This correspondence is m response to your letter and email dated 1 August 2011 where you request additional mformation regardmg the previously subrrutted Pre Construction Nohfication (PCI� for lots 13 & 14 of the Equme Acres Subdivision Hopefully witlun tlus letter SEGi will be able to address all the concerns you may have wrth the proposed pro�ect Below you will find your request (atakctzed tert) followed by SEGi s response(bold text) 1) The currently proposed impacts are considered cumulattve with the 0 OS acres of impacts authonzed on February 2 2010 As such cumulative impacts total 0 538 which exceeds the 0 S acre threshold for ampacts authonzed by NWP 39 The Apphcant has revised the site plan in such a way that reduces the proposed impacts to wetlands by 0 349 acres This was made possible by relocahng the Therapy Barn,wWch hmits the impact to road crossmgs only The Apphcant also incorporated retaming walls to further mimmize permanent impact to �urisd�chonal wetlands In total, the Applicant is requeshng approval to permanently impact 0136 acre and temporarily impact 0 06 acre of headwater forest, to facilitate the construchon of the access drrve on Lots 13 & 14 The reduchon m impacts also reduces the cumulahve impacts to wetlands, associated wrth the subdivision, to 0 216 acre Th�s acreage does not exceed the 0 5 acre threshold authorized by NWP 39 Please see the revised Attachment 6, of the previously submitted PCN or Appendix B of the Proposed Mingahon Plan, for details I have also included, w�th th�s letter, the revised Page 6, of the PCN, to reflect the reduced impact acreages 2) The proposed plan does not ensure minamad adverse e,ff'ects on the aquatic envaronment It is of my opinion that the proposed sate plan could be re desagned to further avoid and miramize impacts to wetlands Specafically the covered arena could be moved further south out of wetlands and the buildangs and paddocks north of the wetlands could be re designed to allow the therapy barn to be moved further north out of wetlands thereby mtnimazang impacts to the road crossing only Please see the response to item 1,above 3) Other assues with the proposed pro�ect include the mittgatton plan Based on the mitagation rule where permitted impacts are not tn the service area of an approved matigation bank or in heu fee program that has the appropriate number and resource type of credits available and m cases where a watershed approach zs not practicable the distract engtneer should consider opporturaties to o,f,�set anticipated aquatic resource impacts by requaring on site and m kind compensatory mitigation Mitigatton for this pro�ect includes on site wetland creatton The pro�ect occurs withan the service area of EEP and as such EEP should be uttlized to off set tmpacts unless the applicant can demonstrate that on stte mzttgatton would be more beneficial for the aquattc envtronment SEGi believes the creahon of 0 65 acre of bottomland hardwood forest, within the subdivision common area, would be more beneficial to the aquahc environment than malung payment to the NCEEP, especially as lots are sold and developed The created wetland will provide addihottal physical, b�olog�cal and chem�cal processes to the exishng headwater system of Harnsons Creek, which drains directly�nto the Northeast Cape Fear River As stated in the previously submitted PCN, making a payment to the NCEEP, to offset the impacts associated with the pro�ect, is not econouucally prachcable for the Apphcant Carrently, to offset the proposed wetland impacts through the NC�EP, the Apphcant would be required to purchase 0 5 acre (2 1) of wetland restorahon credit, at a cost of$23,115 00 The previous land owner has agreed to create 0 41 acres of wetland, witWn the Equine Acres Subdrvision common area As part of the agreement, he will provide the machinery and labor to reach the desired depths, which sigruficantly reduces the cost of the proJect With that m mind,the cost to the Applicant will only be the purchasing of the vegetahon, labor to plant and any follow-up reports that may be required SEGi anhcipates that cost to of the creahon pro�ect to be approanmately$10,120 referred to as the Applicants have undertaken development activities witlun Lots 13 and 14 of the Equine Acres Subdivision m Pender County North Carolina However m order to complete the development the Applicant must secure Department of the Army(DA) authonzation in the form of a Nationwide Pernut 39 to impact of 0 136 acre of Section 404 wetlands The impacts are necessary to facilrtate the construction of the access road in and around the proposed structures withm the equestnan therapy development In order to offset the wetland impacts the Applicant proposes to provide permittee responsible rrutigation in the form of wetland creation and preservation The proposed wetland creation is anticipated to replace the functions lost as result of fillmg a portion of the headwater forest II Pro�ect Srte Witlun the pro�ect boundanes (Lots 13 & 14) 5 40 acres of headwater forest was delmeated by Southern Environmental Group Inc and then venfied by the US Army Corps of Engmeers (USACE) The soil type wrtlun the impact area is mapped as Baymeade � Tlus soil senes occurs on broad gently slopmg surfaces of the lower Coastal Plam generally above 20 feet Slopes range from 1 to 4 percent Vegetahon present witlun the unpact area mclude Acer rubrum (red maple) Linodendron