HiDave/Chad,
I have been talking with Kelly Williams of the NC EEP in Raleigh, as a bacl<up plan to our backup plan for on-site
mitigation at the BBY Cape Fear Marina. Our primary mitigation method for our proposed Phase 1 (0.98 acres) of
maintenance dredging disturbed area x 2 not in-kind mitigation factor= 1.96 Acres is on site mitigation.
(Chad,you don't know about the phasing yet, but I have laid out for Dave 3 phases; Phase One is reduced to the
landward side of the first set of parallel fingers in the southern portion of the marina and a defined distance in the
perpendicular fingers, excluding the catamaran slips at the very southern end of the marina. Phase Two is a 16' swath
from the landward side of the main docks riverward at the catamaran docks; 0.12 acres of bottom. Phase Three is the
remainder 0.75 acres out to the DWQ approved -11 MLW contour. Phase Two doesn't to marginally doesn't need
dredging for catamaran purposes. Phase Three is a place holder for when the economy rebounds such that there are
sufficient larger yachts in the Wilmington Area that dredging to the -11 MLW contour is needed; this may be 20+years
out on the timeline based on current economy.)
The Phase One mitigation would be native marsh grasses from landward to appx 50' landward of the southern main
docl<s, basically a straight line connecting the present maxjut-outs of marsh. First method of remedial action if marsh
growth/survival is not as expected would be a marsh sill option. Kelly has indicated that she did not thinl<that there are

any mitigation banl<s in our hydrologic unit,thus EEP in-lieu Fee Mitigation would be acceptable per state law. (She is
double checl<ing as the DWQ Website with the mitigation banks was not up and running when I talked to her.)
At our location north of the Isabelle Holmes Bridge on the North East Cape Fear River, is the marsh grass considered
to be riparian or coastal? There is a different fee schedule based on type.
Also (for Dave), since Acceptance Letters from NC EEP are only good for 6 months (but renewable) do you feel that we
need acceptance letter in hand in case our mitigation doesn't work, or can we say that we will use an acceptable
mitigation bank if it is available, and if not, then apply to NC EEP?
(For poug/Jim):At the North End of the Marina, I still think that marsh sill/riprap rock sill would be helpful because of
the constant process water discharge from the Sweeney Water Treatment Plant. This would be about 0.1 to 0.16 acres
of area and less than 200 'in length. Spencer Rogers indicated that he feels that some fill is an inferred inclusion of a
marsh sill. I am hoping that the marsh sill is approvable as a general permit orjust as permit condition conformance,
not requiring another minor or major modification process. Please let me know how this needs to be correctly
submitted.
Dave has indicated that when I have my next draft mitigation plan completed,that I send it first as a draft proposal and
then to have another multi-agency meeting on it. Hope to have it by next week, as we are running near to the next
dredge moratorium. I haven't finished new volume calcs, but my Phase One dredge volume is probably down to 2500 cu
yds= 62.5 hours of dredging with an 8" dredge at 40 cu yds/hr.
