relatively inexperienced in terms of the regulatory requirements
involved with such a project. We depended on our consulting engineers, Odom
Hollifield and Associates, to address any issues in order to adequately permit, install, and
certify the sewer project. Odom Hollifield and Associates have accepted the
responsibility for the lack of immediate notification of the spill. There was a lack of
communication between the engineers and the Town of Forest City, who will eventually
operate the system, as to who would contact NCDENR. In addition, please find attached
a letter from_the engineers explaining the cause of the spill, and other items addressed in
your letter'.

Dear Mr. Edwards:
I observed a wastewater spill. of approximately 500 gallons at the Short Road pump station in the
Town of Ellenboro on Friday, May 6. Unfortunately, the spill reached an unnamed tributary to Sandy
Run Creek and was not reported immediately to DWQ or Emergency Management. The cause of the
spill was the failure of a PVC wye in a flushing connection. This line is part of a project still under
construction and had been pressure tested in mid -July, 2004, and was found to be in compliance.
However, it is believed that a shift occurred during operation and the weight of the check valve on
the PVC wye caused the configuration to be unstable resulting in a split in the PVC. The leakage
was identified, the contractor was immediately contacted, and the flushing connection was replaced
with a coupling. Additionally lime was placed on the spill area.
It was noted on Form CS-SSO that immediate 24-hour verbal notification was not given. As stated,
this line is part of a project still under construction. Only a portion of the line is operational which
serves the Ellenboro Elementary School and several homes. Upon completion of the project, the
Town of Forest City will assume ownership of the system. The Town of Forest City was very
responsive in managing the spill and clean-up, however, they have not assumed full responsibility for
the line. As the design engineer, I was on -site, coordinated with the Town representatives, and
discussed immediate and future actions to take. However, the decision of which party would make
contact with DWQ or Emergency Management was not discussed. Each party involved believed that
the other party would take that responsibility. The lack of immediate notification was not an
intentional action, however I, as the Town's representative, should have made that contact.

The Town Forest City implemented an I&I Rehabilitation Project to prevent SSO's.
In September of 2010, McGill & Associates performed an I&I study to inspect and smoke test areas
in the central business district, which is the Brackett's Creek pump station basin. This pump
station receives over half of the Town's collection system flow. The Town performed the smoke
testing in Brackett's Creek basin. McGill did the smoke testing for the Erwin, Woodburn and
Dogwood pump station basins.
In 2011:
Alexander Pump Station: Installed large manhole upstream of Alexander p/s to increase storage
during high flow events and prevent SSOs.
Brackett's Creek Pump Station: As a result of I&I due to heavy rainfall in a short period of
time, SSOs have occurred at the Brackett's Creek pump station. During heavy rain events, the
Town implements by-pass pumping, utilizing a third pump (1.5 MGD Godwin pump) and increased site
monitoring of the system.
Mill Street and Kent Street: Replaced 4100 ft of sewer in & around Mill Street and replaced 600
ft of sewer on Kent Street. Replaced 11 manholes.
In 2012:
Replaced 2000 ft of sewer in and around the McCall Drive housing development area.
The CWSRF (Clean Water State Revolving Fund) awarded tbe_Town .of Forest City with a loan of
$902,700 (1/2 with principal forgiveness). (Contact: Dar! Blaisdell with NCDENR Const Grants &
Loans).
The Collection System is divided into 5 project areas. During 2013, work in project areas 1, 2,
3 and 5 will be performed. Area 4 will be done later.
In 2013:
The completion of the 2013 I&1 Rehabilitation Project should prevent future I&I impacts to the
system and prevent SSOs.

Inspection Summary:
The Town of Forest City maintains the Town of Ellenboro's sewer collection system.
This system has — 6.2 miles of gravity sewer, 7.4 miles of force main and 6 pump stations (with
telemetry and dual alarms).
Total system: — 6.2 miles gravity = 32,598.26 ft
7.4 miles force main = 39,072 ft
. Total feet: 71,670 ft x 10% = 7,167 ft
Manholes: 205 manholes
Cleaning: 2012: 10,393 ft cleaned in Ellenboro
2011: 5,500 ft cleaned in Ellenboro
Ellenboro Elementary School and East High School each have a lift station that pump into
Ellenboro's collection system and are maintained by the Town of Forest City.
The collection system consists of:
39,308 linear feet of 8-inch gravity sewer; a 223 gallon per minute pump station with duplex
pumps, on -site audible and visual high water alarms, and on -site generator with automatic
transfer switch;
— 28,330 linear feet of 6-inch force main; a 57 gallon per minute pump station with duplex
pumps, on -site audible and visual high water alarms, and on -site *generator with automatic
transfer switch;
— 3,105 linear feet of 3-inch force main; a 27 gallon per minute pump station with duplex pumps,
on -site audible and visual high water alarms, and on -site generator with automatic transfer
switch;
— 2,703 linear feet of 2-inch force main; a 21 gallon per minute pump station with duplex pumps,
on -site audible and visual high water alarms, and on -site generator with automatic transfer
switch;
5,207 linear feet of 2-inch force main; a 51 gallon per minute pump station with duplex pumps,
on -site audible and visual high water alarms, and on -site generator with automatic transfer
switch;
1,857 linear feet of 3-inch force main and the discharge of 75,000 gallons per day of
collected domestic wastewater.