tulip�era (tulip poplar) Ilex conacea (tall gallberry) Liguadambar styraciflua (sweetgum) Morella cenfera (wax myrtle) and Quercus alba (wlute oak) Please see Appendix A III Mingation Previously Equme Acres Estates impacted 0 08 acre of Junsdictional wetlands and cumulatively the unpacts are expected to total0 216 acre In order to offset the permanent loss of function due to the wetland unpacts the Applicant proposes to create at a 3 to 1 mitigation to impact ratio 0 65 acre of headwater forest witlun the Equme Acres common area In addition the Applicant will place 4 63 acres of the remairung wetlands located witlun the pro�ect boundanes (Lots 13 & 14) as well as the created wetland into stnct preservation In total5 28 acres of wetlands will be placed mto preservation (see Appendices B and C Site Impact Map and Proposed Creation Area Map respectively) a Creahon(0 65 acres) The first method of proposed mrtigation mcludes the creation of 0 65 acre of headwater forest wetlands The proposed wetland creation area wntlun the Equine Acres common area is located north of the access road m the area previously used as a borrow prt and where a small pond still remams This area abuts a wetland feature that exlubits sirrular charactenstics as that of the unpact areas (see Appendix D — Wetland Creation Vicuuty Map) T'he soil type mapped wrtlun the proposed creation area is Baymeade wlule the soil senes wittun the ad�acent wetlands is mapped as Muckalee The Muckalee soil series is charactenzed as a poorly drained soil that is found on flood plams and is frequently flooded for bnef penods In order to mamtain a uruform hydrologic regune the proposed area will be scraped down to the depth at which the seasonal lugh water table is located (see Appendix E — Wetland Creation Profile) Excavation v�nll not encroach mto the confinement layer or hard pan The area will then be backfilled with a hydnc soil or orgaruc topsoil and planted wrth FAC+ or wetter species Hydrology will be supplied naturally by preciprtation wluch will be in the form of runoff from the ad�acent srte will take place wluch mcreases the need for preservmg wetland functions in a natural state In addition contmued availabilrty of Nationwide or General 404 Per�ruts to surroundmg property owners mcrease the possibility of further degradation of the wetland and rts associated funchons Therefore the Applicant beheves that the preservation of the creation site as well as the remauung wetlands witlun pro�ect boundaries will protect downstream water quahty IV Habitat Values Headwater Forests are highly diverse wetlands that develop m the upper reaches of drainage basms where streams first begm to form and for tlus reason are valuable for pollutant removal They also provide valuable wildlife habrtat These wetlands provide a fnnge habitat m an area where development will likely occupy the ma�onty of the surround�ng land These systems also function to filter water lugh m pollutants pnor to entenng downstream waters thus protecting water qualrty basin wide The vaned plants provide good cover and fruit and nut beanng plants for songb�rds and mammals such as Odocoileus virgmianus (wtute tailed deer) Procyon lotor (racoon) Didelphts Virgznaan (opossum) Sciurus carolanensis (gray squurel) and smaller rodents such as the field mouse This particular headwater forest is too dry to provide a substantial aquahc habitat V Momtonng and Success Criteria To ensure the success of the proposed created wetlands long term momtoruig is anticipated The key m attauung the desired wetland habitat is to assure every measure will be taken to provide the conditions necessary for wetland hydrology to develop m order to establish the desired vegetation Vegetative counts soil charactenstics and hydrologic regunes will be momtored for a five year penod or until the USACE deems the area successful Annual site visrts will be conducted and the findmgs will be reported on an annual basis SEGi proposes these reports be subrrutted to the USACE by the 31 S`of December each year The success cntena of tlus rrutigation srte will be based on the Umted States Army Corps of Enguieers(iJSACE) 1987 Wetlands Delineation Manual (TR Y 87 1) and the Regional Supplement to the Corps of Enguieers Wetland Delineation Manual Atlanhc and Gulf Coastal Plam Region (TR 10 20) The riutigation srte will be deemed successful once it meets the three wetland parameters outlined m the manual and as fiu-ther descnbed ui this section a Vegetahon Vegetative data will be gathered mcluding surnval data of the planted specunens and the presence of nuisance species Species diversrty and composition will be noted For success cntena to be met a surnval rate of 320 planted trees per acre after 2 years and 260 trees per acre after 5 years would nee to be aclueved No one species should account for of 20 mches and will be sealed wrth sand and bentorute The well will take a daily reading of the water table depth which will be processed mto graphs and plotted against National Weather Service rauifall data for the area Success cnteria of the hydrologic parameter requires the site to exlubit one or more of the pnmary mdicators or two or more of the secondary mdicators of hydrology as outlmed in on the Umted States Army Corps of Enguieers (USACE) 1987 Wetlands Delmeation Manual (TR Y 87 1) and the Regional Supplement to the Corps of Engmeers Wetland Delineation Manual Atlantic and
