The North Carolina Division of Marine Fisheries (DMF) submits the following comments
pursuant to General Statute 113 131 DMF has reviewed the CAMA Major permit application
from Kevin Price regarding the proposed construction of a two slip docking facility in Hewlett s
Creek Hewlett s Creek is designated as Primary Nursery Area (PNA) Depths at this location
are approximately zero at MLW
Primary Nursery Areas are essential for post larval and Juvenile species of finfish crabs and
shrimp because they afford food and protection during a vulnerable period of their life cycle
To protect such sensitive areas, Division of Coastal Management rules prohibit new dredging in
Primary Nursery Areas and DMF prohibits the use of bottom disturbing fishing gear Operating
boats in shallow water depths often results in bottom disturbance due to prop dredging' The
water depths in this portion of Hewletts Creek are mostly less than 18 inches at MLW
Downstream from this location the deepest depths in the channel are less than 8 inches The
construction of a two slip docking facility at this location will likely result in prop dredging
impacts to PNA
Due to the significant adverse impacts to PNA that are caused by allowing a boat slip in
insufficient water depth, DMF objects to this project DMF would remove its objection if the
project is redesigned to be a viewing platform with handrails
